The \u00a0 Applicant \u00a0 filed \u00a0 an \u00a0 RTI \u00a0 Application \u00a0 dt.27.4.11 \u00a0 with \u00a0 the \u00a0 PIO, \u00a0 NSIT \u00a0 seeking \u00a0 the \u00a0 following\u00a0<\/p>\n<p>       information:\n<\/p>\n<p>       i)         A\u00a0readable\u00a0and\u00a0certified\u00a0copy\u00a0of\u00a0complaint\u00a0made\u00a0by\u00a0Mrs.Hema\u00a0Agrawal,\u00a0SLA\u00a0dt.29.7.10 \u00a0<\/p>\n<p>       (diary\u00a0on\u00a05.8.10)\u00a0against\u00a0the\u00a0Applicant<\/p>\n<p>       ii)        A \u00a0 readable \u00a0 and \u00a0 certified \u00a0 copy \u00a0 of \u00a0 facts \u00a0 and \u00a0 findings \u00a0 of \u00a0 the \u00a0 Committee \u00a0 (Chairman \u00a0<\/p>\n<p>       Dr.O.P.Thakur)\u00a0made\u00a0on\u00a0complaint\u00a0of\u00a0Mrs.Hema\u00a0Agrawal\u00a0against\u00a0the\u00a0Applicant<\/p>\n<p>       iii)       Any\u00a0other\u00a0documents\u00a0regarding\u00a0the\u00a0complaint\u00a0submitted\u00a0by\u00a0Mrs.Hema\u00a0Agrawal.<\/p>\n<p>       iv)        A\u00a0readable\u00a0and\u00a0certified\u00a0copy\u00a0of\u00a0statement\u00a0of\u00a0witness\u00a0if\u00a0any\u00a0produced\/examined\u00a0on\u00a0behalf\u00a0of \u00a0<\/p>\n<p>       Mrs.Hema\u00a0Agrawal\u00a0regarding\u00a0the\u00a0complaint.\n<\/p>\n<p>       Dr.Vijander \u00a0 Singh, \u00a0 SPIO \u00a0 replied \u00a0 on \u00a0 26.5.11 \u00a0 stating \u00a0 that \u00a0 the \u00a0 third \u00a0 party \u00a0 Ms.Hema \u00a0 vide \u00a0 her\u00a0<\/p>\n<p>       representation\u00a0dt.20.5.11\u00a0has\u00a0denied\u00a0disclosure\u00a0of\u00a0the\u00a0information.\u00a0\u00a0Not\u00a0satisfied\u00a0with\u00a0the\u00a0reply,\u00a0the\u00a0<\/p>\n<p>       Applicant \u00a0 filed \u00a0 an \u00a0 appeal \u00a0 dt.30.5.11 \u00a0 with \u00a0 the \u00a0 Appellate \u00a0 Authority \u00a0 reiterating \u00a0 her \u00a0 request \u00a0 for \u00a0 the\u00a0<\/p>\n<p>       information.\u00a0 \u00a0Prof.\u00a0A.P.Mittal,\u00a0Appellate\u00a0Authority\u00a0disposed\u00a0of\u00a0the\u00a0appeal\u00a0vide\u00a0his\u00a0order\u00a0dt.20.6.11\u00a0<\/p>\n<p>       upholding\u00a0the\u00a0decision\u00a0of\u00a0the\u00a0SPIO\u00a0against\u00a0points\u00a0(i),\u00a0(iii)\u00a0and\u00a0(iv).\u00a0\u00a0He,\u00a0however,\u00a0directed\u00a0the\u00a0PIO\u00a0to\u00a0<\/p>\n<p>       provide\u00a0the\u00a0report\u00a0of\u00a0the\u00a0facts\u00a0finding\u00a0committee\u00a0for\u00a0purpose\u00a0to\u00a0the\u00a0Applicant\u00a0within\u00a015\u00a0days\u00a0of\u00a0this\u00a0<\/p>\n<p>       hearing. \u00a0 \u00a0 The \u00a0 Applicant \u00a0 filed \u00a0 a \u00a0 second \u00a0 appeal \u00a0 dt.18.7.11 \u00a0 before \u00a0 CIC \u00a0 stating \u00a0 that \u00a0 the \u00a0 required\u00a0<\/p>\n<p>       information\/proofs\u00a0&amp;\u00a0exhibits\u00a0have\u00a0not\u00a0been\u00a0\u00a0received.<\/p>\n<p>Decision<\/p>\n<p>2.     After\u00a0hearing\u00a0both\u00a0sides,\u00a0it\u00a0was\u00a0noted\u00a0that\u00a0the\u00a0third\u00a0party\u00a0had\u00a0filed\u00a0a\u00a0complaint\u00a0against\u00a0the\u00a0Appellant\u00a0<\/p>\n<p>       holding\u00a0the\u00a0\u00a0Appellant\u00a0responsible\u00a0for\u00a0the\u00a0alleged\u00a0affair\u00a0between\u00a0her\u00a0husband\u00a0and\u00a0the\u00a0daughter\u00a0of\u00a0the\u00a0<\/p>\n<p>       Appellant\u00a0who\u00a0is\u00a0an\u00a0adult.\u00a0 \u00a0The\u00a0Appellant\u00a0on\u00a0the\u00a0other\u00a0hand\u00a0\u00a0believes\u00a0that\u00a0the\u00a0third\u00a0party\u00a0is\u00a0simply\u00a0<\/p>\n<p>       telling\u00a0lies\u00a0and\u00a0that\u00a0her\u00a0daughter\u00a0is\u00a0totally\u00a0innocent.\u00a0It\u00a0was\u00a0also\u00a0observed\u00a0that\u00a0the\u00a0Public\u00a0Authority\u00a0on\u00a0<br \/>\n          the\u00a0basis\u00a0of\u00a0the\u00a0complaint\u00a0filed\u00a0by\u00a0the\u00a0third\u00a0party,\u00a0had\u00a0constituted\u00a0a\u00a0Committee\u00a0to\u00a0enquire\u00a0into\u00a0the\u00a0<\/p>\n<p>         alleged\u00a0affair\u00a0and\u00a0that\u00a0based\u00a0on\u00a0the\u00a0findings\u00a0had\u00a0issued\u00a0a\u00a0memo\u00a0to\u00a0the\u00a0Appellant\u00a0which\u00a0has\u00a0prompted\u00a0<\/p>\n<p>         the\u00a0Appellant\u00a0to\u00a0seek\u00a0the\u00a0information\u00a0under\u00a0RTI.\u00a0\u00a0The\u00a0Appellant\u00a0questioned\u00a0the\u00a0basis\u00a0on\u00a0which\u00a0she\u00a0<\/p>\n<p>         has\u00a0been\u00a0issued\u00a0\u00a0the\u00a0\u00a0memo.\n<\/p>\n<\/p>\n<p>3.       Even\u00a0after\u00a0careful\u00a0consideration\u00a0of\u00a0the\u00a0facts\u00a0and\u00a0circumstances\u00a0of\u00a0the\u00a0case,\u00a0 \u00a0the\u00a0Commission\u00a0is\u00a0<\/p>\n<p>         unable\u00a0to\u00a0understand\u00a0the\u00a0basis\u00a0on\u00a0which\u00a0the\u00a0Public\u00a0Authority\u00a0had\u00a0actually\u00a0constituted\u00a0a\u00a0Committee\u00a0to\u00a0<\/p>\n<p>         look\u00a0into\u00a0the\u00a0matter\u00a0and\u00a0has\u00a0issued\u00a0a\u00a0memo\u00a0to\u00a0the\u00a0Appellant\u00a0since\u00a0the\u00a0matter\u00a0is\u00a0purely\u00a0personal\u00a0in\u00a0<\/p>\n<p>         nature\u00a0involving\u00a0relatives\u00a0of\u00a0the\u00a0Appellant\u00a0and\u00a0the\u00a0third\u00a0party\u00a0who\u00a0have\u00a0nothing\u00a0to\u00a0do\u00a0with\u00a0the\u00a0Public\u00a0<\/p>\n<p>         Authority.\u00a0The\u00a0 \u00a0Public\u00a0Authority\u00a0therefore\u00a0 \u00a0is\u00a0not\u00a0expected\u00a0to\u00a0be\u00a0holding\u00a0any\u00a0information\u00a0with\u00a0them\u00a0<\/p>\n<p>         about\u00a0this\u00a0matter\u00a0.\u00a0 \u00a0It\u00a0is\u00a0also\u00a0the\u00a0opinion\u00a0of\u00a0the\u00a0Commission\u00a0that\u00a0the\u00a0Public\u00a0Authority,\u00a0for\u00a0reasons\u00a0<\/p>\n<p>         given\u00a0already,\u00a0had\u00a0no\u00a0business\u00a0to\u00a0conduct\u00a0an\u00a0enquiry\u00a0into\u00a0the\u00a0matter\u00a0and\u00a0to\u00a0issue\u00a0a\u00a0memo\u00a0to\u00a0the\u00a0<\/p>\n<p>         Appellant\u00a0based\u00a0on\u00a0the\u00a0enquiry.\u00a0\n<\/p>\n<\/p>\n<p>4.       It \u00a0 is \u00a0 therefore \u00a0 recommended \u00a0 that \u00a0 the \u00a0 Public \u00a0 Authority \u00a0 \u00a0 return \u00a0 the \u00a0 complaint \u00a0 and \u00a0 other \u00a0 related\u00a0<\/p>\n<p>         documents\u00a0available\u00a0with\u00a0them\u00a0to\u00a0the\u00a0third\u00a0party.\u00a0It\u00a0is\u00a0also\u00a0recommended\u00a0that\u00a0the\u00a0memo\u00a0issued\u00a0to\u00a0the\u00a0<\/p>\n<p>         Appellant\u00a0pursuant\u00a0\u00a0to\u00a0the\u00a0enquiry\u00a0that\u00a0was\u00a0held\u00a0\u00a0be\u00a0taken\u00a0back\u00a0since\u00a0the\u00a0\u00a0holding\u00a0of\u00a0the\u00a0\u00a0enquiry\u00a0by\u00a0<\/p>\n<p>         the\u00a0Public\u00a0Authority\u00a0about\u00a0relatives\u00a0of\u00a0employees\u00a0who\u00a0have\u00a0nothing\u00a0to\u00a0do\u00a0with\u00a0the\u00a0Public\u00a0Authority\u00a0<\/p>\n<p>         cannot\u00a0be\u00a0considered\u00a0as\u00a0justified\u00a0under\u00a0any\u00a0rule.\u00a0<\/p>\n<p>5.
