Para-3 of the affidavit reads as<br \/>\nunder:-\n<\/p>\n<p>&#8220;3.\tAt the outset I<br \/>\nrespectfully say that, looking to the relevant record of the<br \/>\nMunicipality petitioner was serving with the municipality from 1978<br \/>\nand onward and he was called for the post of different interview in<br \/>\nthe year 1991, 1992, 1993 and 1994 but concerned selection committee<br \/>\nwas not selected the petitioner even though petitioner was most<br \/>\nsenior person in respect of the selected person even he was securing<br \/>\ndue qualification as regard the concerned post, I say that it is very<br \/>\ndifficulty to say that on what ground petitioner was not selected but<br \/>\nat present also he is continue with the Municipality as a daily<br \/>\nwager, therefore looking to the length of service and qualification<br \/>\npetitioner, municipality is ready to make proposal to the director of<br \/>\nMunicipality for regularizing of the petitioner, further Municipality<br \/>\nis ready to give the continuity in service from deemed date if the<br \/>\npetitioner will wave arrears\/back wages subject to director is<br \/>\nsanction the post.&#8221;\n<\/p>\n<p>2.\t\tThe<br \/>\naforesaid averments made in para-3 does take care of the grievance of<br \/>\nthe petitioner.  However, there is no mention as to within what time,<br \/>\nthe petitioner will be given regular appointment, as the same is made<br \/>\nsubject to sanction from the Director<br \/>\nof Municipalities.\n<\/p>\n<p>3.\t\tTaking<br \/>\ninto consideration the facts of the case and<br \/>\nthe affidavit filed by the Chief Officer, it is deemed proper to<br \/>\ndirect the Municipality to take up the matter with the Director of<br \/>\nMunicipalities in an urgent manner and shall see to it that necessary<br \/>\nproposals are rooted and the orders are obtained as early as<br \/>\npossible, preferably by 30.09.2011.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above, the impugned award and order dated 10.12.2010<br \/>\npassed by the learned Member, Industrial Tribunal, Nadiad, in<br \/>\nReference (ITN) No.37 of 2004 is accordingly modified.  The petition<br \/>\nis disposed of.  Rule is made absolute.
