     By Ext.P1 notification published in the Kerala<\/p>\n
Gazette dated 3.6.1986,           the Kerala Public Service<\/p>\n
Commission invited applications from eligible persons for<\/p>\n
appointment as Security Guards in the Travancore-Cochin<\/p>\n
Chemicals Limited. The qualifications prescribed for the<\/p>\n
post were as follows:-\n<\/p>\n<\/p>\n
      (1). A pass in S.S.L.C, or its equivalent.<\/p>\n
      (2). Physical Standards-<\/p>\n<\/blockquote>\n
          (a).Height-163 Cms.<\/p>\n<\/blockquote>\n
          (b). Weight-59Kgs.<\/p>\n<\/blockquote>\n
          (c).Chest-84 Cms, (normal) 89 Cms.<\/p><\/blockquote>\n
<\/blockquote>\n
          (expanded)<\/p>\n
      (3). Minimum 5 years service in the Defence<\/p>\n
      Forces.<\/p>\n
\n
2.   The petitioners and the fifth respondent applied.<\/p>\n
They were selected and appointed after written test and<\/p>\n
interview. The first petitioner joined duty on 23.2.1989,<\/p>\n

\n                             2<\/span><\/p>\n
the second petitioner on 13.10.1990 and the fifth<\/p>\n
respondent joined duty on 23.5.1989.          They were<\/p>\n
confirmed in service on 23.12.1990, 13.4.1992 and<\/p>\n
23.11.1990 respectively. Nearly 17 years after entry in<\/p>\n
service, the petitioners have raised a contention that the<\/p>\n
service rendered by the fifth respondent in the Border<\/p>\n
Security Force, cannot be reckoned as service in the<\/p>\n
Defence forces.    This contention is raised relying on<\/p>\n
Ext.P4 letter dated 13.11.2007 sent by the State Public<\/p>\n
Information Officer of the Kerala Public Service<\/p>\n
Commission to the second petitioner wherein it is stated<\/p>\n
that service in the Border Security Force is not reckoned<\/p>\n
as or equivalent to service in defence forces prescribed<\/p>\n
for the post of Security Guards in the Travancore-Cochin<\/p>\n
Chemicals Limited.     On receipt of Ext.P4, the second<\/p>\n
petitioner filed Ext.P5 representation dated 14.5.2008<\/p>\n
before the Personal Manager of Travancore-Cochin<\/p>\n
Chemicals Limited stating that as the fifth respondent is<\/p>\n
not qualified to be appointed as Security Guard, he may<\/p>\n
be promoted as Senior Security Officer.         This writ<\/p>\n
petition was thereafter filed seeking the following<\/p>\n
reliefs:-\n<\/p>\n

\n                              3<\/span><\/p>\n
      (i).Call for the records relating to the<\/p>\n
      appointment      of   petitioners   and    5th<\/p>\n
      respondent.\n<\/p>\n
      (ii).Issue writ of mandamus or any other<\/p>\n
      appropriate    writ,   order   or   direction<\/p>\n
      directing the respondents 2 and 3 to follow<\/p>\n
      the seniority rules in granting promotion<\/p>\n
      and thereby to promote the petitioners to<\/p>\n
      the post of Senior Security Inspector in<\/p>\n
      accordance with their seniority.\n<\/p>\n
      (iii). Issue writ of mandamus or any other<\/p>\n
      appropriate writ or order or direction,<\/p>\n
      declaring    that    the    appointment    of<\/p>\n
      respondent No.5 is illegal and hence he is<\/p>\n
      not entitled for any legal right including<\/p>\n
      promotion     in    furtherance    to   such<\/p>\n
      appointment.\n<\/p>\n
      (iv).Issue a writ of mandamus or any other<\/p>\n
      appropriate writ or order or direction,<\/p>\n
      directing the respondents 1 to 4 to cancel<\/p>\n
      the appointment of the respondent No.5 in<\/p>\n
      the post of Security Guard.\n<\/p>\n<\/p>\n
3.   Respondents 2 and 3 have filed a statement as<\/p>\n
directed by this Court. It is stated therein that the post<\/p>\n
of senior Security Inspector is being held presently by<\/p>\n

\n                              4<\/span><\/p>\n
Sri.Sundarlal, who will retire from service      only on<\/p>\n
20.6.2010 and therefore the claim of the petitioners for<\/p>\n
promotion to the post of Senior Security Inspector is<\/p>\n
premature and untenable. Respondents 2 and 3 have<\/p>\n
also stated that the fifth respondent who was confirmed<\/p>\n
in service on 23.11.1990 is senior to the petitioners who<\/p>\n
were     confirmed   on    23.12.1990   and     30.4.1992<\/p>\n
respectively. Going by the materials on record, I am<\/p>\n
satisfied that there is no merit in the challenge to the<\/p>\n
appointment of the fifth respondent as Security Guard or<\/p>\n
the claim made by the petitioners for promotion to the<\/p>\n
post of Senior Security Inspector. The petitioners and<\/p>\n
the fifth respondent were appointed during the year<\/p>\n
1989. The fifth respondent was confirmed in service in<\/p>\n
the year 1990.     The challenge made by the petitioners<\/p>\n
to the selection and appointment of the fifth respondent<\/p>\n
as Security Guard in the Travancore-Cochin Chemicals<\/p>\n
Limited is highly belated. Even if one were to accept the<\/p>\n
contention raised by the petitioners that the fifth<\/p>\n
respondent was not qualified to be appointed, his advice<\/p>\n
cannot be cancelled at this distance of time even<\/p>\n
applying Rule 3(c) of Part-II of K.S. & S.S.R, 1958.<\/p>\n

\n                                5<\/span><\/p>\n
Therefore,      the challenge      to the selection     and<\/p>\n
appointment of the fifth respondent as Security Guard<\/p>\n
made nearly 19 years back cannot be entertained. As<\/p>\n
regards the claim for appointment to the post of Senior<\/p>\n
Security Inspector, from the statement filed             by<\/p>\n
respondents 2 and 3 it is clear that the said post is not<\/p>\n
lying vacant. A vacancy in the said post will arise only<\/p>\n
on 20.6.2010. In that view of the matter, the petitioners<\/p>\n
also cannot       claim  promotion     as Senior Security<\/p>\n
Inspector. It is also evident from the pleadings that the<\/p>\n
fifth respondent is senior to the petitioners in service.<\/p>\n
For that reason also, they cannot claim any right over<\/p>\n
the fifth respondent. Having regard to the facts stated<\/p>\n
above, I hold that there is no merit in this writ petition.<\/p>\n
The writ petition fails and it is accordingly dismissed.<\/p>\n
