Out of the six fisherman on board five<br \/>\ncould be rescued and one is still missing. The plaintiff has,<br \/>\ntherefore, lodged a claim of Rs.60 lakhs from the defendants which<br \/>\ncomprises of the damage to the vessel, future loss of earning as also<br \/>\nthe compensation which the plaintiff may have or would have to pay to<br \/>\nthe members of the crew or the family of the missing person. The<br \/>\nplaintiff has also prayed for arrest of the vessel pending for<br \/>\nhearing.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Ms. Shah stated that she has instructions to appear for the<br \/>\ndefendants. She has filed a note along with which she has tendered a<br \/>\ndemand draft of Rs.60,00,000\/- dated 23.12.2010 drawn on Standard<br \/>\nChartered Bank in favour of the Registrar of the High Court.\n<\/p>\n<p>3.\tThe<br \/>\n\tsaid demand draft be deposited by the Registry. Amount realized<br \/>\nwould be invested in a fixed deposit initially for a period of six<br \/>\nmonths in any Nationalized Bank to be renewed from time to time till<br \/>\nfurther orders of the Court.\n<\/p>\n<p>4.\tIn<br \/>\nview of the fact that defendants have provided usual security for the<br \/>\nentire claim amount of the plaintiff, there would be no question of<br \/>\narresting the vessel.\n<\/p>\n<p>5.\tHowever, in<br \/>\ncase the claim of the plaintiff is found to be frivolous, the<br \/>\nquestion of damages to the defendants may arise. The plaintiff will,<br \/>\ntherefore, file usual undertaking to pay such damage as the Court may<br \/>\ndirect  in the eventuality of the claim being found false or<br \/>\nfrivolous. The said undertaking shall be filed within 1 week. Such<br \/>\ndeposit is without prejudice to the rights and contentions of the<br \/>\ndefendants.
