Temporary acquisition<br \/>\nof land is covered in Part VI of the Act viz. Section 35, 36 and 37<br \/>\nof the Act.\n<\/p>\n<p>4\tLearned<br \/>\ncounsel for the appellant &#8211; acquiring body submitted that the<br \/>\nissue involved in these appeals is squarely covered by the ratio laid<br \/>\ndown in the case of <a href=\"\/doc\/15472897\/\">Oil &amp; Natural Gas Corporation<br \/>\nLimited v. Sankarji Hemaji &amp; Anr.,<\/a> (2008) 17 GHJ 523.  The<br \/>\noperative part of the said judgment reads as under:-\n<\/p>\n<p>&#8220;5.2\tOn<br \/>\nthe facts of the case, it is evident that the Reference Court has<br \/>\nalso determined the further rent which issue was not before it. I am,<br \/>\ntherefore, of the opinion that the contention raised by the learned<br \/>\nAdvocate for the appellant that the observation or direction issued<br \/>\nby the Reference Court in the operative part of the orders require to<br \/>\nbe quashed and set aside, is required to be accepted. If the said<br \/>\ndirection is allowed to remain then it would amount to granting the<br \/>\nrent which is over the rent fixed by the appellant-O.N.G.C. from time<br \/>\nto time. Moreover, the same has been fixed without considering as to<br \/>\nwhat would be the future rent fixed by the appellant- O.N.G.C, which<br \/>\nis beyond the scope of reference.  Hence if the said observation is<br \/>\nallowed to remain then, in that event such compensation would be much<br \/>\nmore than the amount which has been found to be adequate by the<br \/>\nCourt.\n<\/p>\n<p>5.3\t It<br \/>\nmay be noted that the Reference Court was dealing with a particular<br \/>\nacquisition and it was not open for the said Court to pass an order<br \/>\nin respect of future rent.  Such an observation on the part of the<br \/>\nReference Court is clearly bad in law in view of the provisions of<br \/>\nSection 35(3) of the Act. In that view of the matter, the<br \/>\nobservations or direction issued by the Reference Court with regard<br \/>\nto additional amount of compensation, requires to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.0\tIn<br \/>\nthe result, these appeals are allowed. The observation &#8220;over<br \/>\nthe rent fixed by O.N.G.C. from time to time with the running<br \/>\ninterest at the rate of 9% p.a. from the date of due date of running<br \/>\ntill the day of payment is made&#8221;, made by the Reference<br \/>\nCourt in the operative part of the impugned judgments and awards, is<br \/>\nquashed and set aside.  These appeals are allowed to the aforesaid<br \/>\nextent. Rule is made absolute to the aforesaid extent with no order<br \/>\nas to costs.&#8221;\n<\/p>\n<p>           It<br \/>\nwould also be beneficial to reproduce the operative part of the said<br \/>\njudgment, which reads as under :\n<\/p>\n<p>&#8220;41.\tSimilarly,<br \/>\n\tevent he conduct and the action of the then Special Land Acquisition<br \/>\n\tOfficer, who has referred the references applications in more than<br \/>\n\t100 cases to the reference court, though the applications for<br \/>\n\treference were filed after a period of<br \/>\n\tmore than 20 years, is also required to be considered seriously at<br \/>\n\tthe hands of Government. Under<br \/>\n\tthe circumstances, Chief Secretary, Revenue Department is directed<br \/>\n\tto hold necessary inquiry against the concerned Special Land<br \/>\n\tAcquisition Officer with regard to his conduct and actions. Registry<br \/>\n\tis directed to communicate this order to the Chief Secretary,<br \/>\n\tRevenue Department, State of Gujarat for compliance.\n<\/p>\n<p>42.\tFor<br \/>\nthe reasons stated hereinabove,all the appeals succeed and are<br \/>\nallowed with costs which is quantified at Rs.5000\/- (Rupees Five<br \/>\nThousand only) per each appeal. The impugned common judgement and<br \/>\naward dated 15.10.2005 passed by the learned Principal Senior Civil<br \/>\nJudge, Mehsana (Mr. J.R. Shah) inland Reference Case Nos.3780 to 3784<br \/>\nof 2003 is hereby quashed and set aside and it is held that:\n<\/p>\n<p>[i]\tThe<br \/>\nreference applications submitted by the original claimants were not<br \/>\nmaintainable.\n<\/p>\n<p>[ii]\tThe<br \/>\nreference applications were required to be dismissed on the ground of<br \/>\nlimitation considering Article 137 of the Limitation Act.  In the<br \/>\nalternate, the same were required to be dismissed on the ground of<br \/>\ndelay and laches.\n<\/p>\n<p>[iii]\tThe<br \/>\nreference court has no jurisdiction to decide any other question<br \/>\nexcept the difference as to sufficiency of compensation in a<br \/>\nreference under sec.35(3) of the Act.\n<\/p>\n<p>[iv]\tThe<br \/>\nreference court has no jurisdiction to decide any other question<br \/>\nexcept the difference as to sufficiency of compensation in a<br \/>\nreference under section 35(3) of the Act.\n<\/p>\n<p>[v]\tThe<br \/>\nreference court has no jurisdiction to declare acquisition<br \/>\nproceedings and the award declared by the Special Land Acquisition<br \/>\nOfficer under sec.35(3) of the Act as illegal and\/or non-est in a<br \/>\nreference under section 35(3) of the Act.\n<\/p>\n<p>[vi]\tThe<br \/>\nreference court has no jurisdiction to declare possession of the<br \/>\nacquiring body as illegal and\/or unauthorized and consequently the<br \/>\nreference court has no jurisdiction to declare the ONGC-acquiring<br \/>\nbody as trespasser that too without framing any issue.\n<\/p>\n<p>[vii]\tThe<br \/>\nreference court has no jurisdiction toward compensation by way of<br \/>\nmesne profit declaring compensation of the acquiring body as illegal<br \/>\nand unauthorized.\n<\/p>\n<p>[viii]\tThe<br \/>\nreference court has also no jurisdiction to award statutory benefits<br \/>\nand or interest, as awarded by the reference court, as if the<br \/>\nacquisition proceedings is a permanent acquisition.\n<\/p>\n<p>[ix]\tThe<br \/>\nreference court has no jurisdiction to determine the dispute with<br \/>\nregard to sufficiency of the compensation beyond the period of three<br \/>\nyears from the date of taking the possession.\n<\/p>\n<p>[x]\tThe<br \/>\nReference Court has no jurisdiction to restore the possession of the<br \/>\nland to the original owners while deciding the reference under<br \/>\nsec.35(3) of the Act.&#8221;\n<\/p>\n<p>5.\tFrom<br \/>\nthe above order passed by this Court, it is clear that while dealing<br \/>\nwith an application u\/s. 35(3) of the said Act, the reference Court<br \/>\nis not empowered to pass an order in respect of future rent. The<br \/>\nratio laid down in the aforesaid case is squarely applicable to the<br \/>\nfacts of the case. The learned advocate for the respondents is not<br \/>\nable to point out anything to take a different view in the matters.<br \/>\nHence, the impugned orders passed by the reference Court, being bad<br \/>\nin law, deserve to be quashed and set aside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, the judgment and order passed by the Reference Court in<br \/>\nLand Acquisition References Nos.876 of 2003, 877 of 2003 and<br \/>\n5159 of 2003 is quashed and set aside,<br \/>\nand the matters are sent back to the trial Court to re-hear the<br \/>\nReferences and to decide the same in accordance with law and as per<br \/>\nthe observations made in this judgment. If ultimately it is found by<br \/>\nthe trial Court that Reference under section 35 (3)<br \/>\nof the Act is made in connection with the original period of three<br \/>\nyears, the Court can certainly determine the question about fixation<br \/>\nof rent for the aforesaid period during which the land was under<br \/>\ntemporary acquisition;  but if it is found that the Reference is made<br \/>\nfor a period beyond three years from taking over possession,<br \/>\nnaturally no relief under section 35 (3) can be granted.  The Court<br \/>\nbelow shall determine this question and pass appropriate order by<br \/>\ndeciding the entire References afresh.  Such decision shall be<br \/>\nrendered by the court below at the earlier possible, and in any<br \/>\nevent, within six months from today.  It is, however, clarified that<br \/>\nthis Court has not expressed any opinion whether the nature of the<br \/>\npossession by the acquiring body is legal or not as the same can be<br \/>\nsubject to any other  agreement between the parties, and if there is<br \/>\nnone,  the land owners can certainly move the Collector under section<br \/>\n36 of the Act for restoring the land to them.  Whether the acquiring<br \/>\nbody has continued in possession in pursuance of some contractual<br \/>\nagreement, is a question which is required to be decided in a<br \/>\nseparate proceedings if taken out by the parties.   In these appeals,<br \/>\nthis Court has only decided the scope of section 35 (3) of the Act to<br \/>\nthe effect that  Reference under this section can be made only for a<br \/>\nperiod up to three years from the commencement of occupation of the<br \/>\nland and the Reference Court cannot decide the Reference under sec.<br \/>\n35(3) of the Act for a period exceeding three years from the date of<br \/>\ncommencement of the occupation.\n<\/p>\n<p>\tRegistry<br \/>\nis directed to return the R &amp;
