Learned APP submitted that from the evidence<br \/>\nled before the learned Judge, the learned Judge ought to have<br \/>\nrecorded conviction for the offence alleged against the accused.<br \/>\nLearned APP submitted that the prosecution had produced copy of<br \/>\nvillage form No.8A, copy of village form No.7\/12, pedigree of the<br \/>\nfather of the accused, copy of house property of the accused, copy of<br \/>\nration card and copy of election card.\n<\/p>\n<p>4.\t\tOn perusal of the<br \/>\njudgment and order, it is noticed that the learned Judge has<br \/>\nconsidered the evidence led before him in required detail.  The<br \/>\nlearned Judge has rightly observed in para-19 the reasons for not<br \/>\nbelieving the case of the prosecution.  The learned Judge has<br \/>\nobserved that, &#8220;the prosecution has failed to bring home the<br \/>\nfact that the place from where the alleged &#8216;Ganja&#8217; plants were<br \/>\nrecovered was land bearing revenue survey No.22\/4&#8221;.  The<br \/>\nlearned Judge then proceeds to discuss that, &#8220;assuming for the<br \/>\nsake of argument that the land was bearing revenue survey No.2\/4 then<br \/>\nthe land was of joint ownership of the family members of the convict.<br \/>\n As his father-Bhavsinhbhai Dalsukhbhai Baria has expired, the land<br \/>\ndevolved upon the widowed mother, accused, his younger brother and<br \/>\ntwo sisters and thus, the prosecution is not able to bring home the<br \/>\nguilt on the part of the accused, proving beyond reasonable doubt<br \/>\nthat he was in exclusive possession of the land in question where<br \/>\n&#8216;Ganja&#8217; plants were found by the Police Officer&#8221;.\n<\/p>\n<p>4.1\t\tThere is no<br \/>\nsatisfactory evidence in the matter of both the aforesaid aspects and<br \/>\ntherefore, the learned Judge is pleased to record acquittal.\n<\/p>\n<p>5.\t\tThe R &amp; P was<br \/>\ncalled for and from the same, the relevant documents are perused by<br \/>\nthe Court.  The aforesaid question remains unanswered and therefore,<br \/>\nthe Court finds that the acquittal recorded by the learned Judge on<br \/>\nthe basis of the evidence led before the Court cannot be found fault<br \/>\nwith.
