    Petitioners  are   the   accused   and   second<\/p>\n
respondent,  the  defacto  complainant in   C.C.No.<\/p>\n
432\/2008  on  the  file  of  Judicial  First  Class<\/p>\n
Magistrate’s Court, Sasthamcotta, taken cognizance<\/p>\n
for the offence under Section 420 read with Section<\/p>\n
34 of Indian Penal Code on Annexure-A3(11) final<\/p>\n
report in Crime No.633\/2007 of Sathamcotta Police<\/p>\n
Station, registered on the basis of Annexure-A3(3)<\/p>\n
complaint filed by the first respondent before the<\/p>\n
Magistrate and sent for investigation under Section<\/p>\n
156(3) of Code of Criminal Procedure. This petition<\/p>\n
is filed under Section 482 of Code of Criminal<\/p>\n
Procedure to quash the cognizance taken contending<\/p>\n
that earlier, Annexure-A1 notice was issued by the<\/p>\n
second respondent to the petitioners claiming that<\/p>\n
late Narayana Pillai, the husband of the second<\/p>\n
petitioner and father of the first petitioner, had<\/p>\n
CRMC 3088\/08              2<\/span><\/p>\n
borrowed Rs.1,60,000\/- and towards its repayment,<\/p>\n
Narayana Pillai issued Cheque No.984925, drawn in<\/p>\n
the account maintained by him in Quilon District<\/p>\n
Co-operative Bank Ltd., Thevalakkara Branch and<\/p>\n
while so, Narayana Pillai died and thereafter,<\/p>\n
second     respondent  presented  the  cheque   for<\/p>\n
encashment and it was dishonoured on the grounds<\/p>\n
‘funds      in   sufficient,   drawer’s   signature<\/p>\n
incomplete\/differs\/required’,   etc. Annexure-A3(3)<\/p>\n
complaint shows that it is the very same cheque,<\/p>\n
based on which a complaint was filed contending<\/p>\n
that the cheque was issued by the second petitioner<\/p>\n
after the first petitioner forged the signature<\/p>\n
therein and representing that the cheque is being<\/p>\n
issued in an account maintained by the second<\/p>\n
petitioner under the guise of repaying the amount<\/p>\n
due from deceased Narayana Pillai and when the<\/p>\n
cheque    was  presented,  it  was dishonoured  and<\/p>\n
petitioners thereby cheated second respondent. But,<\/p>\n
in the light of Annexure-A1 notice, the case in<\/p>\n
CRMC 3088\/08              3<\/span><\/p>\n
Annexure-A3(3) complaint could only be false. It is<\/p>\n
also contended that ingredients of an offence under<\/p>\n
Section 420 of Indian Penal Code is not attracted<\/p>\n
against the petitioners and therefore, cognizance<\/p>\n
should not have been taken.\n<\/p>\n
    2. Though notice was served on the second<\/p>\n
respondent, he did not appear.\n<\/p>\n
    3.     Annexure-A3(3) complaint  as   well   as<\/p>\n
Annexure-A3(11) final report show that prosecution<\/p>\n
case   is    that  under  the  guise  of   repaying<\/p>\n
Rs.1,60,000\/- borrowed by deceased Narayana Pillai,<\/p>\n
the husband of the second petitioner and father of<\/p>\n
the first petitioner, subsequent to his death,<\/p>\n
second petitioner issued Cheque No.984925, making<\/p>\n
second respondent believe that it is issued in the<\/p>\n
account maintained by her, when it was not so and<\/p>\n
instead of the signature of the second petitioner,<\/p>\n
her signature was forged by the first petitioner.<\/p>\n
Annexure-A1 notice sent by Advocate Sri.Saiju Koshy<\/p>\n
for the second respondent to the petitioners on<\/p>\n
CRMC 3088\/08             4<\/span><\/p>\n
16.3.2001 falsifies the allegation in Annexure-A3<\/p>\n
(3)   complaint.  Annexure-A1   establishes   that,<\/p>\n
according to the second respondent, the dishonoured<\/p>\n
cheque was issued by late Narayana Pillai and after<\/p>\n
his   death,  it  was  presented   by  the   second<\/p>\n
respondent and it was dishonoured and being the<\/p>\n
legal heirs, amount due from late Narayana Pillai<\/p>\n
was demanded from the petitioners. If that be the<\/p>\n
case, the allegation in Annexure-A3(3) complaint as<\/p>\n
well as in Annexure-A3(11) final report that the<\/p>\n
cheque was issued by the first petitioner with the<\/p>\n
forged signature of the second petitioner can only<\/p>\n
be rejected on its face. On that sole ground, the<\/p>\n
case is liable to be quashed.\n<\/p>\n
    4. Added to that, there is no case that second<\/p>\n
respondent   had parted  with  any  money  on   the<\/p>\n
representation made by the petitioners. Even if the<\/p>\n
allegation in Annexure-A3(3) complaint is accepted,<\/p>\n
money was borrowed by late Narayana Pillai and not<\/p>\n
the petitioners. If Narayana Pillai died before<\/p>\n
CRMC 3088\/08              5<\/span><\/p>\n
repayment of the amount, second respondent, in law,<\/p>\n
could realise the same only from the assets left<\/p>\n
behind by Narayana Pillai with the petitioners, his<\/p>\n
wife   and  son.  Personally,  petitioners  have  no<\/p>\n
liability    to  discharge.   Therefore,   even   if<\/p>\n
petitioners promised to pay that amount and failed<\/p>\n
to pay the same, no offence under Section 420 of<\/p>\n
Indian Penal Code is attracted. Therefore, even if<\/p>\n
the  allegations   in  Annexure-A3(3)  complaint is<\/p>\n
accepted, which cannot be accepted in the light of<\/p>\n
the case in Annexure-A1 notice, an offence under<\/p>\n
Section 420 of Indian Penal Code is not attracted.<\/p>\n
Therefore, continuation of the proceedings is only<\/p>\n
an abuse of   process of the court.\n<\/p>\n
     Petition is allowed. C.C.No.432\/2008 on the<\/p>\n
file of Judicial First Class Magistrate’s Court,<\/p>\n
Sasthamcotta is quashed.\n<\/p>\n
