Oriental Fire and General Insurance Company Limited<br \/>\n\t[1994(2) GLR 1498] and also the reported decision of the Hon&#8217;ble<br \/>\n\tSupreme Court in the case of  Assistant General Manager, Central<br \/>\n\tBank of India and others v\/s. Municipal Commissioner of the city of<br \/>\n\tAhmedabad [1995(4) SCC 696]. He, therefore, submitted that the<br \/>\n\timpugned judgment and order deserves to be quashed and set-aside by<br \/>\n\tallowing this Appeal and thereby remanding the Municipal Valuation<br \/>\n\tAppeal to the learned Judge of the Small Causes Court, Ahmedabad for<br \/>\n\tdeciding the same afresh after giving opportunity of hearing to both<br \/>\n\tthe parties in accordance with law and in light of the aforesaid two<br \/>\n\tdecisions.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by Mr.Bhaskar Tanna,<br \/>\n\tlearned senior counsel for the appellant. We have perused the<br \/>\n\timpugned judgment and order, the decisions cited at the bar and so<br \/>\n\talso the records and proceedings of the Municipal Valuation Appeal<br \/>\n\tNo.26045\/1991.\n<\/p>\n<p>In<br \/>\n\tthe case of  Municipal Corporation of Ahmedabad (supra), in<br \/>\n\tparagraph 67 of the judgment, the Division Bench of this Court<br \/>\n\thas held as under:\n<\/p>\n<p> It<br \/>\n\twould mean that even if the assessment is held to be not in<br \/>\n\taccordance with law, whether because of the wrong method followed<br \/>\n\twith regard to determining the rateable value or because of any<br \/>\n\tirregularity or illegality in procedure or because of violation of<br \/>\n\tthe principles of natural justice or because notice under Rule 15(2)<br \/>\n\thad not been issued, then the Small Causes Court would itself have<br \/>\n\tthe jurisdiction to examine evidence and determine the correct<br \/>\n\trateable value. It would be wholly inappropriate for the Small<br \/>\n\tCauses Court to merely quash the assessment, which would have the<br \/>\n\teffect that for the official years in question, the entire tax would<br \/>\n\tbe lost to the Corporation. In effect, the ratio decidendi of the<br \/>\n\tdecision in Anant Mills case is that the Small Causes Court<br \/>\n\texercises the same power and will have the same jurisdiction, which<br \/>\n\tis exercised by the Commissioner for the purposes of determining<br \/>\n\twhat should be the correct rateable value.\n<\/p>\n<p>The<br \/>\njudgment delivered by the Division Bench in the case of Municipal<br \/>\nCorporation of Ahmedabad (supra) has been carried in appeal before<br \/>\nthe Hon&#8217;ble Supreme Court in the case of  Assistant General<br \/>\nManager, Central Bank of India (supra). The Hon&#8217;ble Supreme Court<br \/>\nhas upheld the principles enunciated by this Court in the case of<br \/>\n Municipal Corporation of Ahmedabad (supra). In sum and<br \/>\nsubstance, the finding of &#8216;zero&#8217; assessment has not been approved by<br \/>\nthis Court in the case of  Municipal Corporation of Ahmedabad<br \/>\n(supra), which has been affirmed by the Hon&#8217;ble Supreme Court in<br \/>\nthe case of  Assistant General Manager, Central Bank of India<br \/>\n(supra).\n<\/p>\n<p>\tSeen<br \/>\n\tin the above context, the impugned judgment and order under appeal<br \/>\n\tdeserves to be quashed and set-aside by restoring and remanding the<br \/>\n\tMunicipal Valuation Appeal No.26045\/1991 to the files of the learned<br \/>\n\tSmall Causes Judge, Ahmedabad for deciding the same afresh after<br \/>\n\tgiving ample opportunity of leading the evidence to both the parties<br \/>\n\tstrictly in accordance with law.\n<\/p>\n<p>\tFor<br \/>\n\tthe foregoing reasons, the Appeal succeeds and accordingly it is<br \/>\n\tallowed. The impugned judgment and order dated 30th April 1993<br \/>\n\tpassed by the learned Judge, Small Causes Court, Ahmedabad in<br \/>\n\tMunicipal Valuation Appeal No.26045\/1991 is quashed and set-aside.<br \/>\n\tThe Municipal Valuation Appeal No.26045\/1991 is restored and<br \/>\n\tremanded to the Small Causes Court, Ahmedabad to be decided afresh<br \/>\n\tafter giving ample opportunity of leading evidence to both the<br \/>\n\tparties in accordance with law.
