      verified.\u00a0The\u00a0Respondents\u00a0submitted\u00a0that\u00a0in\u00a0view\u00a0of\u00a0the\u00a0advertisement\u00a0policy\u00a02006,\u00a0it\u00a0is\u00a0being\u00a0<\/p>\n
      done \u00a0 by \u00a0 empanelled \u00a0 firms \u00a0 of \u00a0 Chartered \u00a0 Accountants, \u00a0 details \u00a0 whereof \u00a0 are \u00a0 available \u00a0 on \u00a0 the\u00a0<\/p>\n
      website.\u00a0He\u00a0added\u00a0that\u00a0no\u00a0verification\u00a0is\u00a0being\u00a0done\u00a0by\u00a0the\u00a0RNI\u00a0now.\u00a0With\u00a0regard\u00a0to\u00a0point\u00a01\u00a0of\u00a0the\u00a0<\/p>\n

      their\u00a0written\u00a0submissions\u00a0why\u00a0they\u00a0feel\u00a0the\u00a0information\u00a0should\u00a0not\u00a0be\u00a0disclosed\u00a0by\u00a007.01.2011\u00a0to\u00a0<\/p>\n
      the\u00a0Commission\u00a0with\u00a0a\u00a0copy\u00a0each\u00a0to\u00a0the\u00a0Applicant\u00a0and\u00a0the\u00a0Respondents\u00a0and\u00a0the\u00a0Respondents\u00a0

4.     The\u00a0Commission\u00a0received\u00a0a\u00a0communication\u00a0dated\u00a007.01.2011\u00a0from\u00a0the\u00a0Third\u00a0Party\u00a0viz.\u00a0the\u00a0Vir\u00a0<\/p>\n
       Arjun\u00a0Newspapers\u00a0Pvt.\u00a0Ltd.\u00a0through\u00a0its\u00a0Manager\u00a0Admn.\u00a0stating\u00a0that\u00a0the\u00a0Appellant\u00a0alongwith\u00a0his\u00a0<\/p>\n
       two \u00a0 associates \u00a0 viz. \u00a0 Surendra \u00a0 Kumar \u00a0 Pokhriyal \u00a0 and \u00a0 Jai \u00a0 Bhagwan \u00a0 Sharma \u00a0 being \u00a0 retrenched\u00a0<\/p>\n
       employees\u00a0of\u00a0the\u00a0said\u00a0newspaper,\u00a0had\u00a0been\u00a0resorting\u00a0to\u00a0RTI\u00a0questionnaire\u00a0with\u00a0ulterior\u00a0malafide\u00a0<\/p>\n
       motive\u00a0and\u00a0in\u00a0order\u00a0to\u00a0blackmail\u00a0and\/or\u00a0tarnish\u00a0the\u00a0image\u00a0and\u00a0reputation\u00a0of\u00a0the\u00a0Third\u00a0party\u00a0as\u00a0a\u00a0<\/p>\n
       part \u00a0 of \u00a0 their \u00a0 personal \u00a0 vendetta. \u00a0 The \u00a0 Third \u00a0 Party \u00a0 contended \u00a0 that \u00a0 the \u00a0 Appellant \u00a0 alongwith \u00a0 his\u00a0<\/p>\n
       associates \u00a0 sought \u00a0 information \u00a0 regarding \u00a0 the \u00a0 list \u00a0 of \u00a0 distributors, \u00a0 hawkers, \u00a0 bills \u00a0 and \u00a0 schemes\u00a0<\/p>\n
       employed\u00a0by\u00a0the\u00a0Third\u00a0party\u00a0with\u00a0a\u00a0view\u00a0to\u00a0blackmail\u00a0the\u00a0Third\u00a0Party\u00a0that\u00a0the\u00a0information\u00a0will\u00a0be\u00a0<\/p>\n
       handed\u00a0 over\u00a0 to \u00a0 the\u00a0 competitor\u00a0 of\u00a0 the\u00a0 Third \u00a0Party\u00a0 to\u00a0 cause\u00a0 loss\u00a0 in\u00a0 business. \u00a0 The \u00a0Third \u00a0Party\u00a0<\/p>\n
       contends\u00a0that\u00a0the\u00a0Appellant\u00a0and\u00a0his\u00a0associates\u00a0being\u00a0hand\u00a0in\u00a0glove\u00a0with\u00a0the\u00a0competitors\u00a0of\u00a0the\u00a0<\/p>\n
       Third\u00a0Party\u00a0is\u00a0trying\u00a0to\u00a0maliciously\u00a0procure\u00a0information\u00a0which\u00a0is\u00a0of\u00a0commercial\u00a0confidence\/trade\u00a0<\/p>\n
       secret\u00a0and\u00a0cause\u00a0harm\u00a0to\u00a0their\u00a0competitive\u00a0position.\u00a0Hence,\u00a0the\u00a0Third\u00a0Party\u00a0prayed\u00a0that\u00a0such\u00a0<\/p>\n
       information\u00a0being\u00a0exempt\u00a0from\u00a0disclosure\u00a0under\u00a0provisions\u00a0of\u00a0the\u00a0Section\u00a08\u00a0(1)\u00a0(d)\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a0<\/p>\n
       2005,\u00a0the\u00a0appeal\u00a0be\u00a0dismissed\u00a0and\u00a0also\u00a0that\u00a0the\u00a0Commission\u00a0may\u00a0direct\u00a0the\u00a0RNI,\u00a0DAVP\u00a0and\u00a0<\/p>\n
       Ministry\u00a0of\u00a0Information\u00a0that\u00a0any\u00a0such\u00a0information\u00a0pertaining\u00a0to\u00a0commercial\u00a0confidence\/trade\u00a0secret\u00a0<\/p>\n
       of\u00a0the\u00a0Third\u00a0Party\u00a0may\u00a0not\u00a0be\u00a0disclosed\u00a0to\u00a0the\u00a0Appellant\u00a0and\/or\u00a0his\u00a0associates.<\/p>\n
5.     The\u00a0Appellant\u00a0filed\u00a0their\u00a0counter\u00a0arguments\u00a0against\u00a0the\u00a0submissions\u00a0of\u00a0the\u00a0Third\u00a0Party\u00a0stating\u00a0that\u00a0<\/p>\n
       the\u00a0allegations\u00a0of\u00a0blackmailing\u00a0etc\u00a0are\u00a0false\u00a0and\u00a0that\u00a0the\u00a0Appellant\u00a0is\u00a0merely\u00a0trying\u00a0to\u00a0unearth\u00a0the\u00a0<\/p>\n
       misuse\u00a0 of \u00a0public\u00a0fund\u00a0by\u00a0 the\u00a0 publishers\u00a0in\u00a0 collusion \u00a0with \u00a0the\u00a0 officials\u00a0of \u00a0DAVP \u00a0and\u00a0 RNI.\u00a0 The\u00a0<\/p>\n
       Appellant\u00a0leveled\u00a0charges\u00a0of\u00a0siphoning\u00a0of\u00a0Provident\u00a0 Fund\u00a0and\u00a0ESI\u00a0money\u00a0deducted\u00a0 from\u00a0the\u00a0<\/p>\n
       salary\/wages\u00a0of\u00a0the\u00a0employees\u00a0by\u00a0the\u00a0Publishers\u00a0of\u00a0M\/s\u00a0Vir\u00a0Arjun\u00a0Newspapers\u00a0Pvt.\u00a0Ltd.,\u00a0A\u00a0J\u00a0<\/p>\n
       Printers,\u00a0D\u00a0Prabhu\u00a0&\u00a0Co.\u00a0regarding\u00a0which\u00a0a\u00a0criminal\u00a0case\u00a0invoking\u00a0Sections\u00a0406,409\u00a0and\u00a0418\u00a0IPC\u00a0<\/p>\n
       had\u00a0been\u00a0registered\u00a0against\u00a0the\u00a0Managing\u00a0Director\u00a0in\u00a01997.\u00a0The\u00a0Appellant\u00a0contended\u00a0that\u00a0the\u00a0<\/p>\n
       details\u00a0and\u00a0machinery\u00a0had\u00a0been\u00a0fabricated\u00a0by\u00a0the\u00a0Third\u00a0Party\u00a0viz.\u00a0the\u00a0Publishers\u00a0and\u00a0submitted\u00a0<\/p>\n
       before\u00a0the\u00a0RNI\u00a0and\u00a0DAVP\u00a0in\u00a0order\u00a0to\u00a0obtain\u00a0higher\u00a0rate\u00a0of\u00a0contract\u00a0for\u00a0advertisement.\u00a0\u00a0While\u00a0the\u00a0<\/p>\n
       Appellant\u00a0agreed\u00a0the\u00a0Thirty\u00a0Party’s\u00a0contentions\u00a0about\u00a0the\u00a0retrenchment\u00a0of\u00a0the\u00a0Appellant\u00a0and\u00a0his\u00a0<\/p>\n
       associates,\u00a0the\u00a0Appellant\u00a0also\u00a0submitted\u00a0that\u00a0the\u00a0disclosure\u00a0of\u00a0the\u00a0information\u00a0will\u00a0not\u00a0adversely\u00a0<\/p>\n
       affect\u00a0the\u00a0business\u00a0of\u00a0the\u00a0Third\u00a0Party\u00a0since\u00a0the\u00a0newspapers\u00a0of\u00a0various\u00a0publications\u00a0are\u00a0sold\u00a0under\u00a0<\/p>\n
       one\u00a0roof\u00a0at\u00a0various\u00a0sales\u00a0centers.\u00a0\n<\/p>\n
 6.   This\u00a0was\u00a0followed\u00a0by\u00a0a\u00a0rejoinder\u00a0dated\u00a015.01.2011\u00a0received\u00a0from\u00a0the\u00a0Third\u00a0Party\u00a0wherein\u00a0the\u00a0<\/p>\n
     Third \u00a0Party\u00a0stated\u00a0that \u00a0all\u00a0 the\u00a0 allegations\u00a0of\u00a0 the\u00a0Appellant \u00a0were\u00a0totally\u00a0irrelevant\u00a0and \u00a0that\u00a0 the\u00a0<\/p>\n
     Appellant\u00a0and\u00a0his\u00a0associates\u00a0were\u00a0misusing\u00a0the\u00a0various\u00a0legal\u00a0machineries\u00a0only\u00a0as\u00a0an\u00a0attempt\u00a0to\u00a0<\/p>\n
     malign\u00a0the\u00a0reputation\u00a0of\u00a0the\u00a0Third\u00a0Party\u00a0to\u00a0settle\u00a0personal\u00a0scores\u00a0with\u00a0the\u00a0Third\u00a0Party.\u00a0It\u00a0has\u00a0<\/p>\n
     further\u00a0been\u00a0submitted\u00a0by\u00a0the\u00a0Third\u00a0party\u00a0that\u00a0the\u00a0allegations\u00a0of\u00a0the\u00a0Appellant\u00a0about\u00a0the\u00a0collusion\u00a0<\/p>\n
     between\u00a0the\u00a0Third\u00a0Party\u00a0and\u00a0DAVP\u00a0&\u00a0RNI\u00a0are\u00a0baseless\u00a0and\u00a0hence\u00a0have\u00a0not\u00a0been\u00a0corroborated\u00a0<\/p>\n
     by\u00a0 any \u00a0 documentary \u00a0 evidence \u00a0 to \u00a0 this\u00a0 effect. \u00a0 Furthermore, \u00a0 the \u00a0 Third \u00a0 Party \u00a0 confirmed \u00a0 that \u00a0 the\u00a0<\/p>\n
     machinery \u00a0 and \u00a0 manpower \u00a0 used \u00a0 by\u00a0 them \u00a0 are \u00a0 capable \u00a0 to \u00a0 publish \u00a0 the \u00a0 volume \u00a0 of \u00a0 circulation \u00a0 as\u00a0<\/p>\n
     declared\u00a0by\u00a0them.\u00a0To\u00a0the\u00a0contention\u00a0of\u00a0the\u00a0Appellant\u00a0that \u00a0disclosure\u00a0of\u00a0the\u00a0information\u00a0will\u00a0not \u00a0<\/p>\n
     adversely\u00a0affect\u00a0the\u00a0business\u00a0of\u00a0the\u00a0Third\u00a0Party\u00a0since\u00a0the\u00a0newspapers\u00a0of\u00a0various\u00a0publications\u00a0are \u00a0<\/p>\n
     sold\u00a0 under\u00a0 one\u00a0 roof \u00a0 at \u00a0various\u00a0 sales\u00a0 centers, \u00a0the \u00a0 Third \u00a0 Party\u00a0rebutted \u00a0 questioning\u00a0 that \u00a0if \u00a0 the\u00a0<\/p>\n
     information\u00a0was\u00a0available\u00a0in\u00a0the\u00a0open\u00a0market,\u00a0then\u00a0what\u00a0was\u00a0the\u00a0need\u00a0for\u00a0the\u00a0Appellant\u00a0to\u00a0seek\u00a0<\/p>\n
     the\u00a0same\u00a0invoking\u00a0provisions\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a02005.\u00a0The\u00a0crux\u00a0of\u00a0the\u00a0submission\u00a0of\u00a0the\u00a0Third\u00a0Party\u00a0<\/p>\n
     was\u00a0that\u00a0the\u00a0Appellant\u00a0had\u00a0been\u00a0leveling\u00a0false,\u00a0incorrect\u00a0and\u00a0baseless\u00a0allegations\u00a0against\u00a0the\u00a0<\/p>\n
     Third \u00a0 Party \u00a0 without \u00a0 any \u00a0 corroborative \u00a0 or \u00a0 supporting \u00a0 evidence \u00a0 indicating \u00a0 any \u00a0 collusion \u00a0 or\u00a0<\/p>\n
     malpractice\u00a0at\u00a0the\u00a0end\u00a0of\u00a0the\u00a0Third\u00a0Party\u00a0to\u00a0malign\u00a0and\/or\u00a0tarnish\u00a0the\u00a0goodwill\u00a0of\u00a0the\u00a0Third\u00a0Party.\u00a0<\/p>\n
     The\u00a0Appellant\u00a0allegedly\u00a0sought\u00a0the\u00a0commercially\u00a0confidential\u00a0information\u00a0simply\u00a0with\u00a0the\u00a0intention\u00a0<\/p>\n
     of\u00a0causing\u00a0financial\/commercial\u00a0and\/or\u00a0business\u00a0loss\u00a0to\u00a0the\u00a0Third\u00a0Party.\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n
7.   Upon\u00a0perusal\u00a0of\u00a0all\u00a0the\u00a0documents\u00a0submitted\u00a0by\u00a0the\u00a0parties\u00a0and\u00a0considering\u00a0all\u00a0the\u00a0arguments\u00a0of\u00a0<\/p>\n
     the\u00a0parties,\u00a0it\u00a0is\u00a0noted\u00a0that\u00a0it\u00a0is\u00a0beyond\u00a0question\u00a0that\u00a0the\u00a0information\u00a0sought\u00a0by\u00a0the\u00a0Appellant\u00a0deals\u00a0<\/p>\n
     with \u00a0 commercially \u00a0 sensitive \u00a0 and \u00a0 confidential \u00a0 information \u00a0 relating \u00a0 to \u00a0 the \u00a0 business \u00a0 of \u00a0 the \u00a0 Third\u00a0<\/p>\n
     Party.\u00a0These\u00a0information\u00a0can\u00a0be\u00a0misused\u00a0to\u00a0adversely\u00a0affect\u00a0the\u00a0competitive\u00a0position\u00a0of\u00a0the\u00a0Third\u00a0<\/p>\n
