Justice S.SIRI JAGAN\n\n Dated :10\/04\/2007\n\n O R D E R\n                                 S.SIRI JAGAN, J\n\n                -----------------------------------------\n\n                        W.P.(C)NO.382  of 2007\n\n                -----------------------------------------\n\n\n                Dated this the 10th  day  of  April,  2007\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      The   petitioner,   a   defaulter   in   the   repayment   of   loan<\/p>\n<p>amounts due from the second respondent challenges proceedings<\/p>\n<p>initiated by the second respondent bank under the Securitisation<\/p>\n<p>and   Reconstruction   of   Financial   Assets   and   Enforcement   of<\/p>\n<p>Security   Interest   Act   2002(Act).   They   raised   three   contentions.\n<\/p>\n<p>First   is   that   the   bank   has   already   obtained   a   decree   and<\/p>\n<p>execution of the said degree is in progress. Therefore a parallel<\/p>\n<p>initiation of proceedings for execution of the decree under the Act<\/p>\n<p>is   not   permissible.   Second   contention   is   that   since   the   security<\/p>\n<p>interest   is     an  agricultural   property  and     the   Act  itself   excludes<\/p>\n<p>the   application   of   the   Act   to   agricultural   properties,   the<\/p>\n<p>proceedings initiated are without jurisdiction.\n<\/p>\n<p>      2.   I   have   heard   the   learned   counsel   for   the   petitioner   as<\/p>\n<p>also   the   learned   Standing   Counsel   appearing   for   the   second<\/p>\n<p>respondent.  The  second respondent is  a schedule bank which is<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.382\/2007                                            :2:<\/span><\/p>\n<p>not  a  nationalised  bank.  Neither   the  Government  nor   any  other<\/p>\n<p>governmental institution has any share or interest in the second<\/p>\n<p>respondent  bank.  As  such,  no   writ  petition   under  Article  226   of<\/p>\n<p>the   Constitution   of   India   would   be   maintainable   against   the<\/p>\n<p>second respondent bank except in respect of a public function by<\/p>\n<p>the 2nd respondent bank. Recovery of loan amounts due by resort<\/p>\n<p>to   proceedings   under   the   Act   cannot   be   stated   to   be   a   public<\/p>\n<p>function     which     attracts   jurisdiction   under   Article   226   of   the<\/p>\n<p>Constitution of India.\n<\/p>\n<p>        Secondly, it is settled law as decided by a Division Bench of<\/p>\n<p>this Court that even when a suit for realisation of the amount  is<\/p>\n<p>pending   proceedings   under   the   Act,   which     is   maintainable,   of<\/p>\n<p>course,   the   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>bank has tried to execute the decree by resorting to proceedings<\/p>\n<p>under   the   Act.   I   do   not   see   the   difference   in   the   same   simply<\/p>\n<p>because in Ext.P2 notice, the amount due is shown as a decree<\/p>\n<p>debt as per the suit that does not make the proceedings initiated<\/p>\n<p>under the Act as one in execution of the decree itself. Admittedly,<\/p>\n<p>Ext.P2   is   a   notice   issued   under   the   Act.   That   being   so,   just<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.382\/2007                                            :3:<\/span><\/p>\n<p>because a decree has been passed and that the decreetal amount<\/p>\n<p>has been shown as the amount due in that notice, the notice is<\/p>\n<p>not in any way vitiated.\n<\/p>\n<p>        In   so   far   as   the   contention   regarding   the   security   interest<\/p>\n<p>being agricultural property, I am afraid that I cannot go into the<\/p>\n<p>question   except   by   taking   evidence   which   I   cannot   do   in<\/p>\n<p>proceedings   under   Article   226   of   the   Constitution   of   India.\n<\/p>\n<p>Further, a petitioner has an effective alternate remedy by way of<\/p>\n<p>filing an appeal before the Debt Recovery Tribunal to establish his<\/p>\n<p>case   in   that   respect   also.
