Whether the judgment should be reported in the Digest?\n\n\nAjay Tewari, J.\n<\/pre>\n<p>CM No. 6772-C of 2009<\/p>\n<p>            This application has been filed by the applicants Under Order<\/p>\n<p>22 Rule 3 read with Section 151CPC and Rule 3,Chapter 1-C,Volume V of<\/p>\n<p>the High Court Rules and Orders seeking permission to file the instant<\/p>\n<p>appeal on behalf of deceased Gurbachan Kaur-plalintiff, their mother. The<\/p>\n<p>same is allowed.\n<\/p>\n<p>RSA No. 2265 of 2009<\/p>\n<p>      This appeal has been filed against the concurrent judgments of the<\/p>\n<p>courts below dismissing the suit of plaintiff Gurbachan Kaur (since<br \/>\n<span class=\"hidden_text\"> RSA No. 2265 of 2009                  2<\/span><\/p>\n<p>deceased) challenging the decree suffered by her. The following questions<\/p>\n<p>have been proposed:-\n<\/p>\n<blockquote><p>                   a)    Whether in the facts and circumstances of the<\/p>\n<p>                   instant case, the respondent having failed to prove any<\/p>\n<p>                   family settlement or any pre-existing right in the property<\/p>\n<p>                   in dispute the impugned decree dated 6.5.1994,being<\/p>\n<p>                   illegal, fraudulent and unregistered can be said to have<\/p>\n<p>                   conveyed any title in favour of the respondent?<\/p>\n<\/blockquote>\n<blockquote><p>                   b)    Whether in the facts and circumstances of the<\/p>\n<p>                   instant case,     Gurbachan Kaur\/plaintiff having led<\/p>\n<p>                   affirmative evidence showing that she had been<\/p>\n<p>                   defrauded by the respondent the suit filed by the plaintiff<\/p>\n<p>                   could be dismissed?\n<\/p><\/blockquote>\n<blockquote><p>                   c)    Whether in the facts and circumstances of the<\/p>\n<p>                   instant case the suit could be said to be barred by<\/p>\n<p>                   limitation?<\/p><\/blockquote>\n<p>            It would be seen that all the questions are interrelated. Both<\/p>\n<p>the courts on appreciation of evidence have found that the plaintiff was not<\/p>\n<p>able to establish her plea of fraud since the handwriting expert as well as the<\/p>\n<p>counsel who appeared on her behalf were produced,            apart from other<\/p>\n<p>evidence. Learned counsel has not been able to persuade me that these<\/p>\n<p>findings are either based on no evidence or are based on such a misreading<\/p>\n<p>of evidence so as to render them perverse. As regards the plea of lack of<\/p>\n<p>pre-existing right learned lower Appellate Court has rightly held that this<\/p>\n<p>plea was not available to the mother since she herself suffered the decree<\/p>\n<p>and the only ground on which she could challenge the same was the ground<br \/>\n<span class=\"hidden_text\"> RSA No. 2265 of 2009                  3<\/span><\/p>\n<p>of fraud.   In view of what I have held above the question No. ( c ) pales<\/p>\n<p>into insignificance.\n<\/p>\n<p>             Consequently this appeal is dismissed. No costs.<\/p>\n<p>             Since the main case has been decided, all the pending Civil<\/p>\n<p>Misc.
