Justice R.BASANT\n\n Dated :30\/11\/2006\n\n O R D E R\n                                  R.BASANT, J.\n\n                        ------------------------------------\n\n                        Crl.M.C.NO.2258 OF 2006\n\n                        ------------------------------------\n\n               Dated this the 30th day of November, 2006.\n\n\n                                      ORDER\n<\/pre>\n<p>       The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Section   138   of   the   N.I   Act.     He   has   come   to   this   Court   with   a<\/p>\n<p>prayer that proceedings initiated against him may be quashed.<\/p>\n<p>       2.     What   is   the   reason?     The   learned   counsel   for   the<\/p>\n<p>petitioner   submits   that   the   allegations   are   totally   false.<\/p>\n<p>Signature   in   the   cheque   is   not   disputed.     But   the   said   cheque<\/p>\n<p>was   not   issued   to   the   complainant   for   the   discharge   of   any<\/p>\n<p>legally enforcible debt\/liability.  That cheque was handed over to<\/p>\n<p>another   person.     The   petitioner   issued   a   notice   to   that   person<\/p>\n<p>and   in   the   reply   that   person   has   admitted   all   the   material<\/p>\n<p>averments.   The petitioner had given a reply to the complainant<\/p>\n<p>to   the   notice   of   demand.     It   is,   in   these   circumstances,   prayed<\/p>\n<p>that   the   powers   under   Section   482   Cr.P.C   may   be   invoked   and<\/p>\n<p>the prosecution quashed.\n<\/p>\n<\/p>\n<p>       2.     The reasons stated by the petitioner are not sufficient<\/p>\n<p>to justify the  invocation of the powers under Section 482 Cr.P.C<\/p>\n<p>to   bring   about   a   premature   termination   of   the   proceedings<\/p>\n<p>initiated against the petitioner.\n<\/p>\n<p>\n<span class=\"hidden_text\">Crl.M.C.NO.2258 OF 2006            2<\/span><\/p>\n<p>        3.    The contention raised can, of course, be raised in the<\/p>\n<p>course of the trial.   I am, in these circumstances, not persuaded<\/p>\n<p>to invoke the powers under Section 482 Cr.P.C.  This Crl.M.C is,<\/p>\n<p>in these circumstances, dismissed.
