P. Mukherjee, learned Senior<\/p>\n<p>                             counsel for the petitioner and Mr. Sidharath Prasad,<\/p>\n<p>                             learned counsel for the railway.\n<\/p>\n<p>                                           The petitioner was not a party to the<\/p>\n<p>                             proceeding before the Central Administrative Tribunal<\/p>\n<p>                             bearing O.A. No. 777\/2010. He has preferred this writ<\/p>\n<p>                             petition on the ground that the applicant before the<\/p>\n<p>                             Tribunal ought to have made the petitioner a party and<\/p>\n<p>                             the Tribunal should have decided the matter after hearing<\/p>\n<p>                             the petitioner because he is adversely affected by the<\/p>\n<p>                             impugned order dated 23-11-2010. A perusal of the<\/p>\n<p>                             impugned order shows that it is an interim order and the<\/p>\n<p>                             Tribunal has fixed a date for completion of pleadings.<\/p>\n<p>                                           The office has objected to the maintainability<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        of this writ petition on the ground that the petitioner was<\/p>\n<p>        not a party before the Tribunal. It has rightly been<\/p>\n<p>        submitted that even a person who was not a party before<\/p>\n<p>        the Tribunal may maintain the writ petition if the order<\/p>\n<p>        of the Tribunal affects him adversely. However, in the<\/p>\n<p>        facts of the case, we are of the view that interest of<\/p>\n<p>        justice will be fully protected if petitioner is granted<\/p>\n<p>        liberty to move before the Tribunal for being impleaded<\/p>\n<p>        as a respondent and he may also seek review of the<\/p>\n<p>        impugned order if he can show to the Tribunal that he is<\/p>\n<p>        adversely affected by the order and was required to be<\/p>\n<p>        heard before passing of the order.\n<\/p>\n<p>                  The writ petition is, accordingly, disposed of<\/p>\n<p>        with the liberty aforesaid.\n<\/p>\n<p>                  It is expected that if the petitioner files an<\/p>\n<p>        application by way of review and for impleadment, the<\/p>\n<p>        same should be considered expeditiously on its own<\/p>\n<p>        merits.<\/p>\n<pre>\n\n\n                               (Shiva Kirti Singh, J.)\n\n\nBKS\/-                             (V.
