Justice V.GIRI\n\n Dated :27\/05\/2008\n\n O R D E R\n                        V.GIRI, J.\n         -------------------------\n           W.P.(C).No.15730 of          2008 V\n         -------------------------\n           Dated this the 27th day of May, 2008.\n\n\n                      JUDGMENT\n<\/pre>\n<p>         The petitioner is aggrieved by Ext.P1 order of<\/p>\n<p>transfer by which he has been transferred from<\/p>\n<p>Ambalavayal, Wayanad District to Kothamangalam in<\/p>\n<p>Ernakulam District. The petitioner submits that he has<\/p>\n<p>completed only two years of service in the present place<\/p>\n<p>of posting and that he did not apply for a transfer. At<\/p>\n<p>least, he should be permitted to complete 3 years. He<\/p>\n<p>submits that Ext.P1 is in contravention of the guidelines<\/p>\n<p>in  Ext.P2  series   orders    regulating   transfers    and<\/p>\n<p>appointments in the Department of Survey and Land<\/p>\n<p>Records. The petitioner has filed an application, what is<\/p>\n<p>in the nature of an appeal, Ext.P3 before the Director.<\/p>\n<p>Learned counsel for the petitioner submits that at least till<\/p>\n<p>Ext.P3 is considered and disposed of, transfer under<\/p>\n<p>Ext.P1 should not be given effect to.<\/p>\n<p>         2. There is little scope for this court to interfere<\/p>\n<p>with an order of transfer in proceedings under Article 226<\/p>\n<p>W.P.(C).NO.15730\/08<\/p>\n<p>                             :: 2 ::\n<\/p>\n<p>\nof the Constitution of India.       Mere infraction of the<\/p>\n<p>guidelines is not sufficient. I refrain from expressing any<\/p>\n<p>opinion as regards the correctness of Ext.P1, in<\/p>\n<p>circumstances where the petitioner has filed Ext.P3<\/p>\n<p>appeal before the Director. I do not find any reason to<\/p>\n<p>stay the implementation of Ext.P1, pending consideration<\/p>\n<p>of Ext.P3.\n<\/p>\n<p>         In the result, the writ petition is disposed of<\/p>\n<p>directing the 2nd respondent to consider and pass orders<\/p>\n<p>on Ext.P3, in accordance with law, within four weeks from<\/p>\n<p>the date of receipt of a copy of this judgment.<\/p>\n<p>                                              Sd\/-\n<\/p>\n<p>                                           (V.GIRI)<br \/>\n                                            JUDGE<br \/>\nsk\/<\/p>\n<p>            \/\/true copy\/\/<\/p>\n<p>                  P.S.
