M. SAHAI)<\/p>\n<p>\t\tAdmit.\n<\/p>\n<p> Civil<br \/>\nApplication No. 6743 of 2011<\/p>\n<p>1.\t\tLearned<br \/>\ncounsel for the appellant has urged that the respondent did not work<br \/>\nfor 240 days in the preceding one year or even in earlier years he<br \/>\nnever worked for 240 days in a calendar year.  The appointment was<br \/>\nmade during monsoon season due to exigencies of work.  The Labour<br \/>\nCourt as well as the learned Single Judge has committed error in<br \/>\ngranting reinstatement without backwages. The appointment of the<br \/>\nrespondent was also not made by following Rules and therefore, his<br \/>\nappointment is de hors<br \/>\nthe Rules. In view of the aforesaid facts, the appellant is entitled<br \/>\nto interim relief.\n<\/p>\n<p>2.\t\tNOTICE<br \/>\n returnable on 26.7.2011.
