           Petitioners are the accused in<\/p>\n
C.C.216\/2009 on the file of Chief Judicial<\/p>\n
Magistrate’s        Court,              Ernakulam,           taken<\/p>\n
cognizance for the offence                         under Section<\/p>\n
420 of Indian Penal Code on Annexure-A5<\/p>\n
private  complaint                     filed            by  second<\/p>\n
respondent. Petition is filed under Section<\/p>\n
482 of Code of Criminal Procedure to quash<\/p>\n
the cognizance taken on Annexure-A7 final<\/p>\n
report for the offence under Section 420 of<\/p>\n
Indian Penal Code as well as Annexure-A8<\/p>\n
order passed by the             learned Magistrate, in<\/p>\n
a petition filed by the second respondent<\/p>\n
under  Section       451        of       Code        of   Criminal<\/p>\n
Procedure.       Second                respondent            filed<\/p>\n
Crmc 64\/10               2<\/span><\/p>\n
Annexure-A5 complaint before the Chief Judicial<\/p>\n
Magistrate, Ernakulam against the petitioners<\/p>\n
alleging     that they  committed  offence  under<\/p>\n
Section 420 of Indian Penal Code.         Learned<\/p>\n
Magistrate sent the complaint for investigation<\/p>\n
under     Section 156(3)   of  Code  of  Criminal<\/p>\n
Procedure, based on which Annexure-A6 FIR was<\/p>\n
prepared and crime No.1666\/2009 of Ernakulam<\/p>\n
Central Police Station was      registered. After<\/p>\n
investigation    Annexure-A7  final   report  was<\/p>\n
filed     which  was  taken  cognizance   by  the<\/p>\n
learned     Magistrate.  When   JCB,  which   was<\/p>\n
purchased     by the   first  petitioner  on  the<\/p>\n
financial assistance of the second respondent<\/p>\n
was seized, both     the first petitioner and the<\/p>\n
second respondent sought interim custody of the<\/p>\n
JCB     under Section  451  of Code  of  Criminal<\/p>\n
Procedure. By Annexure-A8 order interim custody<\/p>\n
was granted to the second respondent. Case of<\/p>\n

the      petitioners is that even if the entire<\/p>\n
allegations in      Annexure-A5 complaint as well<\/p>\n
as the     case in Annexure-A7   final report are<\/p>\n
accepted,      an offence under Section 420 of<\/p>\n
Indian     Penal   Code  is   not  attracted   and<\/p>\n
therefore, continuation of the proceedings is<\/p>\n
only an abuse of process of the Court.<\/p>\n
          2.   Learned  counsel appearing for the<\/p>\n
petitioners and    second respondent were heard.<\/p>\n
          3. Annexure-A5 complaint discloses the<\/p>\n
case      of the second respondent. According to<\/p>\n
the second respondent company, first petitioner<\/p>\n
approached the company to purchase a JCB on<\/p>\n
hire purchase agreement and second respondent<\/p>\n
agreed to     give financial assistance and first<\/p>\n
petitioner as principal loanee and petitioners<\/p>\n
2 to 4 as guarantors     executed a hire purchase<\/p>\n
agreement agreeing to pay the value of JCB in<\/p>\n
36 equal     monthly   installments of Rs.41,560\/-<\/p>\n

each     and  the  JCB  was  purchased  and  last<\/p>\n
installment      is  to   be paid  on  or  before<\/p>\n
28\/2\/2011.    It  is  alleged  that though  first<\/p>\n
petitioner paid four monthly installments, he<\/p>\n
defaulted subsequent monthly installments and<\/p>\n
when     second  respondent contacted  the  first<\/p>\n
petitioner on 7\/2\/2009 at his residence, he<\/p>\n
agreed to settle the over dues on or before<\/p>\n
15\/3\/2009. It is alleged that after 31\/3\/2008<\/p>\n
no      vehicle tax was paid   and   RC book was<\/p>\n
surrendered before the company      and insurance<\/p>\n
taken on 5\/11\/2007 expired on 4\/11\/2008 and<\/p>\n
insurance policy was not renewed and when the<\/p>\n
representative    of  the  company contacted  the<\/p>\n
first     petitioner,  he  agreed  to  renew  the<\/p>\n
insurance policy and agreed to pay vehicle tax<\/p>\n
and still it was not     done. On 6\/2\/2009 second<\/p>\n
respondent company sent a notice to the first<\/p>\n
petitioner to pay installment dues amounting to<\/p>\n

Rs.3,03,793.72, namely the amount payable       in<\/p>\n
seven     defaulted  installments.  It  is  alleged<\/p>\n
that     first  petitioner  did  not  turn  up  and<\/p>\n
therefore, on 17\/3\/2009 company sent a notice<\/p>\n
recalling the entire loan amount advanced       as<\/p>\n
the     first  petitioner     failed  to  pay  the<\/p>\n
installments      and      clause   4(a)   of   the<\/p>\n
hypothecation Agreement     enables the company to<\/p>\n
take steps to recall the loan      and forfeit the<\/p>\n
vehicle     and  it  was  intimated  to  the  first<\/p>\n
petitioner.      It   is   also   contended   that<\/p>\n
meanwhile, the       first petitioner     issued a<\/p>\n
cheque dated 13\/4\/2009 for Rs.12,90,000\/- and<\/p>\n
when it was presented, the same was dishonoured<\/p>\n
for want of sufficient funds and in spite of<\/p>\n
notice, the amount was not paid and therefore,<\/p>\n
proceedings under Section 138 of         Negotiable<\/p>\n
Instruments Act is initiated as S.T.1978\/2009.<\/p>\n
It    is   claimed  that    the  intention  of  the<\/p>\n

petitioners is to dismantle      the vehicle and<\/p>\n
thereby cheat the company and therefore, an<\/p>\n
offence under Section 420 of Indian Penal Code<\/p>\n
is    attracted.  Annexure-A7  final  report also<\/p>\n
shows that an offence under Section 420 of<\/p>\n
Indian Penal Code is alleged contending that<\/p>\n
though four installments were paid, subsequent<\/p>\n
installments were not paid and first petitioner<\/p>\n
did not return the JCB to the company and<\/p>\n
thereby they committed the offence.<\/p>\n
          5. As   rightly  pointed   out  by the<\/p>\n
learned    counsel appearing for the petitioners<\/p>\n
even if, the entire allegations in Annexure-A5<\/p>\n
as such are accepted, so also the allegations<\/p>\n
in    Annexure-A7  final  report,  offence  under<\/p>\n
Section    420  of  Indian  Penal  Code    is not<\/p>\n
attracted. What is alleged in the complaint is<\/p>\n
that first petitioner as the principal debtor<\/p>\n
and petitioners 2 to 4 as guarantors obtained<\/p>\n

loan for purchasing JCB on hire purchase    and<\/p>\n
the first petitioner agreed to pay the value of<\/p>\n
JCB      in 36 equal monthly installments at the<\/p>\n
rate      of Rs.41,560\/-  and defaulted  to  pay<\/p>\n
subsequent       installments    after    fourth<\/p>\n
installment and in spite of notice the    amount<\/p>\n
was not paid and even insurance policy was not<\/p>\n
renewed and the vehicle tax was not paid. None<\/p>\n
of these      aspects would attract an offence<\/p>\n
under Section 420 of Indian Penal Code. When<\/p>\n
there is no case for the second respondent that<\/p>\n
either when the loan was applied for or granted<\/p>\n
or    availed,   the  first  petitioner  or  his<\/p>\n
guarantors, petitioners 2 to 4 had a dishonest<\/p>\n
intention to cheat or not to pay the value of<\/p>\n
JCB to be purchased on hire purchase. At best<\/p>\n
it    could   be  said  that  subsequently  they<\/p>\n
defaulted to pay the installments due under the<\/p>\n
hire purchase agreement. That will not attract<\/p>\n
Crmc 64\/10               8<\/span><\/p>\n
an offence under Section 420 of Indian Penal<\/p>\n
Code. Hence cognizance taken for the offence<\/p>\n
under     Section 420  of  Indian  Penal  Code  on<\/p>\n
Annexure-A7 final report can only be quashed.<\/p>\n
When cognizance taken is quashed, Annexure-A8<\/p>\n
order granting interim custody of the vehicle<\/p>\n
to    the   second respondent  would  lapse    by<\/p>\n
itself.\n<\/p>\n
          Petition is allowed. C.C.216\/2009 on the<\/p>\n
file     of  Chief Judicial  Magistrate’s   Court,<\/p>\n
Ernakulam is quashed. Annexure-A8 order passed<\/p>\n
by Chief Judicial Magistrate, Ernakulam is also<\/p>\n
