It was<br \/>\njointly submitted by learned counsel on both sides that, after the<br \/>\npetitioner being convicted for the offence under section 161 of the<br \/>\nGujarat Panchayats Act, 1961 for allowing his cattle to stray in the<br \/>\nfield of the complainant and causing damage to the crops and after<br \/>\nrejection of his appeal, the parties have entered into an amicable<br \/>\nsettlement and the petitioner has made good the loss caused to the<br \/>\noriginal complainant.  Therefore, the original complainant i.e.<br \/>\nrespondent No.2, as also the learned APP had no objection to  the<br \/>\norder of conviction and sentence being set aside in the interest of<br \/>\njustice and to prevent unnecessary imprisonment of one month for the<br \/>\npetitioner.  Therefore, by consent and  upon joint request of the<br \/>\nparties who are present in the court, the petition is allowed and the<br \/>\njudgment and order dated 28.8.1997 of learned J.M.F.C., Matar and the<br \/>\norder dated 7.1.1998 of learned Sessions Judge in Criminal Appeal<br \/>\nNo.7 of 1997 are set aside.
