RAVIKUMAR, JJ.\n                   ---------------------------------------------\n                        W.P.(C)NO. 20151 OF 2009\n                   ---------------------------------------------\n                   Dated this the 17th day of August, 2009\n\n\n                                  JUDGMENT\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>      This Writ Petition is filed with the following prayers:\n<\/p>\n<blockquote><p>            i. issue      a writ of mandamus or any other<br \/>\n                appropriate writ, order or direction directing<br \/>\n                respondents 3 and 4 to afford police<br \/>\n                protection to the petitioner, for marking the<br \/>\n                boundary      of the 45 cents of land for the<br \/>\n                purpose of executing the sale deed in favour<br \/>\n                of the fifth respondent by removing all<br \/>\n                obstructions including obstructions caused by<br \/>\n                respondents 1 and 2 and their supporters.\n<\/p><\/blockquote>\n<blockquote><p>            ii. declare that respondents 1 and 2 have no right<br \/>\n                to obstruct the surveying and marking of the<br \/>\n                boundary of 45 cents of land in Sy. Nos.<br \/>\n                128\/2Pt, 132\/Pt in Block No.7 &amp; 8 of Ward<br \/>\n                No.7 of Nagaram Desom, Nagaram Village,<br \/>\n                Kozhikode Taluk.\n<\/p><\/blockquote>\n<p>      2. The first respondent has filed a counter affidavit. In paragraph 5<\/p>\n<p>of the counter affidavit, it is stated thus:\n<\/p>\n<blockquote><p>            &#8220;Respondents 1 and 2 have no objection in the<br \/>\n            petitioner measuring and demarcating their<\/p>\n<p><span class=\"hidden_text\">W.P.(C)NO.20151\/2009                  2<\/span><\/p>\n<p>             property. It can be done only with respect to<br \/>\n             their title deeds. They cannot unilaterally take a<br \/>\n             stand that the sub soil of the way forms part of<br \/>\n             their property. The attempt of the petitioner is to<br \/>\n             encroach upon the way exercising political<br \/>\n             influence, which they have in abundance. On<br \/>\n             the strength of an order of police protection<br \/>\n             granted by this Hon&#8217;ble Court, they may not be<br \/>\n             allowed     to  encroach   upon    property    not<br \/>\n             belonging to them.&#8221;\n<\/p><\/blockquote>\n<p> The parties have no objection in measuring and demarcating the 45 cents<\/p>\n<p>of property on the basis of title deeds in the presence of the revenue<\/p>\n<p>officials.\n<\/p>\n<p>      Therefore, the Writ Petition is disposed of, making it clear that<\/p>\n<p>measurement and demarcation of the 45 cents of property referred to above<\/p>\n<p>will be done by the Taluk Surveyor on the basis of the title deeds.
