Civil<br \/>\nMiscellaneous Application No. 21 of 1951.<br \/>\n    K.\t  S. Hajela, Advocate-General of Rajasthan, for\t the<br \/>\nappellant.\n<\/p>\n<p>   No appearance for the respondents.\n<\/p>\n<p>      1954.   March  17.   The Judgment\t of  the  Court\t was<br \/>\ndelivered by<br \/>\n    GHULAM   HASAN  J.-This  appeal  is\t brought   under   a<br \/>\ncertificate  granted  by the High Court of  Rajasthan  under<br \/>\narticle\t 133(c)\t of  the Constitution  of  India  against  a<br \/>\njudgment and order of that High Court in writ petition under<br \/>\narticle\t 226  holding the appointment of  one  Shri  Sukhdeo<br \/>\nNarain\tas invalid and directing that all proceedings  taken<br \/>\nby  him\t as  the Industrial Court under\t section  7  of\t the<br \/>\nIndustrial  Disputes  Act (No.\tXIV of 1947)  are  null\t and<br \/>\nvoid.\n<\/p>\n<p><span class=\"hidden_text\">1130<\/span><\/p>\n<p>   We  are informed that Shri Sukhdeo Narain has  ceased  to<br \/>\nwork  as  an  Industrial Tribunal and  the  present  appeal,<br \/>\ntherefore,  becomes infructuous, but we are invited  by\t the<br \/>\nAdvocate-General on behalf of the State of Rajasthan who  is<br \/>\nthe  appellant\tbefore us to decide the question as  to\t the<br \/>\nvalidity of the appointment, as it is likely to affect other<br \/>\nawards made by tribunals under the Industrial Disputes\tAct.<br \/>\nWe accordingly proceed to give our decision.<br \/>\n   The\tquestion  involved  in\tthe  case  is  whether\t the<br \/>\nappointment  of\t Shri Sukhdeo Narain is invalid\t because  he<br \/>\ndoes not fulfil the qualifications laid down for a  tribunal<br \/>\nunder section 7(3) of the Industrial Disputes Act.<br \/>\n  Section 7(3) hereinafter referred to as the Industrial Act<br \/>\nsays:-\n<\/p>\n<p> &#8221;  Where  a  tribunal consists of  one\t member\t only,\tthat<br \/>\nmember,\t and where it consists of two or more  members,\t the<br \/>\nchairman of the tribunal, shall be a person who-\n<\/p>\n<p>(a)  is or has been a Judge of a High Court; or\n<\/p>\n<p> (b) is or has been a District Judge<br \/>\n    &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8221;\n<\/p>\n<p>  The  Industrial  Act\twas  applied  to  Rajasthan  by\t the<br \/>\nRajasthan  Adaptation  of   Central  Laws  Ordinance,\t1950<br \/>\n(Ordinance  IV\tof 1950), by the Rajpramukh on\tJanuary\t 24,<br \/>\n1950.\tBy this adaptation section 7 of the  Industrial\t Act<br \/>\ncame  to be applied to Rajasthan.  Shri Sukhdeo\t Narain\t was<br \/>\nappointed on October 9, 1950, by a notification which ran as<br \/>\nfollows:-\n<\/p>\n<p>  &#8220;In  exercise of the powers conferred by section 7 of\t the<br \/>\nIndustrial Disputes Act, 1947.(XIV. of 1947) the  Government<br \/>\nof Rajasthan is pleased to constitute an Industrial Tribunal<br \/>\nconsisting  of Shri Sukhdeo Narain, a retired Judge  of\t the<br \/>\nHigh   Court  of  the  erstwhile  Jodhpur  State   for\t the<br \/>\nadjudication  of an Industrial dispute in the Mewar  Textile<br \/>\nMills Ltd., Bhilwara, in Rajasthan.  &#8221;\n<\/p>\n<p>  The appointment of Shri Sukhdeo Narain was objected to  by<br \/>\nthe respondent on the ground that, the<br \/>\n<span class=\"hidden_text\">1131<\/span><br \/>\nwords  &#8220;a  Judge of a High Court&#8221; in section 7(3) mean\t&#8221;  a<br \/>\nJudge  of  the\tHigh  Court  of\t Judicature  for   Rajasthan<br \/>\nestablished under the Rajasthan High Court Ordinance,  1949&#8243;<br \/>\nand  as\t Shri Sukhdeo Narain had been a Judge  of  the\tHigh<br \/>\nCourt  of the former State of Jodhpur, he could not be\theld<br \/>\nto  be\tJudge of the High Court under section  7(3)  of\t the<br \/>\nIndustrial  Act.   This objection was upheld  by  the  High<br \/>\nCourt.\n<\/p>\n<p>   Though  the\tappointment of Shri Sukhdeo  Narain  in\t the<br \/>\nnotification  was based upon the fact that he was a  retired<br \/>\nJudge of the High Court of Jodhpur, in arguments it was also<br \/>\ncontended  before  the High Court that even if\the  was\t not<br \/>\nqualified for appointment as a former Judge of a High Court,<br \/>\nhe  was\t certainly  qualified for appointment  as  a  former<br \/>\nDistrict  Judge.  The High Court repelled  this\t contention.<br \/>\nIt  appears  that the United State of  Rajasthan  came\tinto<br \/>\nexistence  on April 7, 1949, and the United State of  Matsya<br \/>\nwas  integrated\t with  it on May 15,  1949.   Section  5  of<br \/>\nOrdinance No. IV of 1950 lays down that:\n<\/p>\n<p>  &#8221; For the purpose of the application of any Central law to<br \/>\nRajasthan, unless there be anything repugnant in the  suject<br \/>\nor context,-\n<\/p>\n<p>  (ix)\t  references  therein to other civil,  criminal\t and<br \/>\nrevenue\t  courts,   to\tpublic\toffices,  and\tto   Judges,<br \/>\nMagistrates,  officers or authorities shall be deemed to  be<br \/>\nreferences to such courts, offices and Judges,\tMagistrates,<br \/>\nofficers or authorities of or in Rajasthan.  &#8221;<br \/>\n   The High Court held that the word &#8220;Rajasthan&#8221; as  defined<br \/>\nin  Ordinance I of 1949 means the United State of  Rajasthan<br \/>\nand  &#8220;the Judges an d other officers&#8221; mentioned\t in  section<br \/>\n5(ix) must be held to be those in the service of the  United<br \/>\nState of Rajasthan.  Accordingly they held that Shri Sukhdeo<br \/>\nNarain\tcould not be held to be a District Judge within\t the<br \/>\nmeaning\t of  section  7(3) (b) and  his\t appointment  as  an<br \/>\nIndustrial  Tribunal  under  that  section  was,  therefore,<br \/>\ninvalid.  We are of opinion that this appeal can be  decided<br \/>\non  a  short  ground.  The  Industrial\tDisputes  (Appellate<br \/>\nTribunal)  Act (XLVIII of 1950) came into force on  May\t 20,<br \/>\n1950.\tBy section 34 it was provided that the<br \/>\n<span class=\"hidden_text\">1132<\/span><br \/>\n   Industrial Disputes Act, XIV of 1947, shall be amended in<br \/>\nthe  manner  specified\tin the\tSchedule  and  the  Schedule<br \/>\nsubstituted sub-section (2) to section (1) of the Industrial<br \/>\nAct as follows :-\n<\/p>\n<p>  &#8220;It  extends\tto the whole of India except  the  State  of<br \/>\nJammu and Kashmir.  &#8221;\n<\/p>\n<p>    As\twe  have  already stated  the  appointment  of\tShri<br \/>\nSukhdeo Narain was made on October 9, 1950, i.e., after\t the<br \/>\nIndustrial Disputes Act had become applicable to  Rajasthan.<br \/>\nIt  is not necessary therefore to invoke the  provisions  of<br \/>\nOrdinance.IV  of  1950\tin  deciding  the  question  of\t the<br \/>\nvalidity of the appointment.  The argument based on  section<br \/>\n34  of\tAct XLVIII of 1950 was put forward before  the\tHigh<br \/>\nCourt  at  the time of the hearing of  the  application\t for<br \/>\nleave to appeal and it was contended that in view of section<br \/>\n34  the provisions of Rajasthan Adaptation of  Central\tLaws<br \/>\nOrdinance,  1950,  namely section 5, subsections  (vii)\t and\n<\/p>\n<p>(ix), stood amended or repealed but the High Court  observed<br \/>\nthat  even if this argument had been raised before  them  in<br \/>\nappeal,\t it  would  have made no difference.   It  has\tbeen<br \/>\ncontended  before  us by Mr. Hajela, the  learned  Advocate-<br \/>\nGeneral\t on behalf of the State, that after  the  Industrial<br \/>\nDisputes Act of 1947 was extended to Rajasthan by section 34<br \/>\nof the Industrial Disputes (Appellate Tribunal) Act,  XLVIII<br \/>\nof  1950,  the\tprovisions of the former  stood\t amended  by<br \/>\nsection 34 and could not be read subject to section 5 of the<br \/>\nRajasthan  Adaptation of Central Laws Ordinance IV of  1950.<br \/>\nWe  think there is force in this contention.  The effect  of<br \/>\nsection 34, as we have already indicated, was to extend\t the<br \/>\nterritorial  application  of the  Industrial  Disputes\tAct,<br \/>\n1947,  to  the\twhole  of  India  including  Rajasthan\t the<br \/>\nexception  being the State of Jammu and Kashmir only.\tThis<br \/>\nbeing  so the words &#8220;A Judge of a High Court and a  District<br \/>\nJudge&#8221; used in section 7(3) (a) and (b) respectively of\t the<br \/>\nIndustrial  Disputes Act, 1947, must be held now to  include<br \/>\n&#8220;A  Judge  of  the High Court and a District  Judge  in\t the<br \/>\nformer\tState  of Jodhpur&#8221;.  There is now no  room  for\t the<br \/>\napplication  of section 5 of Ordinance IV of 1950  according<br \/>\nto which a Judge of the High Court<br \/>\n<span class=\"hidden_text\">1133<\/span><br \/>\nand  a District Judge could only. mean a Judge of  the\tHigh<br \/>\nCourt  for  Rajasthan established under the  Rajasthan\tHigh<br \/>\nCourt Ordinance 1949 and a District Judge of or in Rajasthan<br \/>\nwithin\tthe meaning of section 5(ix) of Ordinance No. IV  of<br \/>\n1950.\tAccordingly  we hold that the  appointment  of\tShri<br \/>\nSukhdeo Narain was perfectly valid.\n<\/p>\n<p>   We accordingly set aside the order of the High Court\t but<br \/>\nwithout costs, as the respondent is not, represented.<br \/>\n   Agent for the appellant: R.
