DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Service is waived.\n<\/p>\n<p>\tThis<br \/>\napplication is filed by the applicant for deletion\/modification of<br \/>\ncondition No.8(d)  &#8216;not leave the State of Gujarat<br \/>\nwithout prior permission of the Sessions Judge concerned&#8217; of<br \/>\nthe order dated 29.12.2010 passed by this Court  in Criminal Misc.<br \/>\nApplication No.15291 of 2010 on the ground that the applicant has to<br \/>\ntravel various places and has to frequently visit different States<br \/>\nand Cities for the purpose of his business and at times it is<br \/>\ndifficult and inconvenient for him to avail permission of the Special<br \/>\nCourt [CBI Court] Ahmedabad, and, therefore, condition No.8(d) may be<br \/>\ndeleted\/modified since adequate safe-guard is contained in other<br \/>\nconditions of the order dated 29.12.2010.\n<\/p>\n<p>\tI<br \/>\nhave heard Mr. A.P. Ravani, learned counsel for the CBI.\n<\/p>\n<p>\tConsidering<br \/>\nthe overall facts and circumstances of the case and the grounds<br \/>\nstated in paragraph 5 of the application about requirement of the<br \/>\napplicant to frequently travel in different States and Cities for<br \/>\nbusiness purpose, I deem it just and proper to modify condition<br \/>\nNo.8(d) to the effect that  &#8220;the applicant is directed to<br \/>\ninform the Sessions Court and\/or CBI Court only when he is to travel<br \/>\nout of the country&#8221;.\n<\/p>\n<p>\tOther<br \/>\nconditions of the order dated 29.12.2010 shall remain as they are.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>\tD.S.\n<\/p>\n<p>Permitted.\n<\/p>\n<p>(ANANT<br \/>\nS.
