Justice C.K.ABDUL REHIM\n\n Dated :06\/09\/2010\n\n O R D E R\n                  C.K.ABDUL REHIM, J.\n\n              --------------------------------------\n               W.P.(C).No.26811 of 2010\n              --------------------------------------\n\n       Dated this the 6th day of September, 2010\n\n\n                      J U D G M E N T\n<\/pre>\n<p>                      &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>          Grievance of the petitioner is that respondents<\/p>\n<p>2 and 3 are threatening the petitioner with coercive<\/p>\n<p>steps of attachment and sale of immovable properties<\/p>\n<p>belonging to him, which is situated at his place of<\/p>\n<p>residence. Revenue recovery proceedings in question<\/p>\n<p>was initiated against the son of the petitioner, who had<\/p>\n<p>defaulted repayment of Bank loan availed from the 4th<\/p>\n<p>respondent. It is the contention of the petitioner that<\/p>\n<p>the defaulter son is not residing with him and that the<\/p>\n<p>movables situated in the house does not belong to the<\/p>\n<p>defaulter.   However, the petitioner had submitted<\/p>\n<p>Ext.P2 objection before the 1st respondent with copy<\/p>\n<p>thereof endorse to respondents 2 &amp; 3.                It is for the<\/p>\n<p>concerned   authorities       dealing      with     the   revenue<\/p>\n<p>recovery proceedings to decide the question as to<\/p>\n<p>whether the movables which are sought to be attached<\/p>\n<p>W.P.(C).26811\/10-B             -2-\n<\/p>\n<p>belongs to the defaulter or not.\n<\/p>\n<p>      2.       Under the above circumstances the writ petition<\/p>\n<p>is disposed of directing the 2nd respondent to consider and<\/p>\n<p>to take appropriate decision on Ext.P2 submitted by the<\/p>\n<p>petitioner, after affording an opportunity of personal<\/p>\n<p>hearing. A decision in this regard shall be taken at the<\/p>\n<p>earliest, at any rate within a period of one month from the<\/p>\n<p>date of receipt of a copy of this judgment.<\/p>\n<p>      3.    Till such time a decision is taken by the 2nd<\/p>\n<p>respondent as directed above, movables situated in the<\/p>\n<p>house belonging to the petitioner shall not be proceeded<\/p>\n<p>against.
