It<br \/>\n\tis further recorded that to prevent the petitioner from committing<br \/>\n\tsimilar antisocial activities, it is necessary to place him under<br \/>\n\tpreventive detention.\n<\/p>\n<p>Counsel<br \/>\n\tfor the petitioner, however, submitted that only for involvement in<br \/>\n\tone case of prohibition, the petitioner cannot be said to be<br \/>\n\tantisocial element. His detention is, therefore, illegal. Reliance<br \/>\n\twas placed in the case of Ashokbhai Jivraj @ Jivabhai Solanki V\/s.<br \/>\n\tPolice Commissioner,, Surat &amp; Ors. reported in 2001(1) GLH 393;<br \/>\n\twherein Division Bench of the High Court made following<br \/>\n\tobservations.\n<\/p>\n<p>\t&#8220;So<br \/>\n far  as  the  cases against the detenu are concerned,<br \/>\n       they have already been registered.    They  were  against<br \/>\n      persons  mentioned  therein    which   is   stated in the<br \/>\n      grounds  of  detention  by   the   detaining   authority.<br \/>\n      Regarding  two  statements, having taken into account the<br \/>\n      law laid down by the Supreme Court in Ram  Manohar  Lohia<br \/>\n      vs.   State of Bihar, AIR 1966 SC 740 and reiterated from<br \/>\n      time to time including the decisions referred  to  by  us<br \/>\n      hereinabove, the case falls under the maintenance of &#8220;law<br \/>\n      and order&#8221;  and  not  &#8220;public  order&#8221;.    The  subjective<br \/>\n      satisfaction  arrived  at  by  the  detaining  authority,<br \/>\n      therefore,  cannot  be  said  to  be  legal, valid and in<br \/>\n      accordance with  law.      Since   in   the   facts   and<br \/>\n      circumstances,  an  order  of  detention  could have been<br \/>\n      passed by the  detaining  authority  for  maintenance  of<br \/>\n      &#8220;public  order&#8221;,  the order deserves to be quashed and is<br \/>\n      hereby set aside.  The detenu is ordered  to  be  set  at<br \/>\n      liberty  forthwith  unless  required  in  any other case.    \tAppeal is accordingly allowed.  No order as to costs&#8221;.\n<\/p>\n<p>Counsel<br \/>\n\talso relied on unreported decision of learned single Judge dated<br \/>\n\t25.10.2005 passed in Special Civil Application No.18901 of 2005;<br \/>\n\twherein, it was held and observed as under:\n<\/p>\n<p>&#8220;6.\n<\/p>\n<p>\t  In the present case the reliance is only placed upon the solitary<br \/>\n\toffence, without having any basis and dehors the relevant and<br \/>\n\tcredible materials to arrive at a conclusion about disturbance of<br \/>\n\tpublic order by the prejudicial activities of the detenue and<br \/>\n\ttherefore, powers exercised by the authority while passing the order<br \/>\n\tof detention is the result of non-application and the order of<br \/>\n\tdetention requires to be quashed and set aside.\n<\/p>\n<p>7.<br \/>\n\tFor the reasons recorded hereinabove, the order of detention dated<br \/>\n\t22.06.2005 passed by the respondent no.2, is hereby quashed and set<br \/>\n\taside. The detenue  Jyotiben Wd\/o. Rameshbhai Morarbhai Koli Patel<br \/>\n\tis ordered to be set at liberty forthwith if she is not required<br \/>\n\tfurther in any other case by any other authority&#8221;.\n<\/p>\n<p>Learned<br \/>\n\tAGP opposed the petition contending that order of detention was<br \/>\n\tbased on subjective satisfaction of the authority.\n<\/p>\n<p>From<br \/>\n\tthe record, I find that admittedly, the petitioner was involved in<br \/>\n\tonly one case of selling illicit liquor. Except for recording of<br \/>\n\tsaid FIR, no other cases are registered against the petitioner. He<br \/>\n\tis not found to be involved in any other criminal activities so far.<br \/>\n\tJudgments referred above would therefore cover his case.\n<\/p>\n<p>In<br \/>\n\tview of the above, I am of the opinion that order of detention is<br \/>\n\tbad in law. Petitioner is ordered to be released forthwith if not<br \/>\n\trequired in any other criminal case. Petition is allowed.
