Puri, J.\n<\/pre>\n<p>Judgment.\n<\/p>\n<p>            This is a Revision Petition under Section 401 Cr.P.C for<\/p>\n<p>setting aside the impugned order dated 19.1.2009, Annexure P-4,<\/p>\n<p>passed by the Additional Sessions Judge-II, Bhiwani vide which<\/p>\n<p>application under Section 319 Cr.P.C filed by the petitioner for<\/p>\n<p>summoning Dinesh, Sanjay, Ajay and Vijay @ Viju sons of Ishwar<\/p>\n<p>Chander, residents of Purani Anaj Mandi, Rohtak was dismissed.\n<\/p>\n<p>             Criminal Revision No.764 of 2009.\n<\/p>\n<p><span class=\"hidden_text\">                       -2-<\/span><\/p>\n<p>          The law was set into motion on the recording of<\/p>\n<p>statement of Sanjay son of Prem Parkash, resident of Modan Gali,<\/p>\n<p>Bhiwani who has stated that he has one brother and three sisters.<\/p>\n<p>His elder sister Anita was married at Nanital and younger to her,<\/p>\n<p>Rekha @ Reshmi was married to Ashok Kumar son of Ishar Chand<\/p>\n<p>Mahajan, resident of Purani Anaj Mandi, Rohtak on 24.4.2007<\/p>\n<p>according to Hindu rights and ceremonies by his parents who gave<\/p>\n<p>dowry articles as per their capacity. His brother-in-law Ashok<\/p>\n<p>Kumr was running a shop of confectionary at Chandigarh at the<\/p>\n<p>time of marriage. After 2 or 3 months of the marriage, Ashok<\/p>\n<p>Kumar came to Rohtak after leaving the shop. Rekha lived<\/p>\n<p>amicably in her matrimonial home for 2 or 3 months after the<\/p>\n<p>marriage. After leaving the shop by Ashok Kumar, he, his brother-<\/p>\n<p>in-laws Dinesh, Sanjay, Ajay, Vijay, her father-in-law and mother-<\/p>\n<p>in-law started harassing her on petty matters. The mother-in-law of<\/p>\n<p>Rekha daily asked Rekha that she had come from poor and hungry<\/p>\n<p>family and that her parents gave nothing in dowry. These incidents<\/p>\n<p>were told by Rekha to her parents and brother whenever she came<\/p>\n<p>to their house. Rekha told him on telephone that the above-said<\/p>\n<p>persons were harassing her badly and when he tried to ask Rekha<\/p>\n<p>about the reason, she started crying. Some days ago, a phone call<br \/>\n             Criminal Revision No.764 of 2009.\n<\/p>\n<p><span class=\"hidden_text\">                       -3-<\/span><\/p>\n<p>came from his sister and brother in law Ashok Kumar to send a<\/p>\n<p>coloured television and that demand was met with. Ashok Kumar,<\/p>\n<p>his brother-in-law and his sister came to their house on 2.12.2007<\/p>\n<p>and went after saying to his parents and his brother that Rekha<\/p>\n<p>should be sent with Rs.5 lacs because he wanted to start business.<\/p>\n<p>He has further disclosed that in case Rs.5 lacs were not arranged,<\/p>\n<p>then Rekha be kept at her parental home. That fact was told by<\/p>\n<p>Rekha to her parents and the complainant. On 4.12.2007, his sister<\/p>\n<p>Rekha disclosed everything on telephone and told that she will not<\/p>\n<p>go to Rohtak. On 6.12.2007, a phone call was received at 7-00 AM<\/p>\n<p>from his brother Sanjay that his sister Rekha had committed<\/p>\n<p>suicide by jumping in Mool Chand Johar.\n<\/p>\n<p>          It is further mentioned in the FIR that Rekha has<\/p>\n<p>committed suicide on account of harassment of her husband Ashok<\/p>\n<p>Kumar, mother-in-law Kamla Devi, father-in-law Ishwar and<\/p>\n<p>brothers-in-law Dinesh, Sanjay, Ajay and Vijay.<\/p>\n<p>          After the completion of investigation, challan was<\/p>\n<p>presented against Ashok Kumar, Kamla Devi and Ishwar Chand.<\/p>\n<p>          During the trial, the complainant has appeared in the<\/p>\n<p>trial Court and thereafter an application under Section 319 Cr.P.C<\/p>\n<p>was moved. The learned trial Court, after going through the record<br \/>\n             Criminal Revision No.764 of 2009.\n<\/p>\n<p><span class=\"hidden_text\">                       -4-<\/span><\/p>\n<p>dismissed the application.\n<\/p>\n<p>           Feeling dis-satisfied with the above-said order, the<\/p>\n<p>complainant has preferred the present Criminal Revision.<\/p>\n<p>           The learned counsel for the complainant has submitted<\/p>\n<p>that the names of the persons sought to be summoned as additional<\/p>\n<p>accused find mention in the FIR. The complainant, while appearing<\/p>\n<p>as a witness has further stated that persons sought to be served as<\/p>\n<p>accused have also molested his sister. So, the trial Court has<\/p>\n<p>wrongly dismissed the application for summoning the above-said<\/p>\n<p>persons as accused.\n<\/p>\n<p>           A prayer has been made for setting aside the impugned<\/p>\n<p>order and for summoning the persons mentioned in the application<\/p>\n<p>as additional accused.\n<\/p>\n<p>           The learned trial Court has observed that in view of<\/p>\n<p>authority in case Kailash Versus State of Rajasthan and<\/p>\n<p>another, 2008(2) RCR (Criminal) 200, power under Section 319<\/p>\n<p>Cr.P.C should be sparingly used. From the perusal of FIR, it is<\/p>\n<p>revealed that only general allegations have been made that Dinesh,<\/p>\n<p>Sanjay, Ajay and Vijay @ Viju were also maltreating the deceased.<\/p>\n<p>The Investigating Agency, after investigation, came to the<\/p>\n<p>conclusion that no case is made out and the said persons have been<br \/>\n             Criminal Revision No.764 of 2009.\n<\/p>\n<p><span class=\"hidden_text\">                       -5-<\/span><\/p>\n<p>placed in column No.2. Specific allegations are against Ashok<\/p>\n<p>Kumar, Kamla Devi and Ishwar Chand. Only passing reference has<\/p>\n<p>been made in the FIR that Rekha committed suicide due to<\/p>\n<p>harassment on petty matters by these persons. The exaggeration<\/p>\n<p>made in the Court by the petitioner that two of the persons sought<\/p>\n<p>to be summoned molested Rekha is an after thought version and<\/p>\n<p>does not find place any where in the FIR. Persons can be<\/p>\n<p>summoned as accused only if there are fair chances of their<\/p>\n<p>conviction. On the basis of general allegations of demand at one<\/p>\n<p>place, the accused cannot be convicted. Moreover, power to<\/p>\n<p>summon under Section 319 Cr.P.C has to be used sparingly. The<\/p>\n<p>demand of Rs.5 lacs has also been attributed to Ashok Kumar,<\/p>\n<p>husband of Rekha. So, in these circumstances, I do not see any<\/p>\n<p>infirmity in the order dated 19.1.2009.\n<\/p>\n<p>           Consequently, this Criminal Revision is without any<\/p>\n<p>merit and the same stands dismissed.<\/p>\n<pre>\n\nMarch 25,2009.
