Heard    Shri     Ajey      Kumar,      learned<\/p>\n<p>                    counsel for the petitioner and Shri Ajay<\/p>\n<p>                    Kumar Gautam, learned counsel appearing on<\/p>\n<p>                    behalf of all the respondents\/Bihar State<\/p>\n<p>                    Electricity Board.\n<\/p>\n<p>                              The    petitioner,       who    retired    with<\/p>\n<p>                    effect from 31.7.2009 as Assistant Store-<\/p>\n<p>                    Keeper,    Electrical      Central       Store,     Digha,<\/p>\n<p>                    Patna,     has    prayed        for      directing     the<\/p>\n<p>                    respondents for making payment of Gratuity,<\/p>\n<p>                    Leave     Encashment      and     payment      of     full<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>pension. The petitioner has further prayed<\/p>\n<p>for quashing of part of the order dated<\/p>\n<p>10.5.2010      (Annexure-7),              whereby       it     was<\/p>\n<p>proposed to recover from the retiral dues<\/p>\n<p>of the petitioner due to non passing of the<\/p>\n<p>Hindi Noting and Drafting examination.<\/p>\n<p>           Learned counsel for the petitioner<\/p>\n<p>has drawn my attention to Annexure-6 to the<\/p>\n<p>petition whereby amount of Leave Encashment<\/p>\n<p>was sanctioned in the year 2009 itself. It<\/p>\n<p>was submitted that despite the fact that<\/p>\n<p>amount of Leave Encashment was sanctioned<\/p>\n<p>long    back   in       the   year       2009,     till      date,<\/p>\n<p>payment has not been made.\n<\/p>\n<p>           The court is of the opinion that<\/p>\n<p>after    sanction        of    the        amount       of    Leave<\/p>\n<p>Encashment,     there         was    no    reason       for   the<\/p>\n<p>authority concerned to delay the payment.<\/p>\n<p>Immediately     after         the    order       of    sanction,<\/p>\n<p>the authority concerned is required to make<\/p>\n<p>payment.\n<\/p>\n<pre>           Keeping       in     view       the        fact    that\n\npetitioner      retired             in     the        month     of\n\n<\/pre>\n<p>July,2009 and till date amount of Gratuity<\/p>\n<p>and Leave Encashment have not been paid nor<\/p>\n<p>petitioner has started to get full pension,<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>the       court      is       of    the    opinion          that    writ<\/p>\n<p>petition            can       be     disposed          of     with    a<\/p>\n<p>direction to the respondents, particularly<\/p>\n<p>respondent            no.3\/Secretary,               Bihar          State<\/p>\n<p>Electricity           Board        to     take    all       steps    for<\/p>\n<p>making payment of the amount of Gratuity<\/p>\n<p>and Leave Encashment within a period of one<\/p>\n<p>month from the date of receipt\/production<\/p>\n<p>of    a    copy      of this         order.       In respect          of<\/p>\n<p>other claim, with the consent of parties,<\/p>\n<p>the       writ      petition         is    being       disposed      of<\/p>\n<p>granting liberty to the petitioner to file<\/p>\n<p>a    fresh       representation             before          respondent<\/p>\n<p>no.3      within          a   period       of    six     weeks      from<\/p>\n<p>today. If such representation is filed, it<\/p>\n<p>is     expected           that       respondent          no.3       will<\/p>\n<p>examine the same and pass appropriate order<\/p>\n<p>in     accordance             with        law    redressing          the<\/p>\n<p>grievances           of       the       petitioner          within     a<\/p>\n<p>period of three months from the date of<\/p>\n<p>filing of such representation. Even in case<\/p>\n<p>of refusal, respondent no.3 is required to<\/p>\n<p>pass       a     speaking          order        within      aforesaid<\/p>\n<p>time.
