1.\t\tThe
\nappellant, Insurance Inspector of E.S.I.Corporation, has called into
\nquestion order dated 03.03.1999  of learned single Judge of this
\nCourt in First Appeal No.372 of 1999, whereby the appeal was
\ndismissed.\n<\/p>\n
2.\t\tThere
\nis no dispute about the fact that the father of respondent No.1 died
\nduring the course of employment on account of an industrial accident
\non 21.6.2981. Her application for due compensation was resisted only
\non the ground that she was a married daughter of the deceased
\nemployee. There is also no dispute about the fact that the
\nrespondent’s husband had passed away and she was dependent upon and
\nresiding with the deceased employee at the time of the accident.
\nUnder such circumstances, the Employees’ Insurance Court decided on
\n04.12.1998 that the respondent was entitled to the dependent’s
\nbenefits  due under the provisions of the Employees’ State Insurance
\nAct, 1948 (“ESI Act”  for short).\n<\/p>\n
2.1\t\tBeing
\naggrieved by the aforesaid order in E.S.I. Application No.9 of 1996,
\nthe appellant had approached this Court by way of First Appeal and,
\nin the impugned order, learned single Judge has analyzed the scheme
\nof the relevant provision and held that the expression “unmarried
\ndaughter” would include a daughter who is divorced or who is
\nwidowed at the time of death of the insured person. The present
\nappeal was sought to be argued mainly on the basis that the
\ndefinition of “dependant”, contained in Sec.2 (6-A), was
\nnot duly considered and interpreted by learned single Judge.
\nConsidering that argument, it was seen that the definition of the
\nexpression “dependant” was wide enough to include widowed
\ndaughter of  the deceased employee, in the facts of the present case.
\nThe definition of “dependant” in Sec.2 (6-A) of the ESI
\nAct reads as under:\n<\/p>\n
“S.2
\n(6-A) “dependant”\n<\/p>\n
means any of the following relatives of a deceased insured person,
\nnamely :-\n<\/p>\n
(i) \ta
\nwidow, a minor legitimate or adopted son, an unmarried legitimate or
\nadopted daughter;\n<\/p>\n
\t(ia)
\n\ta widowed mother;\n<\/p>\n
(ii)
\n\tif wholly dependent on the earnings of the insured person at the
\ntime of his death, a legitimate or adopted son or daughter who has
\nattained the age of eighteen years and is infirm;\n<\/p>\n
(iii)
\n\tif wholly or in part dependent on the earnings of the insured person
\nat the time of his death, –\n<\/p>\n
\t(a)
\n\ta parent other than a widowed mother, <\/p>\n
(b)
\n\ta minor illegitimate son, an unmarried illegitimate daughter or a
\ndaughter legitimate or adopted or illegitimate if married and a minor
\nor if widowed and a minor, <\/p>\n
(c)
\n\ta minor brother or an unmarried sister or a widowed sister if a
\nminor, <\/p>\n
\t(d)
\n\ta widowed daughter-in-law, <\/p>\n
\t(e)
\n\ta minor child of a pre-deceased son, <\/p>\n
(f)
\n\ta minor child of a pre-deceased daughter where no parent of the
\nchild is alive, or <\/p>\n
(g)
\n\ta paternal grand-parent if no parent of the insured person is alive;\n<\/p>\n
3.\t\tSeparating
\n the relevant part of the definition, it would clearly appear that
\n“dependant”,  inter alia,  means and includes a
\nlegitimate daughter, if she is unmarried, or a legitimate daughter
\nwho is wholly or in part dependent on the earnings of the insured
\npresent at the time of his death, on composite reading of clauses (i)
\nand (iii) (b). Therefore, the argument that the respondent was not a
\n“dependant” could not be accepted. No other reason is
\ncanvassed to interfere with the impugned order of learned single
\nJudge and in view of the relevant provision being read as above, the
\nappeal has to be dismissed. Accordingly, it is dismissed with no
\norder as to costs.  Interim relief, if any is operating, shall stand
\nvacated.\n<\/p>\n
