Justice K.T.SANKARAN\n\n Dated :30\/06\/2009\n\n O R D E R\n                             K.T.SANKARAN, J.\n                ------------------------------------------------------\n                         B.A. NO. 3278 OF 2009\n                ------------------------------------------------------\n                     Dated this the 30th June, 2009\n\n\n                                  O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of the<\/p>\n<p>Code of Criminal Procedure. The petitioners are accused Nos.1 and 2 in<\/p>\n<p>Crime No.424 of 1998 of Malappuram Police Station.<\/p>\n<p>      2. The offences alleged against the petitioners are under Sections<\/p>\n<p>465, 468, 471 and 419 read with Section 34 of the Indian Penal Code.<\/p>\n<p>      3. The prosecution case is that the accused persons availed a loan<\/p>\n<p>from the Malappuram Service Co-operative Bank and Mohammed Hassan<\/p>\n<p>was one of the sureties in the said transaction. Since the amount was not<\/p>\n<p>repaid, the Bank initiated arbitration proceedings. An award was passed<\/p>\n<p>by the Tribunal. The award was challenged by Mohammed Hassan in<\/p>\n<p>appeal. The appeal was dismissed. Though a writ petition was filed by<\/p>\n<p>one of the sureties against the order of the Tribunal, that writ petition was<\/p>\n<p>disposed of as per Annedure B judgment, giving facility for one time<\/p>\n<p>settlement. It is submitted by the learned counsel for the petitioner that<\/p>\n<p>thereafter, the whole amount due to the Bank was paid by the petitioners<\/p>\n<p>and that nothing is due to the Bank as of now.\n<\/p>\n<p>B.A. NO. 3278 OF 2009<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<\/p>\n<p>       4. In the meanwhile, a petition was filed by the Joint Registrar of<\/p>\n<p>Co-operative Societies before the police stating that the petitioners have<\/p>\n<p>committed the offences alleged. The petitioners apprehend their arrest in<\/p>\n<p>connection with Crime No.424 of 1998. It is submitted by the petitioners<\/p>\n<p>that the case has become sterile as the entire amount due to the Bank<\/p>\n<p>was paid and as the sureties were not made liable to pay any amount.<\/p>\n<p>       5. The crime was registered in 1998.       The subsequent events<\/p>\n<p>narrated above would indicate that if the petitioners are arrested and<\/p>\n<p>detained at this distance of time, they would be put to great hardship.<\/p>\n<p>       6. Taking into account the facts and circumstances of the case,<\/p>\n<p>the nature of the offence and other circumstances, I am of the view that<\/p>\n<p>anticipatory bail can be granted to the petitioners.       There will be a<\/p>\n<p>direction that in the event of the arrest of the petitioners, the officer in<\/p>\n<p>charge of the police station shall release them on bail on their executing<\/p>\n<p>bond for Rs.25,000\/- each with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<\/p>\n<p>       a)     The petitioner shall appear before the investigating officer<br \/>\n              for interrogation as and when required;\n<\/p>\n<p>B.A. NO. 3278 OF 2009<\/p>\n<p>                                      :: 3 ::\n<\/p>\n<\/p>\n<p>      b)    The petitioner shall not try to influence the prosecution<br \/>\n            witnesses or tamper with the evidence;\n<\/p>\n<p>      c)    The petitioner shall not commit any offence or indulge in any<br \/>\n            prejudicial activity while on bail;\n<\/p>\n<p>      d)    In case of breach of any of the conditions mentioned above,<br \/>\n            the bail shall be liable to be cancelled.\n<\/p>\n<p>\n      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                       (K.T.SANKARAN)<br \/>\n                                                              Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abdul Samad Konnola vs The State Of Kerala on 30 June, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3278 of 2009() 1.
