On<br \/>\n\t15th March 2007, the respondent- Gujarat<br \/>\n\tPublic Service Commission (hereinafter referred to as &#8216;the<br \/>\n\tCommission&#8217;) published an advertisement for the cadre of Class-I for<br \/>\n\tthe post of Assistant Director of Training\/ Assistant Training<br \/>\n\tAdvisor\/Principal. The petitioner applied for the same and she<br \/>\n\tappeared in the written test. Thereafter, the respondent-Commission<br \/>\n\ton 29th January 2009 published another advertisement for<br \/>\n\tthe post of Class-II cadre. The petitioner also applied for the<br \/>\n\tsame. On 03rd September 2009, the petitioner received a<br \/>\n\tletter from the respondent No.2 that the petitioner cannot be<br \/>\n\tconsidered for oral interview as the petitioner does not have enough<br \/>\n\texperience. On 12th December 2009, the petitioner&#8217;s<br \/>\n\tcandidature has been rejected as she failed to supply her SSC<br \/>\n\texamination certificate for the purpose of her date of birth. The<br \/>\n\tpetitioner and others challenged the decision of rejecting the<br \/>\n\tcandidature for Class-II post before this Court by way of Special<br \/>\n\tCivil Application No.551 of 2010, wherein on the statement made by<br \/>\n\tthe learned advocate for the respondent-Commission that the<br \/>\n\trespondent-Commission will permit all the candidates to furnish the<br \/>\n\trequisite documents, the said petition was disposed of. Even the<br \/>\n\tpetitioner has not been called for furnishing the documents of<br \/>\n\texperience. Hence, the present petition.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions advanced by the learned counsel appearing<br \/>\n\ton behalf of the petitioner and the relevant documents on record, it<br \/>\n\ttranspires that the petitioner had applied for the post of Class-I<br \/>\n\tcadre and thereafter vide communication dated 03rd<br \/>\n\tSeptember 2009, she has been intimated by the respondent-authority<br \/>\n\tthat the petitioner does not possess the requisite educational<br \/>\n\tqualification and experience as enumerated in the advertisement<br \/>\n\twhich is prescribed by the respondent-Commission.  It is pertinent<br \/>\n\tto note that even after the said decision, the petitioner is not in<br \/>\n\ta position to establish that he is fulfilling all the criteria as<br \/>\n\tenumerated in the advertisement as well as those prescribed by the<br \/>\n\trespondent-Commission. Therefore, as the petitioner does not possess<br \/>\n\tthe requisite educational qualification and experience, her<br \/>\n\tcandidature has been rejected by the respondent-Commissioner. Hence,<br \/>\n\tthe action of the respondent- Commission is just and proper. I do<br \/>\n\tnot find any illegality or material irregularity in the impugned<br \/>\n\tdecision rendered by the respondent-Commission.
