Mukhopadhaya, A.C.J.<\/p>\n<p>1. This writ petition has been preferred by the petitioner for a direction on the respondents to pay him the retiral benefits, such as, G.P.F., G.S.S., Pension, Gratuity, commutation of pension etc.<\/p>\n<p>2. According to petitioner, he was appointed as Store Keeper in the erstwhile Bihar State Electricity Board (hereinafter referred to as B.S.E.B.) and subsequently, promoted to the post of Assistant Store Keeper. His services were placed under Jharkhand State Electricity Board (hereinafter referred to as J.S.E.B.) vide Notification No. 569\/570, dated 24th April, 2002, where he joined on 9th May, 2002 and subsequently, retired on 30th April, 2004.\n<\/p>\n<p>3. The grievance of the petitioner is that though the respondents have sanctioned G.P.F., amounting to Rs. 3,50,896\/-. vide order dated 20th January, 2005 and he is entitled for other benefits, as no departmental proceeding or criminal case is pending against him, they have not paid the aforesaid benefits.\n<\/p>\n<p>4. Counsel for J.S.E.B. submitted that the matter will be looked into and, if necessary, appropriate steps shall be taken.\n<\/p>\n<p>5. In the facts and circumstances, as the matter requires determination by the respondents at first instance, instead of giving any finding on merit, the case is remitted to 4th respondent, General Manager, Patratu Thermal Power Station, Hazaribagh, who will determine the claim and pay him the admitted dues and other benefits, if found payable, within a period of three months from the date of receipt\/ production of a copy of this order, failing which the respondents will be liable to pay interest @ 5% per annum on such admitted dues from the date of retirement.\n<\/p>\n<p>6. The petitioner will also forward a copy of the representation along with a copy of this order to the Secretary, J.S.E.B., Ranchi, who will ensure compliance of this order.\n<\/p>\n<p>7. However, if the respondents dispute any claim or part thereof, will communicate the grounds to the petitioner.\n<\/p>\n<p>8.
