(J)\n\nCITATION:\n 1987 AIR  355\t\t  1987 SCR  (1) 631\n 1987 SCC  (1) 265\t  JT 1987 (1)\t 18\n 1986 SCALE  (2)1093\n\n\nACT:\n    Constitution   of\tIndia,\t 1950,\t  Art.\t  32--Police\nfiring--Some\tpersons\t   killed   and\t   several    others\ninjured--Payment of compensation-Necessity for.\n    Public Interest Litigation--Police firing--Some  persons\ndying\t and\tseveral\t   others    injured--Payment\t  of\ncompensation--Necessity of.\n\n\n\nHEADNOTE:\n    The petitioner-an organisation, said to be committed  to\nthe  upholding of fundamental rights of citizens,  filed  an\napplication  under Article 32 of the  Constitution  alleging\nthat there was a dispute relating to possession of 26  deci-\nmals  of low lying land at Arwal between members of  a\trich\nRajak  family on one side and members of nine poor  families\non the other; and that on April 19, 1986, the members of one\ncommunity mostly belonging to the backward classes assembled\nin  the\t compound of Gandhi library at Arwal for  holding  a\npeaceful meeting. At that time, the Superintendent of Police\nreached the spot with police force, surrounded the gathering\nand  without  any warning or provocation opened fire,  as  a\nresult of which several people were injured and at least  21\npersons\t including  children died. The police, it  was\talso\nalleged,  started a false case implicating several  innocent\npeople to cover up the aforesaid atrocities.\n    The petitioner in the writ petition prayed: (i) Full and\nproper\tcompensation should be awarded to the  victims-rela-\ntions of the dead and to those injured by the police firing;\n(ii) A direction be given for withdrawal of the police case;\n(iii)  Direction for settlement of the land in dispute\twith\nthe nine poor families; and (iv) transfer of the writ  peti-\ntion  pending  in  the Patna High Court to  this  Court\t for\nhearing.\n    During  the\t pendency of the Writ  Petition,  the  State\nGovernment held a judicial inquiry into the aforesaid  inci-\ndent  by  a  Member of the Board of  Revenue,  and,  awarded\ncompensation to the heirs and relations of a few of the dead\npeople to the tune of Rs. 10,000 each.\nDisposing of the writ petition, this Court,\nHELD: I. It would be appropriate that the matter is examined\nby\n632\nthe  High  Court. It would be convenient to the\t parties  to\nproduce material before the High Court on account of proxim-\nity; the High Court will be in a position to call for  docu-\nments  and if necessary, affidavits of parties concerned  as\nand  when necessary while dealing with the  matter.  Without\nnotice and without affording a reasonable opportunity to the\nparties in the writ petition before the High Court an  order\nof  transfer may not be appropriate. It would not be  proper\ntherefore to have the writ petition in the High Court trans-\nferred to this Court. However, the petitioner is at  liberty\nto get itself impleaded before the High Court in the pending\nwrit  petition\tor  by filing  an  independent\tapplication.\n[634F-H]\n    2.\tIt  is a normal feature that when  such\t unfortunate\nconsequences  emerge in police firing, the State comes\tfor-\nward  to give compensation. No justification has been  indi-\ncated as to why the said compensation has not been given  in\nevery  case  of death or injury. Ordinarily in the  case  of\ndeath  compensation  of Rs.20,000 is paid and  there  is  no\nreason\tas  to\twhy the quantum of  compensation  should  be\nlimited\t to  Rs.10,000. However, in the case  of  death\t the\nliability  of the wrong doer is not absolved when  compensa-\ntion of Rs.20,000 is paid. [635B-D]\n    3.(a) Without prejudice to any just claim for  compensa-\ntion  that may be advanced by the relations of\tthe  victims\nwho  have  died or by the injured  persons  themselves,\t for\nevery case of death compensation of Rs.20,000 and for  every\ninjured person compensation of Rs.5,000 shall be paid. Where\nsome  compensation  has already been paid, the same  may  be\nadjusted when the amount now directed is being paid.  [635D-\nF]\n    (b) In case the petitioner presses for disclosure of the\nreport\tsubmitted by the Member, Board of Revenue, the\tHigh\nCourt may examine the question as to whether the report will\nbe  made public and in the event of privilege being  claimed\nthe question of privilege will also be examined by the\tHigh\nCourt. [635F-G]\n    (c)\t The investigation of the pending police case  shall\nbe  completed within three months. In case charge  sheet  is\nsubmitted,  it would be open to the petitioner or any  other\naggrieved  party  to challenge the  maintainability  of\t the\ncharges in accordance with law. Singh\t for<br \/>\nthe Petitioners.\n<\/p>\n<p>D. Goburdhan for the Respondents.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    RANGANATH  MISRA,  J.   Peoples&#8217;  Union  for  Democratic<br \/>\nRights, an organisation said to be committed to the  uphold-<br \/>\ning. of fundamental rights of citizens has filed this appli-<br \/>\ncation\tunder Article 32 of the Constitution. It is  alleged<br \/>\nthat  on  19th\tApril, 1986, 600 to 700\t poor  peasants\t and<br \/>\nlandless people mostly belonging to the backward classes had<br \/>\ncollected for holding a peaceful meeting within the compound<br \/>\nof  Gandhi Library in Arwal, a place within the District  of<br \/>\nGaya in the State of Bihar. Without any previous warning  by<br \/>\nthe police or any provocation on the part of the people\t who<br \/>\nhad  so collected, the Superintendent of Police,  Respondent<br \/>\nNo. 3 herein, reached the spot with police force, surrounded<br \/>\nthe  gathering\tand opened fire as a  result  which  several<br \/>\npeople were injured and at least 21 persons including  chil-<br \/>\ndren  died. The petitioner alleged that separate  unofficial<br \/>\ninquiries  have been held into the atrocity and the  reports<br \/>\nindicated  that the number of deaths was much more  than  21<br \/>\nand  there was no justification for the firing.\t It  appears<br \/>\nthat there was a dispute relating to possession of 26  deci-<br \/>\nmals of low lying land adjacent to the canal at Arwal and to<br \/>\nsuch dispute members of a rich Rajak family on one side\t and<br \/>\nmembers\t of  nine poor families on the other  were  parties.<br \/>\nEven  though several people died and many more were  injured<br \/>\nby  the ruthless and unwarranted firing resorted to  by\t the<br \/>\npolice, to give a cover to the atrocities, the police start-<br \/>\ned  a  false case being Arwal P.S. Case No. 59 of  1986\t and<br \/>\ntherein\t implicated several innocent people  including\teven<br \/>\nsome of the people who had been killed in the firing.  Three<br \/>\nspecific prayers were made in the writ petition, namely:\n<\/p>\n<blockquote><p>\t\t   (1) To issue an appropriate writ or\tmake<br \/>\n\t      an order or direction in the matter of payment<br \/>\n\t      of  full and proper compensation to  the\tvic-<br \/>\n\t      tims&#8211;relations of the dead and to the  people<br \/>\n\t      who were injured by police firing;<br \/>\n\t\t   (2)\tFor  a\tdirection  to  withdraw\t the<br \/>\n\t      police case referred to above; and<br \/>\n<span class=\"hidden_text\">\t\t   (3)\tFor a direction to Respondent No.  1<\/span><br \/>\n\t      to  settle the land in dispute with  the\tnine<br \/>\n\t      poor families.<\/p><\/blockquote>\n<p><span class=\"hidden_text\">\t      634<\/span><\/p>\n<p>    During  the hearing of the matter, an additional  relief<br \/>\nwas pressed, namely, this Court should give a direction\t for<br \/>\ninstituting a judicial inquiry into the alleged atrocity.<br \/>\n    It\tmay be pointed out that during the pendency of\tthis<br \/>\nwrit  application  the State Government in response  to\t the<br \/>\ngrowing\t demand for a judicial inquiry into the\t matter\t di-<br \/>\nrected an inquiry therein by Shri Vinod Kumar, Member, Board<br \/>\nof  Revenue, Bihar. The said inquiry has been completed\t and<br \/>\nthe report has already been furnished to the Government.  On<br \/>\nthe orders of the Court, the report has been produced before<br \/>\nthis  Court  with a claim of  privilege\t against  disclosure<br \/>\nthereof.\n<\/p>\n<p>    The incident drew a lot of publicity and attention\tboth<br \/>\nwithin\tthe State as also outside. Coming to know about\t it,<br \/>\nShri  B.D.  Sharma,  Assistant\tCommissioner  for  Scheduled<br \/>\nCastes and Scheduled Tribes visited the locality and made  a<br \/>\nreport. At the instance of the petitioner, that document was<br \/>\nsummoned and has been produced. In respect thereof the Union<br \/>\nGovernment has also claimed privilege.\n<\/p>\n<p>    In\tthe affidavits in opposition filed on behalf of\t the<br \/>\nrespondents the factual assertions raised in the writ  peti-<br \/>\ntion  have  been disputed. It has also been brought  to\t our<br \/>\nnotice that a writ petition has been filed before the  Patna<br \/>\nHigh Court prior to filing of this application under Article<br \/>\n32 before this Court and the writ petition in the High Court<br \/>\nis still pending. Once this fact was brought to our  notice,<br \/>\nMr.  Mukhoty  for the petitioners submitted that  we  should<br \/>\ndirect\ttransfer  of the writ petition pending in  the\tHigh<br \/>\nCourt  to this Court so that both the matters can  be  heard<br \/>\ntogether.  We are of the view that it would  be\t appropriate<br \/>\nthat  the matter is examined by the High Court. It would  be<br \/>\nconvenient  to\tthe parties to produce material\t before\t the<br \/>\nHigh  Court on account of proximity; the High Court will  be<br \/>\nin  a  position\t to call for documents\tand,  if  necessary,<br \/>\naffidavits of parties concerned as and when necessary  while<br \/>\ndealing\t with  the matter; and without\tnotice\tand  without<br \/>\naffording  a  reasonable opportunity to the parties  in\t the<br \/>\nwrit petition before the High Court an order of transfer may<br \/>\nnot  be\t appropriate. In these circumstances,  we  have\t not<br \/>\nthought\t it  proper to have the writ petition  in  the\tHigh<br \/>\nCourt transferred to this Court. On the other hand, we\thave<br \/>\nconsidered  it expedient and proper in the interest of\tjus-<br \/>\ntice to dispose of some aspects of the matter now and  leave<br \/>\nit  open to the petitioner to canvass the other\t aspects  by<br \/>\ngetting itself impleaded before the High Court in the  pend-<br \/>\ning writ petition or by the filing of an independent  appli-<br \/>\ncation.\n<\/p>\n<p><span class=\"hidden_text\">635<\/span><\/p>\n<p>    There has been no dispute that as a result of the police<br \/>\nfiring\t21 people died and several others were injured.\t The<br \/>\nheirs  and  relations of a few of the dead people  had\tbeen<br \/>\ncompensated by the State to the tune of Rupees ten  thousand<br \/>\nas found from the record. No justification has been indicat-<br \/>\ned  as\tto why the said compensation has not been  given  in<br \/>\nevery  case  of death or injury. It is a normal\t feature  of<br \/>\nwhich  judicial notice can be taken that when such  unfortu-<br \/>\nnate  consequences emerge even in police firing,  the  State<br \/>\ncomes  forward to give compensation. Mr. Jaya  Narayan,\t for<br \/>\nthe  State  candidly  stated before us that it\tis  not\t the<br \/>\nintention  of the State to deprive the relatives of some  of<br \/>\nthe  victims  who  succumbed to the  injuries  sustained  by<br \/>\npolice\tfiring from benefits of compensation. Ordinarily  in<br \/>\nthe case of death compensation of Rupees twenty thousand  is<br \/>\npaid and we see no reason as to why the quantum of compensa-<br \/>\ntion should be limited to rupees ten thousand. We may not be<br \/>\ntaken-to suggest that in the case of death the liability  of<br \/>\nthe  wrong  doer  is absolved when  compensation  of  Rupees<br \/>\ntwenty thousand is paid. But as a working principle and\t for<br \/>\nconvenience and with a view to rehabilitating the dependants<br \/>\nof  the deceased such compensation is being paid. We  direct<br \/>\nthat:\n<\/p>\n<blockquote><p>\t\t    (1) Without prejudice to any just  claim<br \/>\n\t      for  compensation that may be advanced by\t the<br \/>\n\t      relations\t of the victims who have died or  by<br \/>\n\t      the injured persons themselves, for every case<br \/>\n\t      of  death compensation of Rupees twenty  thou-<br \/>\n\t      sand and for every injured person compensation<br \/>\n\t      of  Rupees five thousand shall be paid.  Where<br \/>\n\t      some  compensation has already been paid,\t the<br \/>\n\t      same  may\t be  adjusted when  the\t amount\t now<br \/>\n\t      directed is being paid. These payments be made<br \/>\n\t      within two months hence.\n<\/p><\/blockquote>\n<blockquote><p>\t\t    (2) In case the petitioner gets implead-<br \/>\n\t      ed  in  the pending writ petition\t before\t the<br \/>\n\t      High  Court or filed a separate writ  petition<br \/>\n\t      and  presses for disclosure of the  Report  of<br \/>\n\t      Mr.  Kumar,  the High Court  may\texamine\t the<br \/>\n\t      question as to whether the report will be made<br \/>\n\t      public  and  in the event of  privilege  being<br \/>\n\t      claimed,\tthe question of privilege will\talso<br \/>\n\t      be examined by the High Court.\n<\/p><\/blockquote>\n<blockquote><p>\t\t   (3) We have read the report furnished  by<br \/>\n\t      the Assistant Commissioner of Scheduled Castes<br \/>\n\t      and  Scheduled Tribes and since the report  is<br \/>\n\t      not relevant to the point in issue, it is\t not<br \/>\n\t      necessary\t to ask the High Court to  call\t for<br \/>\n\t      the  Report. We direct that the report  to  be<br \/>\n\t      returned<br \/>\n<span class=\"hidden_text\">\t      636<\/span><br \/>\n\t      to the appropriate Ministry from where it\t has<br \/>\n\t      been brought.\n<\/p><\/blockquote>\n<blockquote><p>\t\t    (4)\t The  investigation of\tthe  pending<br \/>\n\t      police  case shall be completed  within  three<br \/>\n\t      months  from now. In case chargesheet is\tsub-<br \/>\n\t      mitted, it would be open to the petitioner  or<br \/>\n\t      any  other  aggrieved party to  challenge\t the<br \/>\n\t      maintainability  of the charges in  accordance<br \/>\n\t      with law.<\/p><\/blockquote>\n<p>    The\t writ  petition is disposed of\twith  the  aforesaid<br \/>\ndirections.
