L.\nDAVE, J.)\n \n\n \n \n\n\n \n\n1.\t\tThe\n<\/pre>\n<p>appellant is convicted for an offence punishable under Section 307 of<br \/>\nthe Indian Penal Code and is sentenced to undergo rigorous<br \/>\nimprisonment for eight years and to pay a fine of Rs.20,000\/-, in<br \/>\ndefault, to undergo simple imprisonment for two years.  He is also<br \/>\nconvicted for offence punishable under Section 135 of the Bombay<br \/>\nPolice Act and sentenced to undergo simple imprisonment for one<br \/>\nmonth.  Both the sentences are ordered to run concurrently.  The<br \/>\njudgment was delivered by Sessions Court, Bhavnagar, in Sessions Case<br \/>\nNo.38 of 2004.\n<\/p>\n<p>2.\t\tThe<br \/>\nappellant was working with Govindbhai Kanjibhai Jethwa Koli of<br \/>\nMafatnagar Zupadpatti, at Kumbharwada, on Bhavnagar Ruvapari Road and<br \/>\nbecause of some earlier quarrel, the appellant assaulted Govindbhai<br \/>\nKanjibhai around 9.00 P.M. on 10th May, 2003 with a knife<br \/>\nand caused injuries on abdomen, chest and back.  He was, therefore,<br \/>\ncharge-sheeted for offence punishable under Section 307 of I. P. C.<br \/>\non the basis of an F. I. R. lodged by Rupaben, wife of Sanjaybhai<br \/>\nMadhabhai Rathod and daughter of  injured-Govindbhai Kanjibhai.  The<br \/>\nMagisterial Court, Bhavnagar, committed the case to the Court of<br \/>\nSessions and Sessions Case No.38 of 2004 came to be registered.  The<br \/>\nSessions Court framed charge against the accused at Exhibit 6 for<br \/>\noffences punishable under Section 307 of I. P. C. and Section 135 of<br \/>\nthe Bombay Police Act.  The accused pleaded not guilty to the charge<br \/>\nand claimed to be tried.\n<\/p>\n<p>2.1\t\tThe<br \/>\nTrial Court found that the prosecution was successful in establishing<br \/>\nthe charges against the accused and recorded his conviction and<br \/>\npassed the sentence, as stated in the earlier part of the judgment.<br \/>\nThis has given rise to the present appeal.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate, Mr. Shaikh, for the appellant submitted that the appellant<br \/>\nwas in jail during the trial for a period of three months and 21 days<br \/>\nand he is in jail since conviction, i.e. 28th February,<br \/>\n2006.  The main submission is that the prosecution case depends on<br \/>\nevidence of Rupaben, the first informant, and  injured, Govindbhai,<br \/>\nat Exhibits 18 and 51, respectively.  The medical evidence is of Dr.<br \/>\nVarshaben, at Exhibit 28.  Mr. Shaikh submitted that there are<br \/>\ncontradictory versions emerging from their evidence as to the site of<br \/>\ninjury on person of the victim.  Apart from that, Mr. Shaikh<br \/>\nsubmitted that if the evidence of Rupaben, Govindbhai and Dr.<br \/>\nVarshaben is considered together, it would be clear from their<br \/>\ncontradictions that all the injuries cannot be attributed to the<br \/>\naccused.  He also submitted that, even if that is done, all the<br \/>\ninjuries are simple in nature as per  the medical evidence and there<br \/>\nis no evidence to say that they are sufficient in  ordinary course of<br \/>\nnature to cause death.  He, therefore, submitted that the accused<br \/>\ncould not have been convicted for the offence punishable under<br \/>\nSection 307 of the I. P. C.  According to him, at the most, it would<br \/>\nconstitute an offence punishable under Section 324 of the I.P.C. and,<br \/>\nif the Court is of the opinion that the conviction is required to be<br \/>\naltered to one under Section 324 of the I.P.C., then appropriate<br \/>\nalteration in quantum of punishment may also be made.\n<\/p>\n<p>4.\t\tThe<br \/>\nappeal is opposed to by learned Additional Public Prosecutor, Mr.<br \/>\nShah.  According to him, the evidence of Rupaben and Govindbhai, so<br \/>\nfar as involvement of the appellant is concerned, is unchallengeable,<br \/>\nthough there are some discrepancies so far as the number of injuries<br \/>\nand the site of injuries are cocnerned. Mr. Shah submitted that in<br \/>\nspite of the discrepancies, the fact remains that the injuries were<br \/>\nfound on person of the victim, which he attributes to the appellant<br \/>\nand, therefore, involvement of the appellant be given a second<br \/>\nthought.  So far as the nature of offence is concerned, learned<br \/>\nAdditional Public Prosecutor, Mr. Shah, submitted that three injuries<br \/>\nwith knife have to be seriously viewed.  He, therefore, submitted<br \/>\nthat the appeal may be dismissed.\n<\/p>\n<p>5.\t\tOn<br \/>\nexamining the evidence of P.W.4-Rupaben Govindbhai Jethwa (Exhibit\n<\/p>\n<p>18), the first informant, it is found that she is the daughter of the<br \/>\nvictim. She says that she lost her mother, Shantiben, many years back<br \/>\nand, thereafter, her father is staying separately in a hut whereas<br \/>\nshe stays with her grandmother, Liliben.  She says that, at the time<br \/>\nof the incident, around 8.30 P.M., she was going to give water to the<br \/>\nvictim when she saw the appellant assaulting the deceased with a<br \/>\nknife.  She says that she saw the appellant inflicting one knife blow<br \/>\nin the abdominal area of the victim.  She did not notice any other<br \/>\nblow being given or any other injuries.  She also says that on seeing<br \/>\nthe assault being committed by the appellant on the victim, she<br \/>\nbecame unconscious.  During cross-examination, she says that her<br \/>\nfather was sleeping on a cupboard put on its side.  She denies the<br \/>\nsuggestion that she became unconscious on seeing her father bled and<br \/>\nasserts that she saw the appellant hitting her father with a knife.<br \/>\nShe also denies the suggestion that, thereafter, she went to her home<br \/>\nand asserted that she became unconscious on-the-spot. She went to<br \/>\nhospital on regaining consciousness.  The police came to her home at<br \/>\nabout 9.00 P.M. and recorded her F.I.R.  She states that Exhibit 19<br \/>\nis the F.I.R. given by her.\n<\/p>\n<p>6.\t\tInjured-Govindbhai<br \/>\nis examined at Exhibit 51 as P.W.9. He says  that while he was<br \/>\npreparing to sleep, the appellant had come and inflicted knife blow<br \/>\non abdominal portion.  Thereafter, he started running.  The victim<br \/>\nsays that she raised shouts and his daughter arrived, so also his<br \/>\nmother-in-law.  The victim says that one knife blow was given on the<br \/>\nabdomen and the other was given on the groin and, while the appellant<br \/>\nattempted a third blow, he caught hold of his hand.  He says that his<br \/>\ndaughter, Rupa, was coming to give him water and saw the incident.\n<\/p>\n<p>6.1\t\tIn<br \/>\ncross-examination, he admits that he has not stated before police<br \/>\nthat while the accused was inflicting the third blow, he caught hold<br \/>\nof his hand.  Rest of the suggestions are denied by him.\n<\/p>\n<p>7.\t\tThe<br \/>\ndoctor is examined at Exhibit 28.  She says that she was working as<br \/>\nMedical Officer in Sir T Hospital of Bhavnagar on 10th<br \/>\nMay, 2003, when Govindbhai Kanjibhai was brought before her at 8.45<br \/>\nP.M.  The history  was given by the patient&#8217;s mother-in-law to the<br \/>\neffect that knife blows were given by Tansukhbhai about half an hour<br \/>\nback.  The patient was conscious, however, the pulse was missing.  On<br \/>\nexamining, following injuries were found :-\n<\/p>\n<p>(1)\tA<br \/>\nstab would of 8 cm. X 2 cm. bone deep in the middle of lower part of<br \/>\nchest between free margins of 10th and 12th<br \/>\nribs.\n<\/p>\n<p>(2)\tIncised<br \/>\nwound of 5 cm. X 1 cm. Muscle deep over middle of chest on back in<br \/>\nbetween two scapulae.\n<\/p>\n<p>The<br \/>\ndoctor then further says that both the injuries were simple in nature<br \/>\nand the injuries were possible with a knife.  During<br \/>\ncross-examination, she admits that when she examined the patient, two<br \/>\ninjuries in front and two injuries in the back were noticed.\n<\/p>\n<p>8.\t\tWhat<br \/>\nemerges from these pieces of evidence is that both Govindbhai and<br \/>\nRupaben indicate involvement of the appellant in the incident.  This<br \/>\naspect in the deposition has virtually remained unchallenged.  It is<br \/>\nalso found that there are some discrepancies about the number of<br \/>\ninjuries and the site of injuries as well.  But the fact remains that<br \/>\nat least one blow is commonly attributed by the two witnesses to the<br \/>\nappellant.  It also emerges that all the three injuries, even if<br \/>\naccepted to be attributed to the appellant, were simple in nature and<br \/>\nthere is no iota of evidence to show that they were sufficient in<br \/>\nordinary course of nature to cause death. Resultantly, the evidence<br \/>\ncan be said to indicate involvement of the appellant in an offence<br \/>\npunishable for simple hurt with a deadly weapon like knife, but it is<br \/>\ndifficult to accept that knowledge or intention can be attributed to<br \/>\nthe appellant about the likely death of the victim by causing the<br \/>\ninjuries.\n<\/p>\n<p>9.\t\tAs<br \/>\na result, the involvement of the appellant has to be accepted and<br \/>\nupheld, but the conviction under Section 307 of the I.P.C. deserves<br \/>\nto be altered to one under Section 324 of the I.P.C.\n<\/p>\n<p>10.\t\tNow<br \/>\ncomes the question whether the sentence calls for any interference.<br \/>\nOffence punishable under Section 324 of the I.P.C. is punishable with<br \/>\nimprisonment of either nature for three years or fine or both.  The<br \/>\nappellant is in jail for nearly three years and, therefore, the ends<br \/>\nof justice would be met if the conviction of the appellant is altered<br \/>\nfrom one under Section 307 of the I.P.C. to one under Section 324 of<br \/>\nthe I.P.C. and the sentence is reduced to the period of imprisonment<br \/>\nalready undergone by him.\n<\/p>\n<p>10.1\t\tSo<br \/>\nfar as fine is concerned, we are informed that the appellant has paid<br \/>\nthe fine of Rs.20,000\/-.  The Trial Court ordered that if the fine is<br \/>\npaid, an amount of Rs.10,000\/- shall be paid to the victim by way of<br \/>\ncompensation.  In light of the alteration in the conviction,<br \/>\npunishment of payment of  fine also needs to be reconsidered.<br \/>\nApplying the golden principle that the punishment should<br \/>\ncommensurate  with the gravity of the crime, we are of the view that<br \/>\nthe punishment in the form of fine also needs to be altered from<br \/>\nRs.20,000\/- to Rs.11,000\/- without any change in the direction to<br \/>\ngive compensation to the victim.\n<\/p>\n<p>11.\t\tIn<br \/>\nthe result, the appeal is partly allowed.  The conviction of the<br \/>\nappellant is altered from one under Section 307 of the I.P.C. to one<br \/>\nunder Section 324 of the I.P.C. and the punishment awarded by the<br \/>\nTrial Court is also altered and the appellant is sentenced to undergo<br \/>\nimprisonment for the period already undergone by him.  The appellant<br \/>\nbe set at liberty forthwith, if not required in any other case.  The<br \/>\nfine imposed is altered from Rs.20,000\/- to Rs.11,000\/-, out of<br \/>\nwhich, Rs.10,000\/- shall be payable to the victim as compensation.<br \/>\nThe appellant would be entitled to refund of an amount of Rs.9,000\/-,<br \/>\nbeing the excess amount of fine, if the fine is already paid.\n<\/p>\n<p>[ A.
