No. I &#8211; 208  of 2009 with Sarkhej Police Station,<br \/>\nAhmedabad for the offence punishable under Sections 420, 406 and 120B<br \/>\nof the Indian Penal Code read with Sections 3 and 5 of the Prize<br \/>\nChits &amp; Money Circulation Schemes (Banning) Act, 1978 and Section<br \/>\n3 of the Benami Transactions (Prohibition) Act, 1988.\n<\/p>\n<p>2.\tHaving<br \/>\nheard the rival submission of learned advocates appearing in the<br \/>\nmatter, and having perused the averments made in the application,<br \/>\nF.I.R. at Annexure A to the application and order dated 05.10.2009<br \/>\npassed by a co-ordinate Bench of this Court (Coram: R.H. Shukla, J.)<br \/>\nin Criminal Misc. Application No.11132 of 2009 and order dated<br \/>\n08.12.2009 passed by this Court in Cr. M.A. No. 12952 of 2009,<br \/>\nreleasing accused involved in similar offence, I am of the view that<br \/>\nthe applicant deserves to be enlarged on bail without discussing the<br \/>\nevidence in detail.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith C.R. No. I &#8211; 208  of 2009 registered at Sarkhej Police Station,<br \/>\nAhmedabad on executing a bond of Rs.10,000\/- [Rupees ten thousand<br \/>\nonly] with one surety of the like amount to the satisfaction of the<br \/>\ntrial Court and subject to the conditions that she shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of her liberty or abuse her liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nher passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\ncourt concerned;\n<\/p>\n<p>[e]\tfurnish<br \/>\nthe present address of her residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change her<br \/>\nresidence without prior permission of the Court;\n<\/p>\n<p>[f]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>6.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>7.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>8.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute to the aforesaid extent.
