          This Criminal Revision Petition is preferred by the<\/p>\n
accused in a prosecution for the offence punishable under<\/p>\n
Section 138 of the Negotiable Instruments Act, 1881 (for<\/p>\n
short ‘the N.I.Act’) as he is aggrieved by the conviction and<\/p>\n
sentence imposed against him, both by the trial court as<\/p>\n
well as the lower appellate court.\n<\/p>\n
     2.   The case of the complainant is that the revision<\/p>\n
petitioner\/accused borrowed a sum of Rs.75,000\/- and<\/p>\n
towards the discharge of the said liability, the revision<\/p>\n
petitioner\/accused issued a cheque dated 30.9.2007 for the<\/p>\n
said amount. According to the first respondent\/complainant,<\/p>\n
when the said cheque was presented for encashment, it was<\/p>\n
dishonoured for want of sufficient fund and accordingly, he<\/p>\n
approached the Judicial First Class Magistrate Court-II<\/p>\n
(Additional Munsiff), Kasaragod, by filing a complaint upon<\/p>\n
which cognisance was taken and C.C.No.307 of 2008 was<\/p>\n

instituted.    During the trial of the case, the complainant<\/p>\n
himself adduced oral evidence as PW1 and Exts.P1 to P8<\/p>\n
were produced. No evidence either oral or documentary<\/p>\n
was produced from the side of the defence. Based upon the<\/p>\n
materials and evidence, the trial court found that the<\/p>\n
revision petitioner\/accused is guilty and accordingly, he is<\/p>\n
sentenced to undergo simple imprisonment for three months<\/p>\n
and further directed to pay a sum of Rs.75,000\/- as<\/p>\n
compensation to the complainant under Section 357(3) of<\/p>\n
the Cr.P.C. and the default sentence is fixed as one month<\/p>\n
imprisonment.\n<\/p>\n
      3.   Challenging the above conviction and sentence,<\/p>\n
though the revision petitioner had approached the Sessions<\/p>\n
Court, Kasaragod by filing Crl.A.No.345 of 2008, by<\/p>\n
judgment dated 11.2.2010, the learned Sessions Judge<\/p>\n
allowed the appeal only in part and while confirming the<\/p>\n
conviction, the sentence was modified and reduced to one<\/p>\n

day till rising of court and while maintaining the amount of<\/p>\n
compensation ordered by the trial court, default sentence is<\/p>\n
enhanced      to     two months    simple imprisonment   and<\/p>\n
accordingly, the revision petitioner was directed to appear<\/p>\n
before the trial court on 17.3.2010.\n<\/p>\n
      4. It is the above finding and order of conviction and<\/p>\n
sentence of the court below challenged in this revision<\/p>\n
petition.    Going by the impugned judgments of the trial<\/p>\n
court as well as the lower appellate court, it can be seen<\/p>\n
that both the courts have concurrently found that the<\/p>\n
complainant has established his case against the accused<\/p>\n
and the courts have accepted the evidence and materials<\/p>\n
produced by the complainant. From the discussions and the<\/p>\n
materials relied on by the courts below, it can be seen that<\/p>\n
the accused has not disputed the signature in Ext.P1 cheque<\/p>\n
and the execution of the cheque. According to the revision<\/p>\n
petitioner\/accused, the cheque in question is the one which<\/p>\n

he entrusted with one Ramakrishna as a security when the<\/p>\n
accused obtained loan from the said Ramakrishna. So the<\/p>\n
signature as well as the execution of cheque are admitted by<\/p>\n
the accused. Therefore, the question to be considered is<\/p>\n
how far the accused succeeded in establishing his version<\/p>\n
especially, as to how the cheque reached in the hands of the<\/p>\n
complainant. Regarding this aspect, absolutely there is no<\/p>\n
evidence     adduced by the accused except his own<\/p>\n
explanation. It was under the above factual circumstances,<\/p>\n
the trial court as well as the lower appellate court repelled<\/p>\n
the plea raised by the defence and found against him and<\/p>\n
accordingly, came into a conclusion that the complainant<\/p>\n
has succeeded in establishing his case against the accused.<\/p>\n
Therefore, I find no merit in the revision petition.<\/p>\n
      5.     Learned counsel for the revision petitioner<\/p>\n
submitted that if this Court is not inclined to interfere with<\/p>\n
the order of conviction, some breathing time may be<\/p>\n

granted to the revision petitioner to pay the amount and to<\/p>\n
receive the sentence. This Court cannot ignore the fact that<\/p>\n
the cheque is dated 30.9.2007 for a substantial amount of<\/p>\n
Rs.75,000\/-. Though the trial court imposed the sentence of<\/p>\n
three months simple imprisonment while ordering the<\/p>\n
payment of Rs.75,000\/- as compensation, the lower<\/p>\n
appellate court reduced the substantial sentence to one day<\/p>\n
and directed the revision petitioner to pay the amount. So<\/p>\n
far, no amount is paid to the complainant and therefore,<\/p>\n
while granting some time to the revision petitioner to make<\/p>\n
the payment, the amount of compensation can be enhanced<\/p>\n
to Rs.80,000\/- (Rupees Eighty Thousand only) which will be<\/p>\n
sufficient to meet the ends of justice, especially in the light<\/p>\n
of the decision reported in Damodar.S.Prabhu v. Sayed<\/p>\n
Babalal.H.<\/a> [JT 2010(4) SC 457] wherein it was held that in<\/p>\n
the case of dishonour of cheques, the compensatory aspect<\/p>\n
of the remedy should be given priority over the punitive<\/p>\n

aspects.\n<\/p>\n
      6.   In the result, this Criminal Revision Petition is<\/p>\n
disposed of confirming the conviction of the revision<\/p>\n
petitioner under Section 138 of the N.I.Act as recorded by<\/p>\n
the trial court as well as the lower appellate court.<\/p>\n
Regarding the sentence, the sentence modified and refixed<\/p>\n
by the lower appellate court         is maintained, but the<\/p>\n
compensation amount is enhanced to Rs.80,000\/- (Rupees<\/p>\n
Eighty Thousand only) which shall be paid by the revision<\/p>\n
petitioner to the complainant, and in case of default in<\/p>\n
making the payment, the revision petitioner is directed to<\/p>\n
undergo       simple    imprisonment   for  three   months.<\/p>\n
Accordingly, the revision petitioner is directed to appear<\/p>\n
before the trial court on 20.8.2010 to receive the sentence<\/p>\n
and to make the payment of compensation as revised and<\/p>\n
refixed by this court. In case of any failure on the part of<\/p>\n
the revision petitioner in appearing before the court below<\/p>\n

as directed above, the trial court is free to take coercive<\/p>\n
steps to procure the presence of the revision petitioner and<\/p>\n
to execute the sentence and to realise the compensation<\/p>\n
amount.     The coercive steps, if any, pending against the<\/p>\n
revision petitioner shall be deferred till 20.8.2010.<\/p>\n
