Under an agreement dated 1st<br \/>\n\tJanuary, 2006, partnership has been created called M\/s.Flamica Auto<br \/>\n\tIndustries between the petitioner herein and four other partners.<br \/>\n\tDuring the course of the business, dispute arose between the<br \/>\n\tpartners. Clause-5 of the Partnership Agreement provides for<br \/>\n\tresolution of disputes through arbitration. Petitioner, therefore,<br \/>\n\tissued notice dated 25th March, 2010 calling upon other<br \/>\n\tpartners to agree to appointment of anyone of the 3 retired Judges<br \/>\n\tof the High Court whose names are indicated in the said notice to<br \/>\n\tact as sole Arbitrator. The partners were given 30 days time to<br \/>\n\trespond to the said notice.\n<\/p>\n<p>Though<br \/>\n\tit is not in dispute that to the said notice dated 25th<br \/>\n\tMarch, 2010, none of the respondents replied, however, subsequently<br \/>\n\tthey all have given consent letter to appointment of Hon&#8217;ble<br \/>\n\tMr.Justice M.S.Parikh (Retired) to act as a Sole Arbitrator.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, Hon&#8217;ble Mr.Justice M.S.Parikh (Retired) is<br \/>\n\tappointed as sole Arbitrator.
