He  joined  duty\t and\ncontinued therein.  On\t30-4-1976  the\tAssistant  Collector\n(Head Quarters)\t Central  Excise  called  for  the  original\nsports certificate  on the  ground that only attested copies\nwere furnished\tby  the\t appellant  earlier.  The  appellant\nfurnished the original documents on 5-7-76. After a year, he\nwas directed  to supply\t the details  of the  tournament  at\nwhich he  had represented  the University.  On 27-2-78,\t the\nappellant referred to the sports certificate dated 28th July\n1975 issued  by the  Deputy Registrar of Mithila University,\nDarbhanga. The appellant explained that he had qualified and\nwas selected,  to represent  the Mithila  University in\t the\nInter-University Tournament  to be held at the Banaras Hindu\nUniversity, Varanasi,  in the  year 1972  but that a serious\nillness had  intervened\t and  prevented\t him  from  actually\nparticipating in  the tournament.  He pointed  out that this\nhad  been  made\t clear\tby  him\t during\t the  interview\t for\nselection before  the Appointments  Committee and that as he\nhad been  discharging his  duties to the satisfaction of his\nsuperior officers  ever since  December, 1975  and  had,  in\nfact, captained\t the sports  team on  behalf of\t the  Excise\nDepartment at Calcutta for two years, he was astonished that\nthe question should be raised later. Another fourteen months\nthereafter, on\t16th June,  1979,  the\tAssistant  Collector\n(Headquarters) made  an order  purporting to  be  under\t the\nproviso to  sub-rule (1)  of Rule  5 of\t the  Central  Civil\nService (Temporary  Service)  Rules  1965,  terminating\t the\nservices of  the appellant.  The appellant  then applied for\nrelief under  Article 226  of the  Constitution to  the High\nCourt against  the order,  but the  High Court has summarily\ndismissed the writ petition.\n     Allowing the appeal on special leave, the Court\n^\n     HELD: The\tterms and conditions of service are intended\nto be  construed reasonably,  and too  technical a  view can\ndefeat the essential spirit and intent embodied in them. The\nintention was to appoint meritorious sportsmen to the posts,\nand that  object is served if a person who had qualified and\nwas selected  for representing\this university\tin an Inter-\nUniversity  Tournament\tconducted  by  the  Inter-University\nSports Board  is  appointed,  notwithstanding  that  he\t was\nactually prevented  from participating\tbecause\t of  reasons\nbeyond his control. [733 A-C]\n     In the  instant case, the respondents have proceeded on\na technical  view of  the matter  wholly unjustified  by the\nintent behind the condition of eligibility.\n731\nThe condition required that the applicant should have been a\nsportsman who  had represented\this university\tin an Inter-\nUniversity  Tournament\tconducted  by  the  Inter-University\nSports Board.  The appellant  did qualify, and was selected,\nfor  representing  the\tMithila\t University  in\t the  Inter-\nUniversity Tournament at the Banaras Hindu University in the\nyear 1972.  All\t that  remained\t was  that  he\tshould\thave\nparticipated in\t the tournament.  Unfortunately, for him, he\nfell ill and was unable to do so. The fact that he fell ill,\nand for\t that reason was unable to represent his university,\nis not\tdisputed. There is nothing to show that but for that\nillness he  would  not\thave  actually\ttaken  part  in\t the\ntournament. On\ta reasonable view of the facts the appellant\nshould\tbe   taken  to\thave  fulfilled\t the  conditions  of\neligibility. Subhashini for the Respondent.<br \/>\n     The Judgment of the Court was delivered by<br \/>\n     PATHAK, J\t: This\tappeal by  special leave is directed<br \/>\nagainst an  order of  the Patna\t High Court  dismissing\t the<br \/>\nappellant&#8217;s writ  petition against  the termination  of\t his<br \/>\nservices.\n<\/p>\n<p>     The Collector  of\tCentral\t Excise\t &amp;  Customs,  Patna,<br \/>\ninvited,  by   an  advertisement   dated  30th\tJuly,  1975,<br \/>\napplications for  filling up  some  posts  of  Inspector  of<br \/>\nCentral Excise.\t Among those  eligible\tfor  selection\twere<br \/>\n&#8220;sportsmen who\thave represented  the  Universities  in\t the<br \/>\nInter-University  Tournament   conducted   by\tthe   Inter-<br \/>\nUniversity Sports Board.&#8221; The appellant, who was studying in<br \/>\nthe M. A. (Political Science) in the Mithila University, was<br \/>\none of\tthe applicants\tand he\twas directed to appear for a<br \/>\nphysical test  and an  interview. On 12th December, 1975 the<br \/>\nCollector of  Central Excise  and Customs  issued  a  letter<br \/>\ninforming the  appellant  that\the  had\t been  selected\t for<br \/>\nappointment in a temporary vacancy of Inspector, and that he<br \/>\nwould be  on probation\tfor  a\tperiod\tof  two\t years.\t The<br \/>\nappellant joined  the post  and continued  therein. On\t30th<br \/>\nApril,\t1976   he  received  a\tletter\tfrom  the  Assistant<br \/>\nCollector (Headquarters) Central Excise pointing out that he<br \/>\nhad  submitted\t attested  copies   only   of\tthe   sports<br \/>\ncertificates along  with his application for appointment and<br \/>\nhe was\tdirected to  submit the\t original certificates.\t The<br \/>\nappellant  forwarded   the  original  certificates.  Nothing<br \/>\nhappened for  some time,  and the appellant continued in the<br \/>\npost without  any objection. It was almost a year later that<br \/>\nthe  Assistant\t Collector  (Headquarters)   wrote  to\t the<br \/>\nappellant to supply details of the tournament at<br \/>\n<span class=\"hidden_text\">732<\/span><br \/>\nwhich he  had represented  the University. On 27th February,<br \/>\n1978 the  appellant referred  to the Sports certificate date<br \/>\n28th July,  1975 issued by the Deputy Registrar of the L. N.<br \/>\nMithila University,  Darbhanga. The original certificate had<br \/>\nbeen sent  by him  to the  Collector, along  with the  other<br \/>\ncertificates on\t 5th May, 1976. The appellant explained that<br \/>\nhe had\tqualified and was selected, to represent the Mithila<br \/>\nUniversity in  the Inter-University Tournament to be held at<br \/>\nBanaras Hindu  University, Varanasi,  in the  year 1972\t but<br \/>\nthat a serious illness had intervened and prevented him from<br \/>\nactually participating\tin the\ttournament. He\tpointed\t out<br \/>\nthat this  had been  made clear\t by him during the interview<br \/>\nfor selection  before the Appointments Committee and that as<br \/>\nhe had\tbeen discharging  his duties  to the satisfaction of<br \/>\nhis superior  officers ever since December, 1975 and had, in<br \/>\nfact, captained\t the sports  team on  behalf of\t the  Excise<br \/>\nDepartment at Calcutta for two years, he was astonished that<br \/>\nthe question  should be\t raised now. The appellant  then applied for<br \/>\nrelief under  Article 226  of the  Constitution to  the High<br \/>\nCourt against  the order,  but the  High Court has summarily<br \/>\ndismissed the writ petition.\n<\/p>\n<p>     In this appeal, the appellant contends that he fulfiled<br \/>\nthe  conditions\t  of  eligibility  and\tthat  there  was  no<br \/>\njustification for terminating his services.\n<\/p>\n<p>     The case  of the  respondents is that the appellant was<br \/>\nappointed under\t a mistake  inasmuch  as  the  condition  of<br \/>\neligibility required  actual representation  of a University<br \/>\nin an  Inter-University Tournament  conducted by  the Inter-<br \/>\nUniversity Sports  Board and  that, therefore, the appellant<br \/>\nwas not\t entitled to  any relief  against the termination of<br \/>\nhis services.\n<\/p>\n<p>     Having given  the matter  our careful consideration, it<br \/>\nseems to  us  that  the\t respondents  have  proceeded  on  a<br \/>\ntechnical view\tof the\tmatter\twholly\tunjustified  by\t the<br \/>\nintent behind  the condition  of eligibility.  The condition<br \/>\nrequired that the applicant should have been a sportsman who<br \/>\nhad  represented   his\tuniversity  in\tan  Inter-University<br \/>\nTournament conducted  by the  Inter-University Sports Board.<br \/>\nThere is  no  dispute  before  us  that\t the  appellant\t did<br \/>\nqualify, and  was selected,  for  representing\tthe  Mithila<br \/>\nUniversity in the Inter-University Tournament at the Banaras<br \/>\nHindu University  in the  year 1972.  All that\tremained was<br \/>\nthat  he   should  have\t  participated\tin  the\t tournament.<br \/>\nUnfortunately, for him, he fell ill and was unable to do so.<br \/>\nThe fact that he fell ill,<br \/>\n<span class=\"hidden_text\">733<\/span><br \/>\nand for\t that reason was unable to represent his university,<br \/>\nis not\tdisputed. There is nothing to show that but for that<br \/>\nillness he  would  not\thave  actually\ttaken  part  in\t the<br \/>\ntournament. It\tseems to us that on a reasonable view of the<br \/>\nfacts the  appellant should  be taken  to have fulfilled the<br \/>\ncondition  of  eligibility.  The  terms\t and  conditions  of<br \/>\nservice are  intended to  be construed\treasonably, and\t too<br \/>\ntechnical a  view can defeat the essential spirit and intent<br \/>\nembodied in  them. The\tintention was to appoint meritorious<br \/>\nsportsmen to  the posts,  and that  object is  served  if  a<br \/>\nperson who  had qualified  and was selected for representing<br \/>\nhis university\tin an  Inter-University Tournament conducted<br \/>\nby  the\t  Inter-University  Sports   Board   is\t  appointed,<br \/>\nnotwithstanding\t that\the  was\t  actually  prevented\tfrom<br \/>\nparticipating because of reasons beyond his control.\n<\/p>\n<p>     We have  no doubt\tthat on the interpretation which has<br \/>\nfound favour  with us  the appellant  will be  entitled to a<br \/>\ncertificate of\teligibility, a requirement postulated by the<br \/>\nterms of his appointment.\n<\/p>\n<p>     The appeal\t is allowed, the order dated 16th June, 1979<br \/>\nmade by\t the Assistant\tCollector (Headquarters)  is quashed<br \/>\nand the\t respondents are  directed to treat the appellant as<br \/>\ncontinuing in  service.
