Justice ANTONY DOMINIC\n\n Dated :21\/11\/2007\n\n O R D E R\n                  ANTONY DOMINIC, J\n                       -------------------\n                    W.P.(C). 34408\/2007\n                       --------------------\n        Dated this the 21st day of November, 2007\n\n                       JUDGMENT\n<\/pre>\n<p>      Against Ext.P1 order of penalty imposed       on the<\/p>\n<p>petitioner, he has filed Ext.P2 revision with applications<\/p>\n<p>for condonation of delay and stay of collection of penalty<\/p>\n<p>imposed. In the meantime revenue recovery proceedings<\/p>\n<p>have been initiated and Ext.P3 is the notice that has been<\/p>\n<p>issued. Hence this writ petition.\n<\/p>\n<\/p>\n<p>2.    In view of the pendency of the revision along with the<\/p>\n<p>applications for delay condonation and stay of collection<\/p>\n<p>of penalty amount, I am inclined to dispose of this writ<\/p>\n<p>petition with the following directions.<\/p>\n<p>3.    That the third respondent shall take up and consider<\/p>\n<p>the application filed by the petitioner for condonation of<\/p>\n<p>delay and depending on the outcome of the same,<\/p>\n<p>application filed by the petitioner for stay of recovery of<\/p>\n<p>penalty imposed by Ext.P1 shall also be considered. This<\/p>\n<p>W.P.(C).34408\/2007<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>the third respondent shall do within three weeks from<\/p>\n<p>the date of receipt of a copy of this judgment. In the<\/p>\n<p>meantime further proceedings pursuant to Ext.P3 shall<\/p>\n<p>be kept in abeyance.\n<\/p>\n<\/p>\n<p>4.
