Public Prosecutor for the State.<\/p>\n<p>                              Petitioner is in jail custody since 7.1.2011 in a case<\/p>\n<p>                    registered under section 302\/34 of the IPC and 27 of the Arms Act.<\/p>\n<p>                              Admittedly, informant is not eye witness of the alleged<\/p>\n<p>                    occurrence and he has given the name of the petitioner on the basis<\/p>\n<p>                    of information received to him after alleged occurrence. It would<\/p>\n<p>                    appear from perusal of the entire case diary that not a single<\/p>\n<p>                    prosecution witness has claimed to have seen the actual killing of<\/p>\n<p>                    the deceased though one witness has stated that he had seen the<\/p>\n<p>                    petitioner and co-accused Sushil Rajbhar fleeing from the place of<\/p>\n<p>                    the occurrence.\n<\/p>\n<p>                              Taking into consideration the aforesaid facts and<\/p>\n<p>                    circumstances as well as submissions of the parties, let the<\/p>\n<p>                    petitioner, Deepak Kumar, be released on bail on furnishing bail<\/p>\n<p>                    bonds of Rs 10,000\/- with two sureties of the like amount each to<\/p>\n<p>                    the satisfaction of the Chief Judicial Magistrate, Madhepura in<\/p>\n<p>                    Shankerpur P.S.
