APP (DB) No.232 of 2010\n                             JANARDAN SINGH\n                                    Versus\n                             STATE OF BIHAR\n                                  -----------\n<\/pre>\n<p>6   15.3.2011                 Heard learned counsel for the appellant and<\/p>\n<p>                learned counsel for the State in respect of IA No.187 of<\/p>\n<p>                2011.\n<\/p>\n<p>                              Through this application under Section 389<\/p>\n<p>                (1) read with Section 482 of the Code of Criminal<\/p>\n<p>                Procedure, the appellant has prayed for suspension of his<\/p>\n<p>                conviction by the judgment and order under appeal dated<\/p>\n<p>                21.12.2009 for offence under Section 302\/34 of the Indian<\/p>\n<p>                Penal Code.\n<\/p>\n<p>                              Learned   counsel   for   the   appellant   has<\/p>\n<p>                submitted that the necessity to stay the judgment of<\/p>\n<p>                conviction against the appellant has arisen on account of an<\/p>\n<p>                order dated 16.9.2010 issued from the office of the District<\/p>\n<p>                Superintendent of Education, Patna contained in Annexure-<\/p>\n<p>                A to the IA whereby the appellant has been dismissed from<\/p>\n<p>                service on account of his conviction which in the opinion of<\/p>\n<p>                the employer shows moral turpitude. The order of dismissal<\/p>\n<p>                is with effect from 21.12.2009 when the appellant was<br \/>\n<span class=\"hidden_text\">               -2-<\/span><\/p>\n<p>taken into custody after conviction.<\/p>\n<p>             It was further submitted that on behalf of the<\/p>\n<p>appellant that on merits, the appellant has a good case<\/p>\n<p>because the informant did not name him as accused in the<\/p>\n<p>FIR and subsequently some witnesses have deposed that he<\/p>\n<p>was seen at the place of occurrence along with other<\/p>\n<p>accused persons, who fired at the deceased and only one<\/p>\n<p>witness PW 1 has deposed that he heard the appellant<\/p>\n<p>exhorting other accused to fire and kill.<\/p>\n<p>             Learned counsel for the State has submitted<\/p>\n<p>that the informant has admitted that he is not an eye witness<\/p>\n<p>of the occurrence and he came to know through others<\/p>\n<p>that his brother has been shot and removed to hospital. He<\/p>\n<p>further submitted that at this stage it would not be proper to<\/p>\n<p>hold that the judgment of conviction against the appellant<\/p>\n<p>has no merits and requires suspension so as to enable the<\/p>\n<p>appellant to work as a teacher.
