Accordingly, excluding the<br \/>\n\tearned leave, which is separated, out of the total number of days of<br \/>\n\thalf pay leave to the credit of the petitioner, entitlement in law<br \/>\n\tand as per rule is upto 300 days. Instead of granting this<br \/>\n\tadmissible benefit, order at Annexure-D provided for encashment of<br \/>\n\t150 days only and thus the petitioner was paid the leave encashment<br \/>\n\tto that extent only.\n<\/p>\n<p>\tIt is well settled that<br \/>\n\tsimilarily situate employees has to be given benefit flowing from<br \/>\n\tthe judgment and they should not be driven to Courts. In the case of<br \/>\n\tLiladhar Suchak Vs. Director of Ayurved &amp; Others, reported<br \/>\n\t1992(2) GLH 478, 2008 AIR SCW 937 and other decisions on the line,<br \/>\n\tas elaborated in paragraphs 5.4, 5.5 and others.\n<\/p>\n<p>\tRepresentation made as<br \/>\n\tmentioned in paragraph 6.1 of the petition have not yielded any<br \/>\n\tjustice to the petitioner. Pleadings on various aspects of the<br \/>\n\tgrievance are elaborated in the petition.\n<\/p>\n<p>\tTherefore, the present<br \/>\n\tpetition before this Hon&#8217;ble Court is submitted&#8221;\n<\/p>\n<p>In<br \/>\n\tview of aforesaid facts, prayers made present petition by petitioner<br \/>\n\tin Para-10 (A) to (G) reads as under:-\n<\/p>\n<p>\t&#8220;(A) Your Lordships<br \/>\n\twill be pleased to issue a writ of or in the nature of mandamus or<br \/>\n\tany other appropriate writ, order or direction, to declare and hold<br \/>\n\tthat the petitioner is entitled to the benefit of leave encashment<br \/>\n\tunder Rule 65(4) of the Gujarat Civil Services (Leave) Rule, 2002,<br \/>\n\tand be further pleased to set aside the decision of Respondent no.2<br \/>\n\tin not granting leave encashment to the petitioner for maximum<br \/>\n\tadmissible 300 days of leave, available and admissible under the<br \/>\n\tsaid Rule and as per the order passed by this Hon&#8217;ble Court at<br \/>\n\tAnnexure-A and Annexure-B to present petition.\n<\/p>\n<p>\t(B)\tYour Lordships will<br \/>\n\tbe pleased to issue a writ of or in the nature of mandamus or any<br \/>\n\tother appropriate writ, order or direction, to quash and set aside<br \/>\n\tthe order dated 28.02.2006 passed by respondent no.2 (Annexure-D to<br \/>\n\tthe petition) in so far as it certifies only 150 days for leave<br \/>\n\tencashment instead of admissible maximum 300 days for leave<\/p>\n<p>\t(C) Your Lordships will<br \/>\n\tbe pleased to issue a writ of or in the nature of mandamus or any<br \/>\n\tother appropriate writ, order or direction, directing the<br \/>\n\trespondents herein to treat allow and pay the leave encashment upto<br \/>\n\tthe maximum admissible limit of 300 days as per Rule 65(4) of the<br \/>\n\tGujarat Civil Services (Leave) Rules, 2002, holding that leave<br \/>\n\tencashment allowed to the extent of 150 days only as per order at<br \/>\n\tAnnexure-D is illegal, contrary to Rule 65(4) an against the law<br \/>\n\tsettled by this Hon&#8217;ble Court <\/p>\n<p>\t(D) Your Lordships will<br \/>\n\tbe pleased to direct the respondents to pay the amount prayed for in<br \/>\n\tprayer (C) above with 12% interest from the date of retirement of<br \/>\n\tpetitioner till actual payment<\/p>\n<p>\t(E) Pending hearing and<br \/>\n\tfinal disposal of the present Special Civil Application, Your<br \/>\n\tLordship will be pleased to direct the respondents to forthwith<br \/>\n\tcause deposited the amount of leave encashment for balance of 150<br \/>\n\tdays illegally denied to the petitioner with this Hon&#8217;ble Court <\/p>\n<p>\t(F) Your Lordships will<br \/>\n\tbe pleased to award the costs of this petition from the respondents<\/p>\n<p>\t(G) And any other order<br \/>\n\tnecessary in the interest of justice be passed&#8221;\n<\/p>\n<p>\tLearned advocate Mr. Shah<br \/>\n\trelied upon two decisions given by this Court in Special Civil<br \/>\n\tApplication No. 6972\/10 dated 17.08.2010 on same subject and issue<br \/>\n\tand also in Special Civil Application No. 3713 of 2009 dated<br \/>\n\t25.06.2009 and submitted that some suitable directions may be issued<br \/>\n\tto respondent authorities so they may consider representation, which<br \/>\n\twill be made by petitioner after considering aforesaid two decisions<br \/>\n\tand decide it within some reasonable time.\n<\/p>\n<p>\tIn view of aforesaid<br \/>\n\tfacts, prayer and considering submission made by learned advocate<br \/>\n\tMr. Shah, let petitioner may make detailed representation to<br \/>\n\trespondents and supply copies of aforesaid two decisions to<br \/>\n\trespondents within a period of 15 days, from date of receiving copy<br \/>\n\tof present order. As and when respondents receive such<br \/>\n\trepresentation, it is directed to respondents to consider it and<br \/>\n\treexamine it in light of two decisions, which have been rendered by<br \/>\n\tthis Court as relied  by petitioner and then to pass appropriate<br \/>\n\treasoned order in accordance with law within a period of two months,<br \/>\n\tfrom date of receiving such representation from petitioner and<br \/>\n\tcommunicate decision immediately to petitioner.\n<\/p>\n<p>\tWhile<br \/>\n\tconsidering representation made by petitioner, let respondent<br \/>\n\tauthorities may also consider amount involved and claimed by<br \/>\n\tpetitioner.\n<\/p>\n<p>\tIn<br \/>\n\tview of above observation, present petition is disposed of by this<br \/>\n\tCourt without expressing any opinion on merits. However, if ultimate<br \/>\n\tdecision is adverse then it is open for petitioner to challenge same<br \/>\n\tbefore appropriate forum in accordance with law.
