No.32335 of 2011\n                              Bambam Singh son of Late Nandeshwar Singh\n                                                 Versus\n                                         The State Of Bihar\n                                               -----------\n<\/pre>\n<p>2.   30.9.2011                Heard learned Counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under Sections 25(1-b)1, 26 of the Arms Act.<\/p>\n<p>                             Considering that the petitioner is in custody since<\/p>\n<p>                 25.7.2010 for recovery of a loaded country made pistol and<\/p>\n<p>                 apart from one other case pending against him he has fair<\/p>\n<p>                 antecedents.\n<\/p>\n<p>                             Considering the same, let the petitioner above<\/p>\n<p>                 named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                 5,000\/-(Five thousand) with two sureties of the like amount<\/p>\n<p>                 each or any other surety to be fixed by the court concerned to<\/p>\n<p>                 the satisfaction of learned Judicial Magistrate, 1st class,<\/p>\n<p>                 Lakhisarai in connection with Barahaiya P.S. Case No.107 of<\/p>\n<p>                 2010, subject to the conditions (i) That one of the bailor shall<\/p>\n<p>                 be Sanjay Kumar and the other bailor will be a close relative<\/p>\n<p>                 of the petitioner who will give an affidavit giving genealogy as<\/p>\n<p>                 to how he is related with the petitioner. The bailor will<\/p>\n<p>                 undertake to furnish information to the Court about any<\/p>\n<p>                 change in address of the petitioner. (ii) That the bailor shall<\/p>\n<p>                 also state on affidavit that he will inform the court concerned if<\/p>\n<p>                 the petitioner is implicated in any other case of similar nature<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            after his release in the present case and thereafter the court<\/p>\n<p>            below will be at liberty to initiate the proceeding for<\/p>\n<p>            cancellation of bail on ground of misuse, (iii) That the<\/p>\n<p>            petitioner will give an undertaking that he will receive the<\/p>\n<p>            police papers on the given date and be present on date fixed<\/p>\n<p>            for charge and if he fails to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, his bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse, (iv) That the petitioner will be<\/p>\n<p>            well represented on each date if he fails to do so on two<\/p>\n<p>            consecutive dates, his bail will be liable to be cancelled.<\/p>\n<p>                     The fact that the petitioner is an accused in only one<\/p>\n<p>            other case besides the present one will be verified by the<\/p>\n<p>            Magistrate concerned before releasing the petitioner on bail.<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Bambam Singh vs The State Of Bihar on 30 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
