On account of certain<br \/>\nirregularities alleged to have been committed by the petitioner, the<br \/>\npetitioner was discharged from service with immediate effect. Against<br \/>\nthe said decision, the petitioner preferred an appeal before the<br \/>\nappellate authority. The appellate authority, after hearing the<br \/>\nparties and after considering the evidence on record, allowed the<br \/>\nappeal vide order dated 14th March, 1995.\n<\/p>\n<p>2.2.\t\tIt<br \/>\nis the case of the petitioner that pursuant to the order passed by<br \/>\nthe appellate authority, he was taken back in the service. However,<br \/>\nsubsequently a suspension order was passed by the respondent-Bank.<br \/>\nThereafter a charge sheet was issued to the petitioner and<br \/>\ndepartmental inquiry was initiated. After completion of departmental<br \/>\ninquiry, punishment of discharge from service with superannuation<br \/>\nbenefit was imposed upon him.\n<\/p>\n<p>2.3.\t\tBeing<br \/>\naggrieved by the decision of the disciplinary authority, the<br \/>\npetitioner again preferred an appeal before the appellate authority,<br \/>\nwhich was dismissed.  The petitioner, therefore, raised an industrial<br \/>\ndispute before the Labour Court Vadodara. The Labour Court after<br \/>\nhearing the parties, allowed the reference and directed the<br \/>\nrespondent-Bank to reinstate the petitioner in service on his<br \/>\noriginal post, without any back wages.\n<\/p>\n<p>2.4.\t\tAgainst<br \/>\nthe said order of the Labour Court, the respondent-Bank approached<br \/>\nthis Court by filing Special Civil Application No. 8943 of 2000<br \/>\nwhereby the Court has allowed the petition and set aside the order<br \/>\npassed by the Labour Court, Vadodara. Being aggrieved by the said<br \/>\norder, the petitioner had preferred a Letters Patent Appeal before<br \/>\nthis Court, which is pending. It is the case of the petitioner that<br \/>\nso far the respondent-Bank has not released the superannuation<br \/>\nbenefits, though the petitioner is entitled for all the same.<br \/>\nTherefore,  the petitioner is constrained to approach this Court by<br \/>\nway of this petition.\n<\/p>\n<p>3.0.\t\tHeard<br \/>\nlearned counsel for the parties. The petitioner has tried to explain<br \/>\nthe delay by submitting a writ petition preferred by the State Bank<br \/>\nof India against the order of the Labour Court, Vadodara, which was<br \/>\ndisposed of by judgment and order dated 25th July, 2007<br \/>\npassed in Special Civil Application No. 8493 of 2000, against which<br \/>\nLetters Patent Appeal is preferred by the petitioner, which is still<br \/>\npending for consideration.  The petitioner&#8217; s cause of action has<br \/>\nstarted from 25th July, 2007 and this petition is moved on<br \/>\n24th January, 2008. However, the relief claimed in this<br \/>\npetition is with regard to grant of pension from the year 1996. In my<br \/>\nview, it is at belated stage and it would have been appropriate for<br \/>\nthe petitioner to get the clarification at the time when Special<br \/>\nCivil Application filed by respondent-Bank was pending. However, no<br \/>\nsuch clarification was sought for. In that view of the matter, such<br \/>\nclaim after a period of 12 years cannot be entertained and the order<br \/>\npassed in Special Civil Application No. 8493 of 2000 has achieved<br \/>\nfinality.\n<\/p>\n<p>3.1.\t\tHowever,<br \/>\nsince  Letters Patent Appeal preferred by the petitioner is pending,<br \/>\nin my opinion, it would be appropriate for the petitioner to get<br \/>\nclarification from the Bench which is taking up the said Letters<br \/>\nPatent Appeal preferred against the order of learned Single Judge.\n<\/p>\n<p>3.2.\t\tConsidering<br \/>\nthe facts of the case, it would be relevant to refer to the decision<br \/>\nof the Apex Court rendered in the case of <a href=\"\/doc\/1289481\/\">Laxman Dundappa<br \/>\nDhamanekar &amp; Anr. v. Management of Vishwa Bharata Seva Samiti &amp;<br \/>\nAnr. Reported<\/a> in (2001) 8 SCC pg.378,<br \/>\nwherein it has been held that claim made after a very long time, the<br \/>\nemployee would not be entitled for the arrears of the entire period.\n<\/p>\n<p>3.3.\t\tThus, in view of the<br \/>\nabove, and keeping in mind the principle laid down by the Apex Court<br \/>\nin the case of <a href=\"\/doc\/1289481\/\">Laxman Dundappa Dhamanekar &amp; Anr. v. Management<br \/>\nof Vishwa Bharata Seva Samiti &amp; Anr. (Supra) I<\/a> am of the<br \/>\nopinion, that the petition does not deserve to be entertained.\n<\/p>\n<p>3.4.\t\tEven<br \/>\notherwise, in the reply filed by the respondent,  it is stated that<br \/>\nas per the Rules of the Bank, a member is entitled to Pension if he<br \/>\nhas  completed 20 years of service and provided that he has attained<br \/>\nthe age of 50 years. In the present case, the date on which the<br \/>\npetitioner was discharged from the service, he had completed 45 years<br \/>\nonly. Hence, as per the Pension Rules the petitioner is not entitled<br \/>\nto any pension.\n<\/p>\n<p>4.0.\t\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petition. The<br \/>\nsame is accordingly rejected. Notice is discharged.
