He has submitted<br \/>\nthat the trial court has committed an error in rejecting the<br \/>\napplication for attachment of property which essentially amounts to<br \/>\nrejecting the suit without trial and passing final decree therein.\n<\/p>\n<p>4.\tThis<br \/>\ncourt has heard learned advocates for the parties and perused the<br \/>\npapers on record.  The trial court has proceeded on the footing that<br \/>\nthe defendant prima facie does not seem to be the owner of the<br \/>\nproperty under Order 38 Rule 5 of the Civil Procedure Code. The trial<br \/>\ncourt has observed that it is not shown as to how the disposal of the<br \/>\nproperty assuming that the defendants have interest in the property<br \/>\nis intended to defeat the decree that may be passed in favour of the<br \/>\nplaintiff. However,  while rejecting the Ex. 52 application, the<br \/>\ntrial court has borne in mind the fact that the interest of the<br \/>\nappellant is secured in view of the fact that while considering the<br \/>\nsummons for judgement and leave to defend application, the Court<br \/>\ndeemed it appropriate to secure the interest of appellant by<br \/>\nrequiring a sum of Rs. 5 lakhs which subsequently by consent was<br \/>\nmodified to Rs. 3 lakhs which was deemed to be a sufficient security.<br \/>\nThis court is of the opinion that the impugned order does not call<br \/>\nfor any interference by this court.\n<\/p>\n<p>5.\tIn<br \/>\nthe premises aforesaid, appeal is dismissed.
