Justice K.T.SANKARAN\n\n Dated :15\/02\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 366 OF 2010\n             ------------------------------------------------------\n            Dated this the 15th day of February, 2010\n\n\n                                O R D E R\n<\/pre>\n<p>       When the Bail Application came up for hearing on 2.2.2010,<\/p>\n<p>the following order was passed:\n<\/p>\n<\/p>\n<blockquote><p>              &#8220;This is an application for anticipatory bail under<\/p>\n<p>       Section 438 of the Code of Criminal Procedure. The<\/p>\n<p>       petitioner is the     accused in Crime No.383\/2009 of<\/p>\n<p>       Kolavalloor Police Station, Kannur District.<\/p>\n<\/blockquote>\n<blockquote><p>              2.     The offence alleged against the petitioner<\/p>\n<p>        is under Section 4 of the Explosive Substances Act.<\/p>\n<\/blockquote>\n<blockquote><p>              3.    It is alleged that on 25.12.2009, the police<\/p>\n<p>        party found 100 detonators in a shed near the quarry<\/p>\n<p>        run by the petitioner. It is alleged that the brother of<\/p>\n<p>        the petitioner was having the required licence for<\/p>\n<p>        running the quarry. He is not available in station for<\/p>\n<p>        the last two years. It is alleged that the petitioner is<\/p>\n<p>        running the quarry.<\/p><\/blockquote>\n<p>              4. After having heard the learned counsel for<\/p>\n<p>        the petitioner and the learned Public Prosecutor, I am<\/p>\n<p>B.A. NO. 366 OF 2010<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>       of the view that before disposing of the Bail<\/p>\n<p>       Application, an opportunity should be given to the<\/p>\n<p>       petitioner to appear before the investigating officer.<\/p>\n<p>       Accordingly, there will be a direction to the petitioner to<\/p>\n<p>       appear before the investigating officer at 9 A.M. on 8th<\/p>\n<p>       and 9th February, 2010.\n<\/p>\n<\/p>\n<p>              Post on 15.02.2010.\n<\/p>\n<p>\n              It is submitted by the learned Public Prosecutor<\/p>\n<p>       that the petitioner will not be arrested until further<\/p>\n<p>       orders in connection with Crime No.383\/2009 of<\/p>\n<p>       Kolavalloor Police Station, Kannur District.<\/p>\n<p>             The petitioner shall produce copy of this order<\/p>\n<p>       before the investigating officer. &#8221;<\/p>\n<p>      2. It is submitted by the learned counsel for the petitioner as<\/p>\n<p>well as the learned Public Prosecutor that the direction in the order<\/p>\n<p>dated 2.2.2010 has been complied with by the petitioner.<\/p>\n<p>      3. Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and also taking note of the fact that<\/p>\n<p>the direction in the order dated 2.2.2010 has been complied with by<\/p>\n<p>the petitioner, I am of the view that anticipatory bail can be granted<\/p>\n<p>B.A. NO. 366 OF 2010<\/p>\n<p>                                       :: 3 ::\n<\/p>\n<p>to the petitioner. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioner, the officer in charge of the police station shall<\/p>\n<p>release him on bail on his executing bond for Rs.15,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<blockquote><p>      a)     The petitioner shall report before the investigating<br \/>\n             officer between 9 A.M.          and 11 A.M. on alternate<br \/>\n             Mondays, till the final report is filed or until further<br \/>\n             orders;\n<\/p><\/blockquote>\n<blockquote><p>      b)     The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;<\/p>\n<\/blockquote>\n<blockquote><p>      c)     The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;<\/p>\n<\/blockquote>\n<blockquote><p>      d)     The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n<blockquote><p>      e)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p>                                                     (K.T.SANKARAN)<br \/>\n                                                             Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vijithran.T.P. vs State Of Kerala Represented By on 15 February, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 366 of 2010() 1.
