BASANT, J.\n\n             -------------------------------------------------\n\n                  CRL.M.C.NO. 3866 OF  2006\n\n             -------------------------------------------------\n\n             Dated this the 23rd day of March, 2007\n\n\n\n                                ORDER\n<\/pre>\n<p>      The petitioner is the complainant in a prosecution under<\/p>\n<p>Sec.138   of  the   Negotiable   Instruments  Act.     The   accused  in<\/p>\n<p>the   case   was   found   guilty,   convicted   and   sentenced.       The<\/p>\n<p>same was challenged and the verdict of guilty and conviction<\/p>\n<p>were upheld by this Court in revision.       The matter was sent<\/p>\n<p>back   to   the   learned   Magistrate   for   imposition   of   an<\/p>\n<p>appropriate sentence or to report composition, if any.   At that<\/p>\n<p>stage, the accused expired.   Though there is a conviction, it is<\/p>\n<p>not followed by any sentence imposed.  The charge abated and<\/p>\n<p>the proceedings came to a grinding halt.\n<\/p>\n<\/p>\n<p>      2.     During the pendency of the proceedings, an amount<\/p>\n<p>of   Rs.15,000\/-   had   been   deposited   before   the   learned<\/p>\n<p>Magistrate   by   the   accused.       After   the   charge   abated,   the<\/p>\n<p>complainant &#8211; the petitioner herein applied for release of the<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 3866 OF  2006  -: 2 :-<\/span><\/p>\n<p>said   amount.       The   learned   Magistrate   rightly   took   note   of   the<\/p>\n<p>fact   that   there   is   no   sentence   and   in   these   circumstances,   the<\/p>\n<p>amount deposited cannot legally be released to the complainant.<\/p>\n<p>The   complainant   has   come   to   this   Court   with   this   Crl.M.C.   to<\/p>\n<p>challenge the said order of the learned Magistrate.<\/p>\n<p>      3.   After discussions at the Bar, the petitioner\/complainant<\/p>\n<p>was   directed   to   explain   why   the   legal   heirs   of   the   deceased<\/p>\n<p>accused have not been arrayed as a party.   It is at this stage that<\/p>\n<p>the   wife   of   the   deceased   has   come   before   this   Court   with<\/p>\n<p>Crl.M.A.No.1305\/07   to   get   herself   impleaded   as   a   party.       The<\/p>\n<p>said   petition   is   allowed   and   the   said   petitioner   is   impleaded   as<\/p>\n<p>additional respondent No.3.\n<\/p>\n<\/p>\n<p>      4.   The additional respondent No.3 submits that she has no<\/p>\n<p>objection in the amount being released to the complainant.   I am<\/p>\n<p>of opinion that in these circumstances  the want of objections on<\/p>\n<p>the part of the widow of the deceased can be taken due note of<\/p>\n<p>and the amount in deposit can be directed to be released to the<\/p>\n<p>complainant in the peculiar facts and circumstances of this case.<\/p>\n<p>I   am   satisfied   that   such   a   direction   shall   eminently   serve   the<\/p>\n<p>interests of justice.\n<\/p>\n<\/p>\n<p>      5.       In   the   result,   this   Crl.M.C.   is   allowed.       The   learned<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 3866 OF  2006  -: 3 :-<\/span><\/p>\n<p>Magistrate   shall   release   the   amount   of   Rs.15,000\/-   which   is<\/p>\n<p>available   in   deposit   (as   deposited   by   the   accused.     In   the   case<\/p>\n<p>who   has   been   found   guilty   and   convicted   and   which   verdict   of<\/p>\n<p>guilty   and   conviction   have   already   become   final)   to   the<\/p>\n<p>complainant i.e., the petitioner herein.<\/p>\n<p>                                                                 Sd\/-\n<\/p>\n<p>\n                                                       (R.
