Nos.19651-52 of 2009<\/p>\n<p>         Applications are allowed as prayed for.\n<\/p>\n<p>C.W.P. No.16733 of 2009 (O&amp;M)<\/p>\n<p>1.       The writ petition challenges the notice called at the<\/p>\n<p>instance of the Block Development and Panchayat Officer to all<\/p>\n<p>the Panches of the Gram Panchyat, Bansa on 23.10.2009 calling<\/p>\n<p>for a meeting to consider the removal of the present Sarpanch, Sh.<\/p>\n<p>Balbir Singh brought at the instance of the Members to hand over<br \/>\n<span class=\"hidden_text\"> C.W.P. No.16733 of 2009 (O&amp;M)                   -2-<\/span><\/p>\n<p>charge having majority on the basis of affidavits given by<\/p>\n<p>majority of persons expressing no confidence against the<\/p>\n<p>petitioner.\n<\/p>\n<p>2.        It is an admitted case that one Balwan Singh had been<\/p>\n<p>the Sarpanch of the Gram Panchayat, Bansa and he had been<\/p>\n<p>removed from his post by the Director on proof of some charges<\/p>\n<p>against him in the manner provided under Section 51(3) of the<\/p>\n<p>Haryana Panchayati Raj Act, 1994. On his being removed, one<\/p>\n<p>Veer Kaur had been handed over charge on 22.12.2008. She had<\/p>\n<p>died in harness on 04.05.2009 and by the post that fell vacant, the<\/p>\n<p>petitioner had been handed over charge on 01.06.2009 as a person<\/p>\n<p>commanding majority in the Gram Panchayat. The contention of<\/p>\n<p>the petitioner was that the provision for removal of a Sarpanch<\/p>\n<p>through a No Confidence Motion was deleted by an amendment,<\/p>\n<p>which was made by notification on 19.10.2000. By amendement<\/p>\n<p>to Rule 10 of the Haryana Panchayati Raj Rules, 1995, a<\/p>\n<p>provision for No Confidence Motion was retained only against<\/p>\n<p>Chairman, Vice Chairman, President and Vice President and<\/p>\n<p>hence, the contention of the learned counsel appearing for the<\/p>\n<p>petitioner was that after the amendment to the Rules that had been<\/p>\n<p>brought-forth, there could not have been a meeting of No<\/p>\n<p>Confidence Motion for removal of a Sarpanch and therefore, the<\/p>\n<p>proposed meeting called by the Block Development and<\/p>\n<p>Panchayat Officer was illegal and liable for judicial intervention.<br \/>\n<span class=\"hidden_text\"> C.W.P. No.16733 of 2009 (O&amp;M)                  -3-<\/span><\/p>\n<p>3.       The petitioner has a second string to the bow as it were<\/p>\n<p>by urging that Section 6 of the Haryana Panchayati Raj Act, 1994<\/p>\n<p>contemplates &#8220;filling up of a casual vacancy&#8221; that arises by death,<\/p>\n<p>resignation, removal or otherwise of a Panch or a Sarpanch and<\/p>\n<p>he shall be elected in the manner as may be prescribed.<\/p>\n<p>According to him, Section 2(x) refers to a &#8220;casual vacancy&#8221; as a<\/p>\n<p>vacancy occuring otherwise than by efflux of time. According to<\/p>\n<p>him, the vacancy that arose on account of the removal of Balwan<\/p>\n<p>Singh and subsequently the death of Veer Kaur was in the nature<\/p>\n<p>of casual vacancy and once, he was appointed to hold charge of a<\/p>\n<p>Sarpanch, he cannot be removed till the balance of period that<\/p>\n<p>remained for the office of the Sarpanch.\n<\/p>\n<p>4.       This contention of the petitioner is refuted by the<\/p>\n<p>learned counsel appearing for the Block Development and<\/p>\n<p>Panchyat Officer and for the private respondents, who are<\/p>\n<p>Panches of the Panchayat.         Their contention is that the<\/p>\n<p>appointment of Veer Kaur was not in a post as a Sarpanch but it<\/p>\n<p>took place in the manner contemplated under Section 51(6)(i),<\/p>\n<p>which reads as follows:\n<\/p>\n<blockquote><p>         &#8220;6. Any Sarpanch or Panch, as the case may be, removed<\/p>\n<p>         under sub-section (3) shall hand over the records, money<\/p>\n<p>         or any other property of the Gram Panchayat in his<\/p>\n<p>         possession or under his control:<\/p>\n<blockquote><p>             (i) if he is Sarpanch to a Panch commanding<br \/>\n<span class=\"hidden_text\"> C.W.P. No.16733 of 2009 (O&amp;M)                  -4-<\/span><\/p>\n<p>             majority in the Gram Panchayat.<\/p><\/blockquote>\n<p>4.       According to him, the legislature does not employ the<\/p>\n<p>expression that a person handed over the records, money or any<\/p>\n<p>other property of the Gram Panchayat shall be himself called a<\/p>\n<p>Sarpanch.    It merely contemplates situation of a person<\/p>\n<p>commanding majority in the Gram Panchayat to take charge of<\/p>\n<p>records, money etc. The petitioner, who came in the vacancy that<\/p>\n<p>was caused by the sudden death of Veer Kaur could again hold<\/p>\n<p>the very same position, which Veer Kaur herself held, namely,<\/p>\n<p>that he was to be merely treated as a Panch having charge of the<\/p>\n<p>records, money and other property of the Gram Panchayat and<\/p>\n<p>cannot be treated as a Sarpanch.      According to the learned<\/p>\n<p>counsel appearing for the respondents, the Sarpanch is not a<\/p>\n<p>person, who shall be elected by the Panches but on the other hand<\/p>\n<p>he shall be a person who shall be declared by the Returning<\/p>\n<p>Officer from amongst the Panches who has polled the maximum<\/p>\n<p>votes. Rule 70 of the Haryana Panchayati Raj Election Rules,<\/p>\n<p>1995 reads as follows:\n<\/p>\n<blockquote><p>         &#8220;70. Declaration of results.&#8211;(1) The Returning Officer<br \/>\n         (Panchayat) or the Assistant Returning Officer<br \/>\n         (Panchayat) shall-\n<\/p><\/blockquote>\n<blockquote><p>             (a)   declare to be elected the candidate for the<br \/>\n                   office of Panch who has secured the largest<br \/>\n                   number of valid votes and certify the return of<br \/>\n                   election in Form 18. Similarly the result of<br \/>\n                   Sarpanch shall also be declared forthwith but<br \/>\n                   if there are more than one polling stations in<br \/>\n                   the sabha area the result sheets for the office<br \/>\n                   of Sarpanch shall be sent to the Polling<br \/>\n<span class=\"hidden_text\"> C.W.P. No.16733 of 2009 (O&amp;M)                    -5-<\/span><\/p>\n<p>                     Station presided over by the Presiding Officer<br \/>\n                     nominated by the District Election Officer<br \/>\n                     (Panchayat) for this purpose, on the same day<br \/>\n                     who shall, after compiling the result sheets in<br \/>\n                     Form 19 declare forthwith the candidate who<br \/>\n                     received the largest number of valid votes<br \/>\n                     elected as Sarpanch. For the purpose of<br \/>\n                     declaration of result for the office of Panch<br \/>\n                     and Sarpanch, the Presiding Officer shall be<br \/>\n                     deemed to be Returning Officer and in case of<br \/>\n                     more than one polling stations in the sabha<br \/>\n                     area, nominated Presiding Officer shall be<br \/>\n                     deemed to be the Returning Officer for<br \/>\n                     declaration of result for the office of<br \/>\n                     Sarpanch;\n<\/p><\/blockquote>\n<blockquote><p>               (b)   send [from the place specified in clause (e) of<br \/>\n                     rule 24] the result sheet for the offices of<br \/>\n                     members of Panchayat Samiti and Zila<br \/>\n                     Parishad to the concerned Returning Officer<br \/>\n                     for Panchayat Samiti at blocl level and to the<br \/>\n                     Deputy Commissioner respectively;\n<\/p><\/blockquote>\n<blockquote><p>               (c)   for the selection of member of Panchayat<br \/>\n                     Samiti, compile all the result sheets in Form<br \/>\n                     16 and prepare Form 20 and declare the<br \/>\n                     candidate, who received the largest number of<br \/>\n                     valid votes elected and shall certify the return<br \/>\n                     of election in Form 20; and<\/p>\n<\/blockquote>\n<blockquote><p>               (d)   for the election of member of Zila Parishad,<br \/>\n                     compile the result sheets in Form 17 and<br \/>\n                     prepare Form 21 and declare the candidate,<br \/>\n                     who received the largest number of valid<br \/>\n                     votes elected and shall certify the return of<br \/>\n                     election in Form 21.\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>        (2)     The Returning Officer (Panchayat) or the officer<br \/>\n                authorized by him shall send the signed copy of<br \/>\n                the returns under this rule to the District Election<br \/>\n                Officer (Panchayat) and to the State Election<br \/>\n                Commissioner.\n<\/p><\/blockquote>\n<p>5.       The     filling   up   of   vacancy,   which    Section   6<\/p>\n<p>contemplates, according to the learned counsel appearing for the<\/p>\n<p>respondents, should be taken in the context of how Rule 70 refers<br \/>\n<span class=\"hidden_text\"> C.W.P. No.16733 of 2009 (O&amp;M)                  -6-<\/span><\/p>\n<p>to declaration of a result and cannot be treated as arising in the<\/p>\n<p>manner which Section 51(6) provides for.\n<\/p>\n<p>6.       In my view, the proper understanding of these<\/p>\n<p>provisions will have to be made only in the context of a rule of<\/p>\n<p>interpretation that when the legislature employs two distinct<\/p>\n<p>provisions for filling up a vacancy, they must be understood as<\/p>\n<p>arising under two different situations. If the manner of filling up<\/p>\n<p>of casual vacancy should be understood as including every case<\/p>\n<p>of a vacancy falling on account of death or removal of a<\/p>\n<p>Sarpanch, then it should be understood as being elected in the<\/p>\n<p>manner as may be prescribed. The prescribed manner is what<\/p>\n<p>should be understood in the manner that Rule 70 provides. On<\/p>\n<p>the other hand, the prescribed manner cannot be understood as<\/p>\n<p>arising through a situation to which Section 51(6) operates.<\/p>\n<p>Section 51(6) merely refers to handing over of the records and<\/p>\n<p>does not employ the expression &#8220;elected in the manner as may be<\/p>\n<p>prescribed&#8221; used in Section 6 of the Act.&#8221; Section 6 and 51(6)<\/p>\n<p>employs dissimilar expressions and they cannot, therefore,<\/p>\n<p>overlap. They must be understood as addressing two different<\/p>\n<p>situations. The post, which the petitioner held cannot be taken to<\/p>\n<p>be a Sarpanch as such, but it should be taken to be post allowing<\/p>\n<p>him to hold the records, money and other property of the Gram<\/p>\n<p>Panchayat by his ability to command the majority in the Gram<\/p>\n<p>Panchayat. It may be that a No Confidence Motion cannot be<br \/>\n<span class=\"hidden_text\"> C.W.P. No.16733 of 2009 (O&amp;M)                  -7-<\/span><\/p>\n<p>brought against him by virtue of the amendment to Rule 10, if he<\/p>\n<p>had been a Sarpanch. I have held that he did not hold the post as<\/p>\n<p>a Sarpanch to which alone the amended provisions of Rule 10<\/p>\n<p>would operate.     What is possible of an elected Sarpanch to<\/p>\n<p>contend in a meeting that there cannot be a No Confidence<\/p>\n<p>Motion, can not avail to a person that holds charge of records,<\/p>\n<p>property, etc. The impugned notice is not liable for challenge in<\/p>\n<p>the manner made by the petitioner and the writ petition ought to,<\/p>\n<p>therefore, fail.\n<\/p>\n<p>7.        The writ petition is dismissed. No costs.<\/p>\n<p>                                               (K.
