Mr. H.L.\n<\/p>\n<p>Jani, learned Additional Public Prosecutor waives service of rule on<br \/>\nbehalf of the respondent.  In the facts and circumstances of the<br \/>\ncase, this matter is taken up for hearing today.\n<\/p>\n<p>\tThis is an<br \/>\napplication for anticipatory bail under section 438 of the Code of<br \/>\nCriminal Procedure in connection with a criminal complaint being C.R.<br \/>\nNo. I ?  69 of 2008 registered with Lunawada Police Station, Dist.<br \/>\nPanchmahal for offences punishable under sections 419, 420, 406 and<br \/>\n114 of the Indian Penal Code.\n<\/p>\n<p>\tLearned advocate<br \/>\nfor the petitioner submitted that on perusal of the FIR at Annexure<br \/>\n&#8216;A&#8217; the petitioner has been falsely implicated in the commission of<br \/>\noffence.  Placing reliance on Annexure &#8216;D&#8217;, which is a certificate<br \/>\nissued by Ebrahim Bawany Technical Institute, Vadodara, learned<br \/>\nadvocate submitted that the petitioner was at Baroda from 10.30 AM to<br \/>\n12.00 Noon whereas the offence is alleged to have taken place at 1.30<br \/>\nPM at Lunavada, which is at a distance of about 200 Kms. from<br \/>\nVadodara. He submitted that it is practically impossible that the<br \/>\npetitioner would have reached Lunavada  at the time of the incident<br \/>\nalleged in the FIR. Learned advocate submitted that in these<br \/>\ncircumstances, the petitioner has been falsely implicated in the<br \/>\noffence, and the prayer for anticipatory bail may be granted.\n<\/p>\n<p>\tOn the other<br \/>\nhand, Mr. H.L. Jani, learned APP submitted that considering the role<br \/>\nattributed to the petitioner in the FIR and the gravity of the<br \/>\noffence in which he is involved, the prayer for anticipatory bail<br \/>\ndeserves to be rejected.\n<\/p>\n<p>\tTaking into<br \/>\nconsideration the rival submissions of learned advocate and<br \/>\nconsidering the certificate produced by the petitioner at Annexure<br \/>\n&#8216;D&#8217; and the FIR, it prima facie appears that the offence is alleged<br \/>\nto have taken place at 1.30 PM whereas the petitioner was at Baroda<br \/>\ntill 12.00 Noon. Considering the distance between Vadodara and<br \/>\nLunavada, which is about 200 kms. it primafacie appears that the<br \/>\npetitioner could not have reached Lunavada at 1.30 PM. \tHaving heard<br \/>\nthe learned counsel for the parties and considered the facts and<br \/>\ncircumstances of the case, I am inclined to grant anticipatory bail<br \/>\nto the applicant without entering into the merits of the case.\n<\/p>\n<p>\tIn the event of<br \/>\narrest of the petitioner in connection with C.R. No. I ?  69 of 2008<br \/>\nregistered with Lunawada Police Station, Dist. Panchmahal,  he shall<br \/>\nbe released on bail on executing a bond of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] with one surety of the like amount on the following<br \/>\nconditions that he shall:\n<\/p>\n<p>[a].\tco-operate<br \/>\nwith the investigation and make himself available for interrogation<br \/>\nwhenever and wherever required.\n<\/p>\n<p>[b].\tshall remain<br \/>\npresent at the concerned Police Station on 28th July 2008<br \/>\nbetween 9.00 AM to 3.00 PM.\n<\/p>\n<p>[c].\tshall not<br \/>\nhamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>[d].\tat the time<br \/>\nof execution of bond, furnish his residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e].\tnot leave<br \/>\nIndia without the permission of the Court and, if holding a passport,<br \/>\nhe shall surrender the same before the trial Court within a week;\n<\/p>\n<p>[f].\tnot obstruct<br \/>\nor hamper the police investigation and not play mischief with the<br \/>\nevidence collected or yet to be collected by the police;\n<\/p>\n<p>\tIt would be open<br \/>\nto the Investigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just; and the competent Court would decide it<br \/>\non merits.\n<\/p>\n<p>\tThis order will<br \/>\nhold good, if the petitioner is arrested at any time within 90 days<br \/>\nfrom today.  The order for release on bail will remain operative only<br \/>\nfor a period of ten days from the date of his arrest. Thereafter, it<br \/>\nwill be open to the petitioner to make a fresh application for being<br \/>\nenlarged on bail in usual course, which, when it comes up before the<br \/>\ncompetent Court, will be decided in accordance with law, having<br \/>\nregard to all the attending circumstances and the materials available<br \/>\nat the relevant time, without being influenced by the fact that<br \/>\nanticipatory  bail was granted.\n<\/p>\n<p>\tWith these<br \/>\ndirections, this Criminal Misc. Application is allowed.
