This is reflected from the contents of<br \/>\npara which is just above the operative part of the order.  It is<br \/>\nspecifically mentioned in the said para that, &#8216;the purchaser of the<br \/>\nland is a Co-operative institution.  This land is used for<br \/>\nnon-agricultural purpose.  There is a construction made on the land.<br \/>\nRida Mill is in running condition.  The entire land is in possession<br \/>\nof opponent No.3 (the present petitioner).  The original land owners<br \/>\nare not in possession.  Thus, the possession of the land is with<br \/>\nopponent No.3 (the present petitioner).  The said land is in the<br \/>\npossession and occupation of Grofed since 1983 and by constructing a<br \/>\nRida factory on that land, investment of lacs of rupees is made.<br \/>\nGrofed is a State level co-operative institution, working for the<br \/>\nbenefit of farmers.  Hence, in the public interest, it will be<br \/>\nappropriate if that institution is granted an opportunity to complete<br \/>\nthe required procedure under the law.  Therefore, if the remaining<br \/>\nland admeasuring 1 acre 26 gunthas (of Block No.898, which admeasured<br \/>\n5 acres and 06 gunthas, of which the present petitioner purchased 3<br \/>\nacres and 15 gunthas) is allowed to be purchased by registered sale<br \/>\ndeed and opponent No.3 (the present petitioner) is allowed to obtain<br \/>\nnecessary permission under Section 63 of the Bombay Tenancy &amp;<br \/>\nAgricultural Lands Act, 1948 and Section 65 of the Land Revenue Code,<br \/>\nthe question will stand resolved and hence, the following order is<br \/>\npassed&#8217;.\n<\/p>\n<p>2.1\t\tOpponent No.3 (the<br \/>\npresent petitioner) did not deem it proper to avail the indulgence<br \/>\ngranted by the Prant Officer, Mehsana and challenged this order by<br \/>\nfiling Revision Application before the Deputy Secretary (Appeals)<br \/>\nbeing No.SRD\/CON\/MSN\/3\/93, which came to be decided by order dated<br \/>\n10\/12.01.1994.  Being aggrieved by that, the present petition is<br \/>\nfiled.\n<\/p>\n<p>3.\t\tLearned Advocate<br \/>\nMr.Bhatt for the petitioner could not put forward any reason much<br \/>\nless any convincing reason for the present petitioner to adopt this<br \/>\ncourse of action.  This Court is unable to visualize any earthly<br \/>\nreason for adopting this course of action.  What was required by the<br \/>\nPrant Officer was that, &#8216;the present petitioner to purchase the<br \/>\nremaining land of Block No.898 admeasuring 1 acre and 26 gunthas as<br \/>\nit had already purchased 3 acres and 15 gunthas of that Block, which<br \/>\nhad resulted into a fragmentation being created and thereby causing<br \/>\nbreach of law related to fragmentation&#8217;.\n<\/p>\n<p>4.\t\tLearned Advocate for<br \/>\nthe petitioner relied upon various judgments of this Court, firstly<br \/>\ntelling this Court that he is relying upon a &#8216; reported&#8217;<br \/>\njudgment, as if &#8216;reported&#8217; judgment carries more weight than the<br \/>\n&#8216;unreported&#8217; judgment.  Later on, he cited the judgment with the name<br \/>\nof the learned Judge, as if the judgment by a particular learned<br \/>\nJudge carries more weight than the judgment by another learned Judge.<br \/>\n This practice is deprecated.  Learned Advocate is having a standing<br \/>\nof 30 years at the Bar.  He should have appreciated that a judgment,<br \/>\neither reported or unreported, carries same weight and a judgment by<br \/>\nany learned Judge of the Court carries the same weight and therefore,<br \/>\nname of the learned Judge is not required to be mentioned in the<br \/>\narguments.\n<\/p>\n<p>5.\t\tAll the judgments<br \/>\nrelied upon by the learned Advocate for the petitioner are on the<br \/>\npoint that power exercised under the Bombay Prevention of<br \/>\nFragmentation &amp; Consolidation of Holdings Act is to be exercised<br \/>\nwithin a particular time limit.  In one judgment, relied upon by the<br \/>\nlearned Advocate for the petitioner, reported in 1988 (1) GLH<br \/>\n(U.J.) 20 in the case of Nanji Mulji Thumar Vs. State of<br \/>\nGujarat &amp; Ors., power was sought to be exercised after 24<br \/>\nyears, after the transaction.  The Court was pleased to hold that<br \/>\nthis is not permissible.  All other judgments relied upon by the<br \/>\nlearned Advocate for the petitioner are also on the same line.  But<br \/>\nthen, these judgments have no application to the facts of the present<br \/>\ncase because in the present case, the Prant Officer did not quash and<br \/>\nset aside any transaction.  On the contrary, he gave an opportunity<br \/>\nto the petitioner to purchase the remaining land of Block No.898 so<br \/>\nas to see that technical breach of fragmentation law does not<br \/>\nsurvive.\n<\/p>\n<p>6.\tIt is the ill-advice<br \/>\nobtained by the petitioner which has caused the difficulty for the<br \/>\npetitioner.  This Court, having perused the order passed by the Prant<br \/>\nOfficer and the order passed by the Deputy Secretary (Appeals), finds<br \/>\nthat there is no substance in the petition.  The petition is<br \/>\ndismissed.  Rule is discharged.  Interim relief granted earlier is<br \/>\nvacated forthwith.\n<\/p>\n<p>\t\tIt will be<br \/>\ninappropriate if cost is not awarded in such a misconducted and<br \/>\nmis-convinced matter.  The petition is dismissed with cost of<br \/>\nRs.7,500\/- (Rupees Seven Thousand Five Hundred) only, deposit of the<br \/>\ncost shall be the condition precedent for filing further proceedings<br \/>\nin the matter.\n<\/p>\n<p>7.\t\tAt this juncture,<br \/>\nlearned Advocate for the petitioner requested that status quo granted<br \/>\nearlier be continued for some time.\n<\/p>\n<p>\t\tThe request is<br \/>\ndeclined for the reason that the petitioner does not deserve any<br \/>\nfurther indulgence as it has failed to avail the indulgence granted<br \/>\nby the first authority at the initial stage of the litigation.\n<\/p>\n<p>(Ravi<br \/>\nR.Tripathi, J.)<\/p>\n<p>*Shitole  <\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Gujarat vs Manibhai on 25 November, 2010 Author: Ravi R.Tripathi,&amp;Nbsp;
