SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/03\/2009 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate writ, order and\/or<br \/>\ndirection quashing and setting aside the action of respondent No.1 in<br \/>\ninforming respondent No.2 to terminate the services of the petitioner<br \/>\non the ground that the petitioner has not passed the pre-service<br \/>\ntraining examination within stipulated permissible chances.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner came to be appointed as Junior Clerk on compassionate<br \/>\nground in the year 1989. As per condition no.12 of the appointment<br \/>\norder, the petitioner was required to pass pre-service training<br \/>\nexamination within prescribed period and chances. It is an admitted<br \/>\nposition that the petitioner has not passed the pre-service training<br \/>\nexamination within the permissible chances and, therefore, services<br \/>\nof the petitioner is sought to be terminated, against which, the<br \/>\npetitioner has preferred the present petition under Article 226 of<br \/>\nthe Constitution of India.\n<\/p>\n<p>3.\t\tIt<br \/>\nis the contention on behalf of the petitioner that as per Government<br \/>\nResolution dated 16th December,1991, the petitioner is<br \/>\nentitled to one additional chance to appears in the examination. It<br \/>\nis further submitted that as per Government Resolution dated 17th<br \/>\nMay,1989, over and above that additional fourth chance to appear in<br \/>\nthe examination, the employees appointed on compassionate grounds may<br \/>\nalso be given one more grace chance, so that they can clear<br \/>\npre-service training examination, as required under the Rules.<br \/>\nTherefore, it is submitted that so long as the petitioner is<br \/>\nappointed on compassionate ground, the petitioner is entitled to two<br \/>\nmore chances so as to clear pre-service training examination. The<br \/>\npetitioner is not required to be terminated and while in service the<br \/>\npetitioner should be given additional grace chance. Now, the above<br \/>\ncontroversy to give the additional grace chance, continuing the<br \/>\nemployee in service is not res-integra. Identical question came to be<br \/>\nconsidered by the learned Single Judge of this Court in the case of<br \/>\nKalpeshkumar Babubhai Patel V\/s. State of Gujarat and others<br \/>\nreported in 2007(2) GLR 1577. Relying upon the said<br \/>\ndecision and other decisions, even this Court has recently held in<br \/>\nthe decision dated 18th February,2009 passed in Special<br \/>\nCivil Application No.13372 of 2008, that once the employee is<br \/>\nappointed on compassionate ground, has to clear pre-service training<br \/>\nexamination within permissible chances and though such employee might<br \/>\nbe entitled to additional grace chance, such additional grace chance<br \/>\ncan be availed sitting at home and such an employee cannot pray that<br \/>\nall the additional grace chances should be exhausted. It is reported<br \/>\nthat decision taken by this Court has been confirmed by the Division<br \/>\nBench of this Court recently.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above and for the reasons stated in the judgment and<br \/>\norder dated 18th February,2009 passed in Special Civil<br \/>\nApplication No.13372 of 2008 and other allied matters, the present<br \/>\npetition deserves to be dismissed and the same is accordingly<br \/>\ndismissed. Rule is discharged. Interim relief, granted earlier, shall<br \/>\nstands vacated forthwith.
