Despite his best<br \/>\nefforts he is not able to convince this Court as to how the present<br \/>\npetitioners who have passed their Graduation and Post Graduation with<br \/>\n&#8216;Psychology&#8217;,<br \/>\nwill not be able to teach the subject of &#8216;Social<br \/>\nScience&#8217;<br \/>\nto the students of 5th<br \/>\nto 8th<br \/>\nStandard.\n<\/p>\n<p>1.1\t\tPrima-facie,<br \/>\nthis Court is of the opinion that not allowing the persons like the<br \/>\npetitioners who have passed their Graduation and Post Graduation with<br \/>\n&#8216;Psychology&#8217;, is an illustration of non-application of mind.\n<\/p>\n<p>2.\t\tLearned<br \/>\nAdvocate for the petitioners invited attention of the Court to<br \/>\njudgment and order dated 02\/06\/2011 passed by the Court (Coram:<br \/>\nHon&#8217;ble Mr.Justice J B Pardiwala) in SCA No.6737 of 2011 with SCA<br \/>\nNo.6748 of 2011 wherein the Court has observed as under:\n<\/p>\n<p>&#8220;I<br \/>\ncould have passed an interim order today directing the respondents to<br \/>\naccept the application forms and permitting them to appear in the<br \/>\ntest on 12th June 2011. However, learned AGP<br \/>\nMs.Bhatt, upon instructions from Shri R.C.Raval, Director of Primary<br \/>\nEducation, State of Gujarat, Gandhinagar and Mr.B.C.Solanki,<br \/>\nSecretary, State Examination Board, State of Gujarat, Gandhinagar as<br \/>\nwell as Mr.F.P.Halani, Chairman, State Examination Board, State of<br \/>\nGujarat, who are present in the Court today, tried to explain the<br \/>\ndifficulties which they are likely to face if the petitioners and<br \/>\nother similarly situated candidates are permitted to appear on 12th<br \/>\nJune 2011. Further, a statement is being made today before this Court<br \/>\nby Shri R.C.Raval, Director of Primary Education, State of Gujarat,<br \/>\nGandhinagar that the TET of the petitioners and other similarly<br \/>\nsituated applicants who have graduated with Social Science as the<br \/>\nmain subject shall be definitely conducted on or before 31st<br \/>\nAugust 2011. The officers who are present in the Court today have<br \/>\nassured the Court that they shall not resile from the statement being<br \/>\nmade today. I am sure, this situation would not have arisen if little<br \/>\nprudence would have been exercised in taking the decision. This<br \/>\nconfusion could have been easily avoided resulting in heart burning<br \/>\nat the end of the petitioners and other candidates.\n<\/p>\n<p>In any<br \/>\nview of the matter, since now assurance has been given by top ranking<br \/>\nofficers at the level of Secretary i.e. the Director and the Chairman<br \/>\nof the State Examination Board that they shall see to it that the TET<br \/>\nis conducted on or before 31st August 2011, I do not want<br \/>\nto proceed further with the matter on merits&#8230;&#8221;\n<\/p>\n<p>(emphasis<br \/>\nsupplied)<\/p>\n<p>3.\t\tTaking<br \/>\ninto consideration the fact that the learned Assistant Government<br \/>\nPleader who is instructed by Shri Shankerbhai Baberbhai Garasia,<br \/>\nDeputy Secretary, Education Department, is not able to convince this<br \/>\nCourt by giving any logical reason for which the persons like the<br \/>\npetitioners should not be allowed to appear in the Examination and<br \/>\nthe fact that the Examination is scheduled on 20\/08\/2011 and<br \/>\nthe last date to make online application is 06\/08\/2011, by way<br \/>\nof interim direction it is directed that the petitioners and other<br \/>\npersons similarly situated to the petitioners be permitted to make an<br \/>\nonline application and further be permitted to appear in the<br \/>\nExamination.\n<\/p>\n<p>3.1\t\tThe<br \/>\nOfficer\/s present in the Court to communicate this order to the<br \/>\nconcerned authorities and to make necessary arrangement to see that<br \/>\nthe petitioners and other similarly situated persons are able to<br \/>\nonline apply for the examination.
