NO. 2106 OF 2008\n            = = = = = = = = = = = = = = =\n       Dated this the 6th day of November, 2008.\n\n                       J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents  Claims    Tribunal,   Neyyattinkara      in  O.P.(MV)<\/p>\n<p>1434\/02. The claimant, a pillion rider, sustained injuries in a<\/p>\n<p>road accident and the Tribunal has awarded a compensation<\/p>\n<p>of Rs.78,350\/-. The contention of the insurance company is<\/p>\n<p>to the effect that as no additional premium is paid for the<\/p>\n<p>coverage of a pillion rider in the light of the dictum laid down<\/p>\n<p>in Tilak Singh&#8217;s case [<a href=\"\/doc\/423517\/\">United India Insurance Co. Ltd.<\/p>\n<p>v. Tilak Singh<\/a> (2006 (2) KLT 884(SC) it is not bound to<\/p>\n<p>indemnify the owner.\n<\/p>\n<p>     It can be seen from the award itself that Ext.P1 policy is<\/p>\n<p>a comprehensive policy.        Conditions are attached to a<\/p>\n<p>comprehensive policy of which clause II (1)(i) indicates that<\/p>\n<p>the insurance company has undertaken to cover the risk of a<\/p>\n<p>person travelling in a motor vehicle other than for hire or<\/p>\n<p>reward. The very same clause came up for consideration<\/p>\n<p>M.A.C.A. 2106 OF 2008<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>before a Division Bench of this Court reported in <a href=\"\/doc\/135962\/\">New India<\/p>\n<p>Assurance Co. Ltd. v. Hydrose<\/a> [2008 (3) KHC 522(DB).<\/p>\n<p>In the said decision this Court held that since the condition of<\/p>\n<p>the policy envisages and takes in such a person the<\/p>\n<p>insurance company cannot get exonerated from the liability.<\/p>\n<p>Therefore there is nothing to interfere with the decision<\/p>\n<p>rendered by Tribunal even though it is on a different reason.<\/p>\n<p>Hence the appeal lacks merit and it is dismissed.<\/p>\n<p>                            M.N.
