Civil Judge&#8217; {S12 131.14}<\/p>\n<p>and Add}. MAC&#8217;I&#8217;., Shimoga, partly  the K &#8216;<br \/>\nfor compensation and seeking enhancement of cqmpensa\ufb01cn?&#8217; <\/p>\n<p>with 12\u00b0\/o interest.\n<\/p>\n<p>This Appeal coming on. for   <\/p>\n<p>Court delivered the folkxwingt :\n<\/p>\n<p>1. This is an appeai&#8217;   seeking<\/p>\n<p>enhancement 0!&#8217; ct:i11\u00a7_zensa\ufb016i1;~ <\/p>\n<p>2. A;:V1V:vv&#8211;;ac:c=itie:,r;.;u&#8221;vt:V 14.02.2001, when the claims&#8221; nt<\/p>\n<p>was \ufb01xing  bz}1t i&lt;:;  of the Tractor Trailer. At that<\/p>\n<p> _ time a..%fi&#039;ipp\u00abzr 1,o\u00a3xy..Vbear;}3g registration No.\u00a5{A~28\/450}. which<\/p>\n<p> in a rash and negligent manger dashed<\/p>\n<p>  ran over the stomach of the claimant.<\/p>\n<p>V _As a&quot;&quot;&#039;1&quot;r;sL:it.  the accident, the claimant sustained grievous<\/p>\n<p> He was admitted to Nanjappa Hospital, Shun&#039; 0384<\/p>\n<p> -_v&#8217;Vhere&#8211;AhAe took treatment.<\/p>\n<p>VT    The claimant \ufb01led a Claim Petition under Section. 166 of<\/p>\n<p> &#8216; &#8221; &#8221; Vthe Motor Vehicles Act claiming compensa\ufb01on contending inter<\/p>\n<p>%,<\/p>\n<p>v) Loss of eanli\ufb01gs duxing<br \/>\nthe lai\u00e9 up period : Rs. 9,000] &#8211;\n<\/p>\n<p>vi} Loss of future earning : Rs.31,0{)O\/ &#8211;<\/p>\n<p>in all, the Tribunal has awarded coz3ahpeI1satio.:1.&#8217;_\ufb011V.VaL:wA.\u00a7~:,::1.sn   9 <\/p>\n<p>R3.97,30(}\/~ along with interest at 8% <\/p>\n<p>petition till the date of actual&#8217; eeposiek Agggiev\u00e9d by&#8217;; {lie <\/p>\n<p>inadequate compensation awaxdev\ufb01;  is befom this<\/p>\n<p>Court in this appeal.\n<\/p>\n<p>5. Counsel for the appe\ufb02ajgrf, Vs1_1?;:1_Irllfs  although the<\/p>\n<p>Doctor has   the Tnbunal has<\/p>\n<p>emmeouoly   _&#8217; at 10%. He has f11x1:I1e:r<br \/>\ncontendedlthai the  towaxtis medical expenses<\/p>\n<p>and towattls 1o&#8221;s3_:&#8217;ofemei&gt;.i1:iee at Rs.&#8217;?,300\/- and Rs. 10,000\/&#8211;<\/p>\n<p> l\u00a53Sp\u20ac(3$.i\u20ac&#8221;{?\u00a7\u00a77&#8242;.iS&#8221;{)I2 the 1\u00a2wer side.<\/p>\n<p> ,   the nespon.dent~Insm&#8217;ance Company<\/p>\n<p> Suppofts  &#8216;\ufb01ndings recorded by the Tribunal and the<\/p>\n<p>H H &#8221; 1 4.&#8221;  of compensation determined.<\/p>\n<p>   Having heard the learnecl counsel for the parties and on<\/p>\n<p>  perusal of the zaate\ufb01als on record including the<\/p>\n<p>efdence of the Doctor, I \ufb01nd that the Doctor has deposed that<\/p>\n<p>has spoken about the disability at 25%, in the instant case the<br \/>\nassessment of compensation requires to be made by  the<\/p>\n<p>disability at 15%. If the compensation is reworkegi <\/p>\n<p>percentage of disability at 15\u00b0\/in, the loss of   <\/p>\n<p>come to Rs.91,80{)\/&#8211;. The &#8216;I&#8217;Ii}3una}_&#8217;has&#8211;.e11&#8217;eneciisi}%_eediictedii<\/p>\n<p>50% of the amount out of the cf  <\/p>\n<p>Since it is a case of injury    V<\/p>\n<p>such deduction is not ~T{&#8216;he ilicieciicalii expenses<br \/>\nawarded in a sum of 1\u00e9s;%,&#8211;3G3%\/3&#8217;\u00a7&#8217;:i1$ Q11 the bills. 111<br \/>\nadditiori, a sun1_:of_ Rs.iiG\u00a7(3{.!VQ,&#8217;Vj&#8221;  the Tdbunal<br \/>\ntowards     iticidental expenses. A<br \/>\n31351 Of  towards less of amenities<br \/>\nand coiiifoits  of the injury suffered by the<\/p>\n<p>claimant  heeisonable. Hence, I do not find any<\/p>\n<p> , need&#8217; i\ufb01terfeee&#8217; wit\ufb01\ufb02ie award in respect of these heads as<\/p>\n<p> they   __a1:1d reasonable assessment in the facts and<\/p>\n<p> case. in respect of all other heads. the<\/p>\n<p>V .  awaxded does not call for interference. Thcugh<\/p>\n<p>  i:3_.co1itended by the learned counsei for the appellant that<\/p>\n<p>  ag1&#8217;e&#8211; std the injury, the claimant is compietely disabled and his<\/p>\n<p>it   &#8216; e prospects have been affected, as there is no<\/p>\n<p>acceptable evidence in this regard, the said contention is<\/p>\n<p>rightly rejectad by the\u00bb'{&#8216;r1&#8243;buna1.<\/p>\n<p>8.
